The Saeima has adopted and the President promulgated the following laws: the law on the movement of the seed to make the life of seed Act (Republic of Latvia Saeima and the Cabinet of Ministers rapporteur, 1999, no. 22; 2002, 11 no, no. 22; 2003; 2004, nr. 21; 2006, nr. 1; 2007; 2008, no 3, No 15; 2009, nr. 20) the following amendments: 1. Put the name of the law by the following: "the varieties of seeds and the chain rule".
2. Express article 1 by the following: "article 1. The purpose of the law (1) this law aims at: 1) protect consumers from poor quality seed for sowing seeds;
2) regulate agricultural crops, vegetables, fruit and berry varieties.
(2) this law shall apply to: 1) agricultural crops and vegetable species referred to in the law on solely and seed;
2) fruit and Berry species listed in regulations on fruit and Berry propagating material movements. To the fruit and Berry species subject to this law, only V1 chapter. "
3. in article 2, paragraph 1: turn off the "f" section;
Add to paragraph 1, with the "h" and "i" in subparagraph by the following: "(h)) issued under certain circumstances, the recognition of the variety of vegetable breeding and seed movement provisions. Under certain circumstances, the breeding of vegetable variety is a variety which has no significant value in commercial vegetable production but which is designed for the production of specified conditions, for example, special agrotehnisko, climatic or soil-specific conditions (hereinafter referred to, under certain circumstances, the breeding of vegetable variety), i) issued rules on the marketing of fodder plant seed mixtures intended for the conservation of the natural environment; "
4. turn off the "l" section;
to make the "o" in paragraph 4 subparagraph by the following: "o) organized or carried out a follow-up to certified seed, '' variety keep seeds and breeding of vegetables in certain circumstances of variety seed";
Supplement point 4 with the "p" section as follows: "p") permits the marketing of fodder plant seed extraction and marketing of mixtures intended for the conservation of the natural environment (hereinafter referred to as the seed mixes for the conservation of the natural environment). "
4. in article 5: Add to the name of the article after the word "variety" with the words "and in certain circumstances, breeding varieties of vegetables";
to supplement the article with the third part as follows: "(3) in certain circumstances, the recognition of the variety of vegetable breeding and seed movement provisions governing: 1) the requirements under certain circumstances, the recognition of the variety of cultured vegetables;
2) minimum requirements and procedures to be carried out under certain circumstances, breeding of vegetable varieties for distinctness, uniformity and stability test;
3) requirements and procedures for certain circumstances, breeding of vegetable variety be included in the catalogue of plant varieties of Latvia;
4) requirements, under certain circumstances, breeding varieties of vegetable seed to the movement;
5) requirements, under certain circumstances, breeding varieties of vegetable seed quality;
6) requirements, under certain circumstances, breeding varieties of vegetable seed packaging and labelling;
7) requirements, under certain circumstances, breeding of vegetable varieties for the post-control of seed kontrollauciņo. "
5. To supplement the law with article 5.1 by the following: ' article 5.1. The provisions on plant seed mixtures for the conservation of the natural environment rules on the marketing of seed mixtures for the conservation of the natural environment is governed by: 1) mixtures of seeds harvested in ways and areas from which allowed them to collect;
2) order in which issue and withdraw an authorization for marketing of seed mixtures;
3 commercial seed mixtures) quantitative restrictions;
4) requirements to the quality of seed mixtures;
5 seed mixtures) packaging and labelling. "
6. Supplement article 7 to the fourth paragraph as follows: "(4) the State plant protection service of the decision on the authorisation of the certified seed germination or reduced decision on authorisation to lower the random seed category adopted month solely and seed trade rules for the submission of the application."
7. Supplement 7.1 the second paragraph of article 4 of the following paragraph: "4) under certain circumstances, breeding of vegetable varieties seed if the variety is entered in the catalogue of plant varieties as breeding in certain circumstances a vegetable variety, subject to certain conditions of vegetable breeding and seed variety chain requirements contained in the regulations."
