The Saeima has adopted and the President promulgated the following laws: amended military retirement pension Act to make military retirement pension Act (the Saeima of the Republic of Latvia and the Cabinet of Ministers rapporteur, 1998, no. 8; 2000, no. 9; 2001, nr. 1; 2005, nr. 2, 14; 2006, no. 13; 2007, nr. 24; 2008, no. 10) follows: 1. Article 2 of the first paragraph: make paragraph 1 by the following: "1) not less than 20 years If the military least consecutive not less than 15 years; ".
Replace in paragraph 2, the figure "10" with the number "15".
2. Replace article 3 the number "10" with the number "15".
3. Replace article 6, fourth paragraph, the number "10" with the number "15".
4. transitional provisions be supplemented by 14, 15, 16, 17, 18, 19 and 20 the following: "14. From 1 July 2009 to 2012 December 31 retirement pensions to a recipient who has been granted a retirement pension until 30 June 2009, the retirement pension shall be recalculated and reduced by 10 per cent of the calculated retirement pension. The Department of Defense military retirement pension adjustment to 3 July 2009.
15. From 1 July 2009 to 2012 December 31 retirement pension is determined 90% of article 6 of this law in accordance with the procedure laid down in the calculated retirement pension.
16. From 1 July 2009 to 2012 December 31 retirement pension beneficiary, who in July 1, 2009 is necessarily socially insured person (employees or self-employed) retirement pension shall be recalculated and reduced by 70% of the calculated retirement pension. The amount of the retirement pension shall be renewable with the first date of the month following the month in which it lost in the insured person's social status. If the beneficiary of the retirement pension 1 July 2009 is necessarily socially insured person (employees or self-employed), his duty is to the July 6, 2009 to inform the Ministry about it, as well as optional socially insured person's loss of status within three working days from the moment of this loss of status.
17. From 1 July 2009 to 2012 December 31 retirement pension beneficiary, which becomes mandatory for the socially insured persons (employees or self-employed), with the first date of the month following the month in which the retirement pension beneficiary become the mandatory social insurance, retirement pension shall be recalculated and reduced by 70% of the calculated retirement pension. The amount of the retirement pension shall be renewable with the first date of the month following the month in which it lost in the insured person's social status. The retirement pension beneficiary is obliged, within three working days of the mandatory social status of the insured person or the loss now inform the Defence Ministry.
18. By 2010, December 31, the right to a retirement pension is a military personnel, which, in accordance with article 3 of this law, the retirement seniority is calculated: 1) not less than 20 years;
2) less than 20 years military service opened up to 31 December 2004 and the least consecutive not less than 10 years or if military service launched by 1 January 2005 and continually least consecutive 10 years and retired: a) due to active military service for maximum age, b) illness or health condition, c) reduction in the number of posts, d) that's gone for a certain period of time in a closed service contract expires.
19.2010 December 31 retirement seniority, giving entitlement to a retirement pension, in addition to this law, article 3, first paragraph, 1, 2, and 3 as specified in paragraph including: 1) service in the armed forces of other countries, border and internal troops and authorities, with the exception of the Interior of the USSR State Security Committee and its subordinate institutions, military personnel that service under the Ministry of defence or the military departments started before the entry into force of this law and those of at least three nodienējuš years but the military, which launched the service after the entry into force of this Act, if in the 10 years of days;
2) service prosecution authority prosecutors and investigators in positions in the military, which before the entry into force of this Act assigned to the most recent, third, second or first class lawyers, the newest justice Advisor, Justice Advisor, Senior Advisor of Justice or national justice Advisor rank and authority of the Ministry of defence or military unit under the nodienējuš for at least three years, but the military, which launched the service after the entry into force of this law If in 10 years, days;
3) insurance indemnity in accordance with the law "on State pensions" before active military or military personnel of the service lines that service under the Ministry of defence or the military departments started before the entry into force of this law and they nodienējuš at least three years, but the military, which launched the service after the entry into force of this Act, if: (a) the days in the 10 years) 80% 100% b), or before the active military rank of the days not less than five years of service in the National Guard ārrind.
20. By 2010 31 December of each year for the military, which runs out to a 20-year retirement to reduce the length of a retirement pension of 2% of article 6 of this law laid down in the first subparagraph the amount of the pension, if the days not less than 10 years, and if the soldiers are retired: 1) due to active military service for maximum age;
2) illness or health condition;
3) reduce the number of posts;
4) due to the fact that is terminated at a certain time in the service of the term of the contract is concluded. "
The law shall enter into force on July 1, 2009.
The Parliament adopted the law of 16 June 2009.
