No 22 27) at national and European Union aid modalities for local action groups for inter-territorial and transnational cooperation Issued under the agricultural development Act unlauk article 5, fourth paragraph (I). General questions 1. determines the order in which the State and the European Union support for the implementation of: 1.1. the rural development programme 2014-2020 Sub-measure interterritorial and transnational cooperation "(hereinafter rural development programme); 1.2. the action programme for the development of fisheries, 2014 – 2020 ' cooperation measures ' (hereinafter referred to as the programme of action). 2. measures aimed at supporting cooperation at national and international level, to facilitate the exchange of experience, the quality of new and innovative ideas for cooperation, as well as encourage business development and employment. 3. the measures implemented in accordance with the laws of the State of the Union aid society-driven local development strategy preparation and implementation: 3.1. rural development measures – measures in the programme "support to the LEADER local development (community-driven local development)" community driven local development strategy (hereinafter referred to as the local development strategy) implementation in a specific territory; 3.2. the action programme-action programme for the development of fisheries, 2014 – 2020 event Company-driven local development strategy implementation "company-driven local development strategies in a specific territory. 4. supports the applicant's application and the conditions for receiving the aid, project submission, evaluation and selection procedures, decision making and project implementation conditions, report, evaluation and decision-making procedures, requiring public financing and payment arrangements, project monitoring and sanctions shall also determine the laws on the national and European Union aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period insofar as these provisions do not stipulate otherwise. II. conditions for the receipt of Support transnational cooperation 5. Support for transnational cooperation shall be entitled to the society or establishment assigned to support local development strategy consistent with the laws of the State of the Union aid society-driven local development strategy preparation and implementation (hereinafter local action group). 6. the transnational cooperation project involves public and private partners Group (hereinafter referred to as cooperation partner) that works and implementing a local development strategy: 6.1 rural development programme: 6.1.1. in another Member State of the European Union, if partner meets the European Parliament and of the Council (EU) 17 December 2013 Regulation No 1303/2013 laying down common provisions on the European regional development fund, the European Social Fund , The Cohesion Fund, the European agricultural fund for rural development and the European Fund for Maritime Affairs and fisheries and general provisions on the European regional development fund, the European Social Fund, the Cohesion Fund and the European Fund for Maritime Affairs and fisheries, and repealing Council Regulation (EC) No 1083/2006 (hereinafter Regulation No 1303/2013), article 32 (2) and (5) the requirements referred to in; 6.1.2. in another country, if partner meets the European Parliament and of the Council (EU) 17 December 2013 Regulation No 1305/2013 on support for rural development by the European agricultural fund for rural development (EAFRD) and repealing Council Regulation (EC) No 1698/2005 (hereinafter Regulation No 1305/2013), article 44, paragraph 2 of the said requirements; 6.2. the activities of the programme of action, to the other Member State of the European Union, if the partner complies with Regulation No 1303/2013 32 and article 5 the requirements referred to in point and receives a European Fund for Maritime Affairs and fisheries support local development strategy. 7. the cooperation partner that operates outside the European Union, the participation costs of transnational cooperation project covers from the same resources. 8. The local action groups with the partners conclude cooperation agreements. The contract shall contain at least the following information: 8.1 a transnational cooperation project name; 8.2. all transnational cooperation project partner contact information and indicate which partner is the project coordinator and responsible for the implementation of the cooperation; 8.3. a transnational cooperation project description: 8.3.1. the objectives of cooperation; 8.3.2. joint action (planned measures), as well as indicate the time and place; 8.3.3. the direct beneficiaries; 8.3.4. the results achieved and the benefits of the direct beneficiaries after the transnational cooperation project; 8.3.5. each partner's duties and responsibilities; 8.4. the projected total project funding for transnational cooperation, each partner of the planned financial contribution and settlement arrangements; 8.5. a transnational cooperation project implementation timetable; 8.6. dispute resolution procedure. 