8. Add to article 8 to the third paragraph as follows: "(3) the State plant protection service of the decision on the conformity of seed varieties volume acquisition shall be adopted for a period of three months, while the divgadīgaj and the multiannual species of vegetable — 15 months solely and seed trade rules for the submission of the application, but not later than three working days after the last inspections."
9. Article 9: put the second part as follows: "(2) '', seed store and, under certain circumstances, breeding of vegetable varieties seed quality assess the preparer or packer, or of the national plant protection services.";
off in the third paragraph, the words "(published by the national plant protection service website on the internet);
to supplement the article with the fourth paragraph as follows: "(4) the State plant protection service of the decision on the conformity of the quality of the seed of the species concerned solely and seed trade terms of the categories of seed, the requirements shall be adopted within two months after the date of submission of the application, but not later than within three working days of the international seed testing Association (ISTA) rules on expiry of analysis."
10. Article 11: make the first paragraph by the following: "(1) catalogue of the Latvian plant is the plant variety list that includes the seeds of varieties allowed to certify and verify how '', seed or variety to be retained under certain conditions of vegetable seed breeding and selling them under solely and seed trade rules, as well as varieties or to be retained under certain circumstances, the recognition of the variety of vegetable breeding and seed supply chain rules.";
Supplement to the third part of paragraph 9 by the following: "9") in certain circumstances, the breeding of vegetable variety ", if it is included in the catalog as breeding in certain circumstances a vegetable variety."
11. in article 11.1: make the first part of the introductory part of paragraph 1 by the following: "1) it was recognized as a distinct, uniform and stable according to the laws of a variety concerning the appraisal of its distinctness, uniformity and stability test. The breed is recognized for: ";
make the first part of paragraph 2 as follows: "2) its name corresponds to the International Union for the protection of new varieties of plants (UPOV) and European Union law. State plant protection service of the decision on the conformity of the variety denomination shall be adopted within six months after the date of the application for entry in the catalogue of the variety ";
adding to the fifth subparagraph of paragraph 2 with the words "and in certain circumstances, the breeding of vegetable varieties";
to supplement the article with the eleventh, twelfth and thirteenth part as follows: "(11) in certain circumstances, be accepted for breeding of vegetable variety and include catalog, if it meets the following conditions: 1) under certain circumstances, the recognition of the variety of vegetable breeding and seed movement rules is recognized as distinct, uniform and stable according to the minimum requirements for the breeding of certain circumstances vegetable varieties for distinctness, uniformity and stability;
2) is the variety of commercial vegetable production values, but it is designed for the production of special agrotehnisko, climatic or soil-specific conditions;
3) have been complied with under certain circumstances, the recognition of the variety of vegetable breeding and seed supply chain requirements in the rules.
(12) national plant protection service, after receiving the application for entry in the catalogue of the variety, shall decide on: 1) species, which are to carry out the economic evaluation of the characteristics of the variety: (a) a period of three years), cereals (summer form) annual fodder plants, oil (summer form), textile, potatoes and beet varieties, b) three and a half years-cereal (form field) and oilseeds (form field), c) within five years — a perennial forage plant varieties;
2) species for which, in accordance with the first subparagraph of paragraph 3 of the economic evaluation of the characteristics of the variety is not required — seven months.
(13) If, after the national plant variety Board proposal, the term of the economic characteristics of the variety of assessment is extended for one year, respectively, for a one year period is extended also to the decision on the inclusion of the varieties catalog. "
12. To supplement the law with the V1 as follows: section "V1 chapter fruit and berry varieties of 12.1 article. Fruit and berry varieties of list building and maintenance (1) fruit and berry varieties list (list of varieties) include regulations on fruit and Berry movement of propagating material of these fruit and Berry of the genera and species, as well as interspecific hybrid varieties.

(2) the list of varieties shall be kept and maintained the national plant protection service.
