The Saeima has adopted and the President promulgated the following laws: State and local professional Orchestra, choir, koncertorganizācij, theater and circus artists of the retirement pensions Act article 1. The terms used in the law, the law is applied in the following terms: 1) Ballet artist (ballet soloist, baletdejotāj, dancer), a person whose job is to execute the solodej, dances alone, with a partner, ensemble or dance group performance, concerts;
2) circus artist [Circus contortionist, circus performances, clown heads, illusionist (magician), juggler, gymnast, Tamer, balancer, athlete, Fakir]: a person whose job is to provide a public circus performances;
3) artists Kora (choir singer, vocalist): a person whose job is to sing the ensemble, choir, play the music;
4 puppet theatre) actor (actor): a person whose job is to execute the role, directing the dolls (doll, of the parter trost doll, puppet), in dramatic performance in the theatre;
5) Orchestra artist (Orchestra musician, instrument musician, pūšaminstrument musician, percussionist, musician, string instrument musician): a person whose job is to play one or more musical instruments in the Orchestra, playing music;
6) soloist vocalist (singer): a person whose job is to sing the role, solopartij or singing ensemble, playing musical works performance, concerts;
7) Theatre Actor (actor, actress, travestij): a person whose job is to execute the roles in dramatic performance in the theatre;
8) State and local professional Orchestra, choir, koncertorganizācij, theatre and circus artist, Ballet, circus, choral or orchestral artists, theatre or puppet theater actor, lead singer vocalist.
2. article. The purpose of the law this law aims to provide national or local professional Orchestra, choir, koncertorganizācij, theater and circus artists (hereinafter person) the right to a retirement pension due to the fact that these professions after a fixed period of employment, job related to the loss of skills before the age pension for age and retirement pensions, and cost calculation.
3. article. The right to a retirement pension (1) the right to a retirement pension is: 1) Ballet artists worked for 18 years at;
2) soloists and vocalists circus artists — after 20 years worked;
3) artists, after the Orchestra worked for 25 years;
4 artists by the choir) worked for 25 years;
5 puppet theatre actor) — after 25 years spent working;
6 Theatre actors — after) worked for 30 years.
(2) the right to a retirement pension is persons not less than 10 years worked in the profession and have a job in this profession, reaching the following ages: 1) Ballet and circus artists — 38 years;
2) soloists vocalist — 45 years;
3) orchestras artists 50 years;
4) choral artists 50 years;
5) actor of puppet shows, 50 years;
6 the actor of theatre-55) years.
(3) the right to a retirement pension is a person who meets the first and second parts as defined and exempted from work after the entry into force of this law, except in the fourth paragraph of this article, the persons mentioned.
(4) entitlement to a retirement pension is Ballet artists, circus artists, choral artists, puppet theatre actors, orchestral artists (musicians pūšaminstrument), actresses, singers travestij vocalist who released from work from 1 January 1999 to 1 January 2005 and which correspond to the first and second subparagraphs.
(5) do not have the right to a retirement pension to a person who has reached the age laid down for the granting of old age pensions, with the exception of article 7 of this law in the sixth part.
4. article. The calculation of the retirement seniority (1) retirement service that gives the right to a retirement pension, including the State and local professional Orchestra, choir, koncertorganizācij, theatre or circus of time worked.
(2) the retirement seniority, giving entitlement to a retirement pension, also included time spent working in a professional Orchestra, choir, koncertorganizācij, theater, circus, which until 1990 4 may operate in the territory of Latvia.
(3) persons who worked for the law referred to in article 3 of the professions, the retirement seniority is calculated by adding each of the professions of the time worked. The calculation of the retirement pension of the required number of years of service is determined by the last profession who worked for not less than three years.
5. article. Wages from which the calculation of the retirement pension (1) the retirement pension is calculated from the monthly average wage in the profession over the past 36 months worked. If the last 36 months has been a labour relations break in the profession, the calculation includes a 36 month period before and after the break, summing it up.
(2) the monthly average wage calculated on the 36-month wage divided by the total 36. Wages include wages and the law, collective agreement or employment contract in certain allowances, as well as bonuses.