9. the conditions for receiving the aid of transnational cooperation for the implementation of the project: 9.1. partners have concluded that rule 8, paragraph cooperation agreement; 9.2. the transnational cooperation project is implemented according to local action groups prepared and public driven local development strategy approved by the selection Committee of the local development strategy the provision referred to in paragraph 3 in the territory and the activities of partners in territory, creating the benefit in cooperating local action groups and partners activity to the people of the territory. Rural development measures in the programme for transnational cooperation projects can be implemented in the city, which has more than 15 000 inhabitants, with the exception of Riga, where the city has been identified as a local development strategy and direct beneficiaries are agricultural producers, processors of agricultural products or agricultural service cooperative society, which works in one of the cooperating local action group in the area. Transnational cooperation projects not implemented one of the merchant's interest; 9.3. transnational cooperation projects, this provision is referred to in paragraph 2, the objective, and this contributes to: 9.3.1. rural development measures in the programme – in at least one article of Regulation No 1305/2013 5 rural development in priority one goal; 9.3.2. the activities of the programme of action, at least one of the European Parliament and of the Council of 15 may 2014, the Regulation (EU) no 508/2014 of the European maritime and Fisheries Fund and repealing Council Regulation (EC) No 2328/2003, (EC) no 861/2006, (EC) no 1198/2006 and (EC) no 791/2007 of the European Parliament and of the Council Regulation (EU) No 1255/2011 (hereinafter Regulation No 508/2014) Article 63, paragraph 1 goal; 9.4. a transnational cooperation project contributes to at least one local development strategy in the achievement of the objective set out in; 9.5. a transnational cooperation project is for the implementation of joint operations in accordance with the rules referred to in point 8 of the cooperation agreement. 10. Transnational cooperation project, which is involved in a number of local action groups (hereinafter referred to as joint ventures), on the basis of contracts concluded between the participants in the joint venture, Field support services, submit and support received one local action group responsible for coordination of the joint venture, in accordance with the provisions referred to in point 8 of the cooperation agreement. 11. Support for inter-territorial cooperation is entitled to receive a local action group for the implementation of joint activities with other local action groups. The contract shall contain at least the following information: inter-territorial cooperation 13.1. project name; 13.2. the Inter-territorial cooperation project involving local action group contact information and specify which local action group is the project coordinator and responsible for the implementation of the cooperation; 13.3. the Inter-territorial cooperation project schedule: 13.3.1. the objectives of cooperation; 13.3.2. joint action (planned measures), as well as indicate the time and place; 13.3.3. the direct beneficiaries; 13.3.4. objectives and benefits of direct beneficiaries after the Inter-territorial cooperation project; 13.3.5. each local action groups, including the duties and responsibilities of the project's compliance with the conditions of supervision for a period of five years following the last payment of aid under the legislation on the national and European aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period; 13.4. the planned total of inter-territorial cooperation project funding, each local action group of the planned financial contribution and settlement arrangements; 13.5. the Inter-territorial cooperation project implementation timetable; 13.6 dispute resolution. 14. the conditions for receiving the aid of the Inter-territorial cooperation project: 14.1 between local action groups have concluded that the provisions referred to in paragraph 13 of the cooperation agreement; 14.2. the Inter-territorial cooperation project is implemented this provision in paragraph 3 that territory under the cooperation involved in local action groups and the company's push to prepare local development strategy approved by the selection Committee of the local development strategy, creating the benefit in cooperating local action group in the area of population. Local action group may receive support for inter-territorial cooperation project for technical preparation, if its rural development programme in the implementation of measures of Regulation No 1305/2013 44. Article 1 of the "b" claim, and referred to the activities of the programme of action, the Regulation No 508/2014 64. paragraph 1 of article "b" referred to in the claim. Support for inter-territorial cooperation project for technical preparation is available to these regulations, paragraph 13, of the conclusion of a cooperation agreement. IV. the amount and intensity of aid, eligible and non-eligible costs 16. the maximum amount of aid or the Inter-territorial cooperation projects of transnational cooperation projects, including joint ventures, including support for the implementation of transnational or inter-territorial cooperation project for technical preparation, the rural development programme activities does not exceed 100 000 euro and the activities of the programme of action, the 50 000 euro. Support for transnational cooperation projects for technical preparation does not exceed 4000 euro and inter-territorial cooperation project for the preparation of the technical-500 euro. 17. Aid intensity of transnational cooperation project and the starpter in the toriāl project of cooperation is 100 percent of the total amount of the eligible cost. 18. measures for the rural development programme and in the activities of the programme of action are attributable to such transnational or inter-territorial cooperation project technical preparation costs: 18.1. remuneration of the supervisor, including taxes and fees; 18.2. the expenditure related to the appointment with a transnational cooperation project to potential partners or inter-territorial cooperation project involving local action groups, including travel costs, travel expenses, daily allowance and hotel costs-according to laws and regulations about the order in which the recoverable costs associated with business travel, if the appointment occurs at the partners; 18.3. translation costs, if there is cross-border cooperation; 18.4. accounting costs; 18.5. the cost of legal services for the preparation of a cooperation agreement. 