(3) the Cabinet of Ministers issued the rules on the making of a list of varieties that provides: 1) requirements and procedures for the breed include and maintain the list of varieties as well as excluded from it;
2) the requirements in the description of the variety and its recognition;
3) order in which the stored and published with the list of varieties related information;
4) with the list of varieties related to the procedure for the exchange of information.
(4) the list of the varieties of propagating material of varieties allowed to be sold in accordance with the laws and regulations on fruit and Berry propagating material movements.
(5) the list of varieties indicating the following information: 1 the name of the species;)
2) denomination of the variety;
3) the country in which the variety was bred;
4) breeder, breed peacekeepers and their authorized representative (if applicable) and address;
5) varietal protection;
6) indication, if the variety has been genetically modified.
12.2 article. The inclusion of the varieties fruit and berry varieties of the national plant protection service included in the list of varieties of the breed in accordance with the rules on the making of lists of varieties where it is the official description of the variety established in accordance with the laws of a variety concerning the appraisal of its distinctness, uniformity and stability, or the national plant protection dienestaatzīt in the description of the variety. "
13. in article 13.1: to supplement the first part of paragraph 9 and 10 by the following: "9) in certain circumstances, breeding seeds of varieties of vegetables, if: (a)) variety is entered in the catalogue of Latvian varieties of plants or of the European Union in the common catalogue of varieties of vegetable species as breeding in certain circumstances a vegetable variety, b) seed quality meets certain conditions of vegetable breeding and seed of a variety of rules, c) seeds are handled and labelled under certain circumstances recognition of the varieties of vegetable breeding and seed supply chain requirements the quality of seed, d) supporting documents comply with the specified conditions of breeding a variety of vegetables and seeds movement provisions requirements;
10) seed mixtures for the conservation of the natural environment, if: (a)) national plant protection service is provided by permission of its extraction and trade, (b)) the seed is handled and labelled according the requirements of the rules on the marketing of seed mixtures for the conservation of the natural environment, c) complies with the provisions on the marketing of seed mixtures for the conservation of the natural environment, d) seeds are provided quantitative restrictions laid down in the legislation on the marketing of seed mixtures for the conservation of the natural environment. "
to supplement the article with the fourth paragraph as follows: "(4) the national plant protection service within three months following the day of receipt of the national plant variety Board proposal on specific variety cultivation prohibition or restriction of production, assess the damage and send the application to the European Commission for permission to take a decision to prohibit the cultivation of the variety in the territory of the country."
14. Supplement article 16, third paragraph with the sentence as follows: "the State plant protection service for permission to place on the market seed of varieties for which an application has been submitted, but not yet included in the catalogue of plant varieties in Latvia or in one of the Member States of the European Union national catalogues are issued within two months of receipt of the application."
15. off article 18, second paragraph, the word "(company)".
16. Add to article 21, paragraph 2, the words "or in the list of varieties".
17. transitional provisions be supplemented with 11, 12, 13 and 14 as follows: "Cabinet of Ministers 11 to 2010 December 31 issued this law, article 2, paragraph 1" h "referred to in the rules.

14. Amendment of article 21 of this law in paragraph 2 as regards the addition of paragraph by the word "or" in the list of varieties shall enter into force on June 1, 2011. "
18. To supplement the informative reference to directives of the European Union with 12 and 13 the following paragraph: "12) Commission 26 November 2009. directive 2009/145/EC providing for certain derogations for the vegetable wild species and varieties, which have been traditionally grown in particular localities and regions and threatened by genetic erosion and for the acceptance of varieties of vegetables, which do not have significant value for commercial crop production but developed for growing under particular conditions and this wild species and seed varieties (text with EEA relevance);
13) Commission 2010-30 august 2010/60/EU directive providing for certain derogations for the marketing of fodder plant seed mixtures, which are intended to be used in the conservation of the natural environment (text with EEA relevance) ".
The law shall enter into force on the day following its promulgation.