6. article. Retirement pensions retirement pension award deadlines without a time-limit granted to the person who freed from working in the profession, which confer the right to such pension pursuant to article 3 of this law.
7. article. The calculation of the retirement pension and retirement pension funds for the cost of (1) the retirement pension of 55 percent of the person's average monthly pay is given in accordance with article 3 of the law laid down in the first paragraph of years worked in the profession.
(2) a retirement pension 45 percent of a person's average monthly pay is given according to this law, the second subparagraph of article 3 in the age and the years spent working in the profession.
(3) the amount of the retirement pension must not be less than the State social security benefit.
(4) the amount of the retirement pension must not exceed 10 times the State social security benefit.
(5) retirement pensions paid from State budget funds allocated under the annual State budget Act appropriation.
(6) retirement pensions retirement pension beneficiary is assigned in accordance with the law "on State pensions". When the beneficiary reaches retirement pension the law "on State pensions" a certain age, he will stop the retirement pension paid to old age pensions. After the granting of old-age pensions retirement pension cost restores, reduced by the amount of the old-age pension awarded.
8. article. Increase the amount of the retirement pension (1) the amount of the retirement pension is reviewed annually, taking into account country specific consumer price and wage index insurance changes.
(2) the amount of the retirement pension shall be reviewed in the same order that determines the indexing State pensions granted according to the law "on State pensions".
9. article. Retirement pensions and the cost of the procedure for requesting (1) retirement pension and the documents required for the granting of the Cabinet in the order submitted to the Ministry of Culture of the people.
(2) the Ministry of culture of the retirement pension and the granting of the request the necessary documents within 10 days of the appearance of their submission and the decision taken shall notify the applicant of the retirement pension.
(3) the retirement pension granted to the Ministry of culture.
(4) the persons who are entitled to more of the retirement pensions are granted only one pension check of the person concerned.
(5) the procedures for the payment of the retirement pension is determined by the Cabinet of Ministers.
(6) the retirement pension beneficiary may authorize another person to receive his pension. After one powers the trustee of the pension payable for not more than six months in a row.
(7) this law disputes concerning the provision of rights in court.
10. article. The cost of the retirement pension termination or amendment of (1) the amount of the retirement pension paid off or extent of amending this law in the following cases: 1) the retirement pension recipient is granted an old-age pension in accordance with the law "on State pensions";
2) beneficiary of the retirement pension shall enter into a new employment relationship professional Orchestra, choir, koncertorganizācij, theater, circus, which gives it the right to a retirement pension.
(2) the retirement pension beneficiary is obliged within 10 days notify the Ministry of Culture of the first paragraph of this article, the conditions.
11. article. The retirement pension paid on time elapsed (1) Calculate the amount of the retirement pension which the pension recipient is received in time, the cost of the passage of time, but not more than three years.
(2) If the calculated amount of the retirement pension is not received during the fault, which is granted or paid to a retirement pension, the amount paid for the passage of time without a time limit.
12. article. Deductions from retirement pension (1) deduction of the retirement pension can be made: 1) on the basis of a court order;

In this case, the forfeited each month not more than 10 percent of the amount of the retirement pension payable until the overpayment amount is deleted.

(3) the total deduction amount per month can not exceed 50 percent of the amount of the retirement pension.
(4) If payment of the retirement pension is interrupted before the debt, the amount of the debt shall recover the remaining laws.
13. article. Due to the death not received retirement pensions and death grants (1) to the cost of the retirement pension paid to the beneficiary's death, but not paid, calculated the amount of the retirement pension is entitled to a pension of the spouse of the beneficiary or the first or second degree relatives.

The law shall enter into force on 1 January 2005.