19. measures for the rural development programme and in the activities of the programme of action are attributable to such transnational or inter-territorial cooperation project implementation costs: 19.1. costs associated with the implementation of joint operations in accordance with the provisions of paragraph 8 or 13 cooperation referred to in the contract; 19.2. the project administrative costs that are directly associated with transnational or inter-territorial cooperation, coordination and monitoring of the project and shall not exceed eight percent of these provisions 19.1. the costs referred to in point: 19.2.1. reimbursement supervisor, including taxes and fees; 19.2.2. accounting costs; 19.2.3. legal expenses; 19.2.4. translation costs, if implemented in a transnational cooperation project. 20. A transnational cooperation project and inter-territorial cooperation project subject is the acquisition cost of fixed assets, which are directly linked to the achievement of the project objectives and the implementation of activities and ensure the sustainability of its monitoring of the project. 21. Local action group is entitled to enter into a contract with the cooperation project members about this rule referred to in paragraph 20 of the asset maintenance of transnational cooperation project and inter-territorial cooperation project implementation and monitoring period, but they are not used in commercial activities. They ensure clear separation of costs and activities. 23. Value added tax included in the local action group attributable costs, if it is not legal to deduct from taxes payable to the State budget amounts as input to the laws on value added tax. 24. the rural development programme and in the action programme the following are not eligible: 24.1. interest payments, money transfers, Currency Exchange Commission payments and exchange rate fluctuations suffered damage; 24.2. fines, penalties and costs of legal proceedings; 24.3. the subcontracting, which artificially and unduly increase the cost of the project and the fee is fixed as a percentage of the total cost of the project; 24.4. the costs associated with the supply of any services or work for which there is no organized according to the procurement procedure in accordance with the laws and regulations on the application of the procurement procedure; 24.5. the construction costs that are attributable to individual facilities, stationary advertising or billboard installation costs; 24.6. the existing structure, assets and purchased software maintenance costs; 24.7. these provisions 19.2. in the case referred to in subparagraph space rental and management expenses; 24.8. this rule 19.2. in the case referred to in subparagraph office machinery and equipment acquisition expenses; 24.9. expenditure on the acquisition of property or shares; 24.10. expenditure on maintenance, spare parts and maintenance of aircraft; 24.11. reward staff, except that rule 18.1 and 19.2.1. the costs referred to in; 24.12. any bonus for the extra work, overtime work or work on public holidays, bonuses, incentives and prize money; 24.13. taxes and fees, with the exception of this rule and in 19.2.1 18.1 and paragraph 23; 24.14. expenditure on the purchase of the vehicle; 24.15. fee for the training, which is part of general secondary education or higher education programmes or linked to the European Union, or other financial instruments support and preparation of project submissions; 24.16. expenditure incurred before the rural support service of the decision on the granting of aid for the preparation of a technical cooperation project and prior to the application of the Field support service; 24.17. expenses that are not related to the cooperation activities provided for in the project implementation; 24.18. local action group of events organised by the costs associated with the implementation of the project in the event of failure to comply with this provision, the condition referred to in paragraph 37; 24.19. legal expenses if the local action group received remuneration of the lawyer to support rural development programme for Latvia in 2014 – 2020 Sub-measure "local action group activity, activation of the territory"; 24.20. representation expenses required for transnational or inter-territorial cooperation project for technical preparation; 24.21. cooperation in local action groups and the traditional annual sports and cultural events, the cost of a local development strategy; 24.22. other costs that are not eligible under Regulation (EC) no 1305/2013 and no 508/2014. V. 25. Application procedures To support transnational or inter-territorial cooperation project for technical preparation, the local action group field support service electronic login system submitted the application for the rural development programme and action programmes (annex 1). Agreement with the owner of immovable property concluded for a period of at least seven years from the application of the cooperation projects; 27.4. procurement procedures supporting documents in accordance with the laws of the State of the European Union and the granting of aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period for deliveries and services this rule 41.1. pre-financing referred to; 27.5. reconciliation of būvvald, if the cooperation provided for in this provision of the draft 24.5. the actions referred to in subparagraph; 27.6. the transnational cooperation projects – these rules referred to in point 8 of the cooperation agreement and a copy of the local action groups demonstrate Latvian language translations of the Treaty; 27.7. the Inter-territorial cooperation project – this provision referred to in paragraph 13 of the cooperation agreement. 