Cabinet of Ministers Regulations No. 267 in Riga on May 23, 2017 (pr. No 27 14) amendments to the Cabinet of Ministers of 27 April 2010 No. 397 "in the terms of the provisions of the national civil aviation security programme" Issued in accordance with the law "on the air", the first subparagraph of article 57 do cabinet 27 April 2010 No. 397 "in the terms of the provisions of the national civil aviation security programme" (Latvian journal 2010, nr. 69.45. no 2012,;;, 173. nr. 2013) follows: 1. Replace the text of the provisions : 1.1., the words "authorised representative" (fold) with the words "official freight agent" (the fold); 1.2. the words "in accordance with the regulations for the carriage of passengers, baggage and cargo security screening of persons involved in the certification and the preparation and training of those involved in the certification of" with the words "in accordance with the regulations on the certification of personnel in the exercise of the national civil aviation security measures laid down in the programme". 2. Express 1.1 point as follows: "1.1 the national civil aviation security programme of the aviodrošīb measures in accordance with the Commission's 2015 5 November 2004 implementing Regulation (EU) No 2015/1998 laying down detailed measures for the implementation of the common basic standards on aviation security (hereinafter Regulation No 2015/1998), and the Commission of 17 October 2011 the implementing Regulation (EU) No 1035/2011 laying down common requirements for the provision of air navigation services and amending Regulation (EC) No 482/2008 and (EU) no 691/2010." 3. To supplement the provisions and paragraph 3.9.1 3.9.2 in this version: 3.9.1 "cooperation with a third national civil aviation authorities, to assess the potential security risks in the Republic of Latvia registered aircraft operator flights to third countries; 3.9.2 information about increase risks to civil aviation safety on the territory of third countries, to determine the aircraft operator to take the necessary additional measures or aviodrošīb to issue recommendations to the operator exposure time to stop flights to (or through) the specific area or take flight in a specific air route. " 4. a add to 3.10. section behind the words "aircraft operator" with the words "air navigation service providers". 5. To replace the words "in paragraph 3.11. regularly check the airport operator of aircraft" with the words "to assess regularly the airport, aircraft operators, air navigation service providers". 6. To supplement the provisions of the following paragraph 3.11.1: "3.11.1 to assess their Republic of Latvia registered aircraft operator introduced preventive measures in compliance with the aviodrošīb of the European Union and international law who performs or intends to perform a flight at airports in third countries;". 7. Add to subparagraph 3.17 behind the words "aircraft operators" with the words "air navigation service providers." 8. Supplement with 3.19. subparagraph by the following: "3.19. monitor, as airport operators, aircraft operators and air navigation service providers shall ensure civil aviation requires information and communication technology systems and data against unauthorized interference." 9. Supplement with 4.5.1 section as follows: "at the request of State border guard 4.5.1 special monitoring passengers and accompanying officials to perform safety inspection separately from that rule 4.5. checks referred to in point;". 10. Amend section 4.7. 11. Express 4.12. subparagraph by the following: "4.12. to develop and provide the appropriate security screening procedures for persons with disabilities, persons with functional limitations, persons with restricted movement and mobility, as well as the treatment of these persons and functional products, necessary for devices (such as immobilization, mobility equipment, self-contained breathing apparatus and other medical AIDS) and dogs-attendants;". 12. To supplement the provisions under section 4.12.1 as follows: "to ensure that rule 4.12 4.12.1. the security referred to in subparagraph checks in the airport involved the training of staff of the European Parliament and of the Council in 2006.  July 5 to Regulation No 1107/2006 on the rights of disabled persons and persons with reduced mobility when travelling by air, 11; ". 13. Express 4.13. subparagraph by the following: "4.13. of Regulation No. 1.3 of annexes 2015/1998 and 1.4. Sub-paragraph to ensure safety checks of persons other than passengers, and vehicle inspection before entering airport restricted access security areas, as well as a critical part of their personal and vehicle safety inspection, which penetrates the airport airside restricted area;". 14. To supplement the provisions and paragraph 4.21 4.22. the following wording: "to coordinate with national 4.21 border guards, the State revenue service and the food and veterinary service of the airport infrastructure development project in the section relating to this service functions; 4.22. implement and maintain an information and communications technology security management system according to the provisions of paragraph 18 of these requirements. " 15. To supplement the provisions of the following paragraph 5.8.1: "announce National Guard to 5.8.1 on existing specific aircraft to monitor passengers before the aircraft landing at the airport of the Republic of Latvia;". 16. To supplement the rules with 5.11 and 5.12. subparagraph by the following: ' 5.11. to ensure aviodrošīb implementation of the air operator and its subcontractors agreed the initial qualification of personnel and maintenance training in accordance with the Civil Aviation Agency approved civil aviation security training programmes; 5.12. to implement and maintain information and communication technology systems security management according to the provisions of paragraph 18 of these requirements. " 17. the introductory part of paragraph 6, replace the words "national joint stock company" Latvian "air traffic" with the words "air navigation service providers". 18. To supplement 6.5. section aviodrošīb after the words "program" with the words "to submit it to the harmonisation of Civil Aviation Agency." 19. To supplement the provisions under point 6.8 as follows: "6.8. implement and maintain an information and communication technology safety management system according to the provisions of paragraph 18 of these requirements. " 20. To supplement the provisions under paragraph 9.4 as follows: "9.4. no later than 24 hours before the scheduled flight of an aircraft to inform the operator about the particular subject passengers, by Regulation No 2015/1998 of the annex to the information specified in point 4.3.2;". 21. Supplement with 10.3. subparagraph by the following: "10.3. to inform the operator about the particular subject passengers, by Regulation No 2015/1998 4.3.2. Annex information specified in the following periods of time: 10.3.1. for foreigners, for which the Airport border crossing points in the decision to refuse entry to the Republic of Latvia, immediately after the adoption of the decision; 10.3.2. for other passengers to be monitored in particular – not later than 24 hours before the planned flight of the aircraft. " 22. Supplement with 10.4. subparagraph by the following: "10.4. assess the airport infrastructure development project compliance with border check measures." 23. To supplement the provisions under point 11.5. by the following: "11.5. assess the airport infrastructure development project suitability for effective customs control measures." 24. Replace paragraph 14.1., the words "to be consumed during the flight inventory, stocks, airport cleaning supplies and goods intended for trade" with the words "their premises". 25. To supplement the provisions and paragraph 14.2 14.1 the following wording: "14.1 entities approved for consumable items during a flight to an authorised supplier of consumable items during a flight to some suppliers and known suppliers of airport stock, in addition to this provision the obligation referred to in paragraph 14 of the following responsibilities: 14.1 1. comply with safety requirements for consumable items during a flight to an authorised supplier of consumable items during a flight to some items of the supplier and the supplier of the airport security programme known; 14.1 2. prevent unauthorised access in-flight and airport supplies consumable items; 14.1 3. appoint the person responsible for safety, certificated in accordance with the regulations on the certification of personnel in the exercise of the national civil aviation security measures laid down in the programme. 14.2 legal entity conducting commercial activities in the territory of the airport open fulfil on their eligible airport security program requirements.