28. Local action group 27.5. these provisions referred to field support service shall be submitted together with the application or a cooperation project with the first request for payment. 29. If the cooperation partner in running the country, which is not a Member State of the European Union, the local action group in addition to the provisions referred to in paragraph 25 of the document, as applicable, or 27 of these rules by the documents mentioned in paragraph Field support services, submit proof of partners on its conformity with the provisions referred to in subparagraph 6.1.2. requirements and funding availability for participation in a transnational cooperation project and local action groups demonstrate Latvian language translations of this document. 30. If the implementation of joint projects, the local action group in addition to the provisions referred to in paragraph 25 of the document, as applicable, or 27 of these rules by the documents mentioned in paragraph Field support services shall provide the members of the joint venture agreement. Vi. cooperation of transnational or inter-territorial project implementation conditions and support the request and payment procedure 34. Local action group the first payment request for transnational or inter-territorial cooperation project is part of the Field support service shall be submitted in the first year of implementation of the project by the rural support service of the decision on the application for approval of cooperation projects. 37. If local action group in Latvia organises events related to any of these provisions 19.1. the costs referred to in point it five working days before the event to inform the field support service on the event venue and time. 38. The aid shall be granted for those eligible costs that are included in the rural support service in the submitted cooperation project in the application. If the eligible costs constitute only part of the local action groups transnational or inter-territorial cooperation project costs, the local action group supports transnational or inter-territorial cooperation project on its own resources under the cooperation project in the application actions and objectives. 39. Pre-financing and all with the support of transnational or inter-territorial cooperation project for technical preparation and inter-territorial cooperation of transnational or project-related funds and the financing of expenditure in the local action group, which is a joint venture of the Inter-territorial cooperation project or coordination, open accounts in the Treasury. Support for transnational or inter-territorial cooperation project for technical preparation of the grant in the following order: 40.1. the rural support service within one month of the adoption of the decision on the granting of aid for the transnational cooperation project inter-territorial or technical preparation for transfer to the local action group of pre-financing in not more than 50 percent of the applications approved in the eligible costs; 40.2. the local action group after the conclusion of the cooperation agreement shall prepare the payment request and submit it to the rural support service; 40.3. the rural support service to examine the payment claim to the laws on the national and European aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period. If the request for payment of the expenditure conforms to the provisions referred to in paragraph 18 of the eligible costs, the rural support service approved expenditure and transferred to local action groups in the specified account, minus the pre-financing received in advance. 41. Support for transnational or inter-territorial cooperation project grant in the following order: 41.1. the rural support service within one month of the adoption of the decision on the granting of aid for the implementation of cooperation projects transferred to the local action group cooperation project pre-financing within the application, but not more than 50 percent of the eligible cooperation projects; 41.2. the local action group after the implementation of the cooperation projects part prepare the payment request and submit it to the rural support service, but no more than three times the cooperation during project implementation; 41.3. the rural support service to examine the payment claim to the laws on the national and European aid, administration and monitoring of the development of the rural and fisheries-2014 – 2020 programming period. If local action groups total cooperation project expenditure is less than the projected total cost of the project and cooperation there is a European Union funding and the State budget funding overpayment, a local action group not applicable expenses reimbursed in accordance with the regulations on the European agricultural guarantee fund, the European agricultural fund for rural development, European Fund for Maritime Affairs and fisheries, as well as on the national and European aid for agriculture and rural development and fisheries Financing Administration 2014 – 2020 programming period. 43.
