The MINISTER of ECONOMIC DEVELOPMENT having regard to the Decree of the Minister of economic development July 23, 2009, published in the Gazzetta Ufficiale della Repubblica italiana of November 28, 2009, # 278 on the creation of an aid scheme in favour of productive investment in accordance with art. 1, paragraph 845 of the Act December 27, 2006, # 296, regarding technology areas identified in paragraph 842 the same article and related interventions and connected; Having regard to the Decree of the Minister of economic development April 28, 2010, published in the Gazzetta Ufficiale della Repubblica italiana of July 8, 2010, n. 157, embodying amendments and additions to the Decree of the Minister of economic development July 23, 2009; Having regard to Council Regulation (EC) no 800/2008 of August 6, 2008, published in the official journal of the European Union L 214 of August 9, 2008 declaring certain categories of aid compatible with the common market in application of articles 87 and 88 of the Treaty (General block exemption regulation) and subsequent amendments and additions; Having regard to Council Regulation (EU) no 1224/2013 of November 29, 2013, published in the official journal of the European Union L 320 of November 30, 2013, which has extended until June 30, 2014 the duration of the period of application of Regulation (EC) No 800/2008; Having regard to the Legislative Decree March 31, 1998, n. 123, laying down rules for the rationalization of public support to enterprises; Visto l'art. 1, commi 462 and 463) (a) of law no 296 December 27, 2006 and subsequent modifications and additions, which defines the National Agency for the attraction of investments and the development of enterprise S.p.a. -Central Government which instrumental Invitalia; Having regard to the aims of regional State aid map 2007-2013 approved by the European Commission on July 6, 2010 (No 117/2010), published in the official journal of the European Union C 215 of August 18, 2010; Having regard to Commission decision C (2013) 7178 of October 25, 2013 that extends the length of the period of application of the abovementioned purposes regional State aid map 2007-2013 until June 30, 2014; Having regard to the Third Cohesion Action Plan (Cap) reprogramming of December 11, 2012, whereby the Minister for territorial cohesion, with the objective of financing ' countercyclical measures» in order to mitigate the effects of the prolonged crisis at work, on business and on people, he meant, among other things, 150 million to boost the areas affected by industrial crisis of Airola , Acerra, Avellino, Caserta and Castellamare; View the delibera di Giunta n. 756 of December 21, 2012, with which the Campania region has approved the contents of the third switch of the predicted PAC; View the delibera di Giunta n. 30 of January 29, 2013, by which the Campania region showed the following breakdown of the resources allocated, with the possibility of subsequent rescheduling: = === === === === === === === === === === === === === === === === |   | million |

+------------------------------+------------------+ having regard to the ' Memorandum of understanding for the revitalization of areas affected by industrial crisis in Campania», signed by the Ministry of economic development and the Regione Campania on July 17, 2013 and recorded at the Court of Auditors on December 30, 2013, aimed at the enhancement of entrepreneurial vitality and potentials of individual Territories, so as to ensure a stable and lasting employment through the implementation, with the support of the National Agency for the attraction of investments and the development of enterprise S.p.a.-Invitalia, the ' programme for revitalising the areas affected by industrial crisis in Campania», attached to the same memorandum of understanding; Considered that the aid scheme established by Decree of the Minister of economic development July 23, 2009 is exempted under Regulation (EC) no 800/2008, whose application has been postponed to June 30, 2014; Considering that the said agreement establishes, among other things: to decline the interventions under the programme annexed to the Protocol in reference to the "crisis area" Macro, the set of individual crisis areas;
to support productive investments in areas of crisis by recourse to: aid scheme of development contracts established by interministerial decree September 24, 2010, promoting strategic projects;
aid scheme in favour of productive investment, established by Ministerial Decree July 23, 2009, for the promotion of projects aimed at achieving specific goals of innovation, competitive improvement and environmental protection;
leave the governance of the measures indicated in the programme to an Executive Committee set up by subsequent Decree of the Minister of economic development October 22, 2013; Given that the aforementioned memorandum of understanding has so bordered individual areas of crisis, which together constitute the Macro crisis area: «crisis Area of Airola» the municipalities of Airola, Arpaia, Bonea, Bucciano, Forchia, Moiano, Montesarchio, Paolisi (all in the province of Benevento);
«Crisis Area of Acerra» the municipalities of Acerra, Brusciano, Caivano, Afragola, Casalnuovo di Napoli, Castello di Cisterna, Marigliano, Nola, Pomigliano d'Arco (all in Italy);
«Crisis Area of Avellino» all municipalities in the province of Avellino;
«Crisis Area of Caserta» all municipalities in the province of Caserta;

«Crisis Area of Castellammare di Stabia» the municipalities of Boscoreale, Boscotrecase, Cercola, Ercolano, Castellammare di Stabia, Gragnano, Ottaviano, Palma Campania, Poggiomarino, Pollena Trocchia, Pompeii, Portici, San Gennaro Vesuviano, San Giuseppe Vesuviano, San Giorgio a Cremano, San Sebastiano al Vesuvio, Santa Maria la Carita ', Sant'Anastasia, Sant'Antonio Abate, Saviano, Somma Vesuviana, Striano, Terzigno, Torre Annunziata, Torre del Greco, Trecase (Italy)-Angri Castel San Giorgio, Cava dei Tirreni, Corbara, Mercato San Severino, Nocera Inferiore, Nocera Superiore, Pagani, Roccapiemonte, San Marzano sul Sarno, Sant'Egidio del Monte Albino, San Valentino Torio, Sarno, Scafati, Siano (province of Salerno); Considered that the Executive Committee, at its meeting of January 29, 2014, identified the staff to reoccupy crisis area residents in workers who are recipients of the IGC or are enrolled in the lists of mobility, when new hire; Considered that the Executive Committee has provided, in the same meeting of January 29, 2014, to allocate resources amounting to euro 53,400,000.00 in the financing of intervention aimed at promoting productive investment according to the scheme established by the Ministerial Decree July 23, 2009; Considered, therefore, must define, pursuant to Ministerial Decree several times July 23, 2009 and subsequent amendments and additions, the conditions and modalities for activation of measures for strengthening the competitiveness of enterprises, through the creation of new innovative investments aimed at consolidating, retrain, diversifying enterprises of areas affected by industrial crisis in Campania, encouraging their integration capacity;
Decrees: Art. 1 Definitions 1. For the purposes of this Decree, the following definitions are adopted: a) "Ministry" means the Ministry of economic development;
b) ' managing subject»: the National Agency for the attraction of investments and the development of enterprise S.p.a.-Invitalia;
c) ' agreement ' means the Protocol signed on July 17, 2013 between the Ministry of economic development, the region of Campania and the National Agency for the attraction of investments and the development of enterprise S.p.a.-and for the reindustrialization Invitalia economic and production of areas affected by industrial crisis in Campania;
d) «Executive Committee» the Committee established by Decree of the Minister of economic development October 22, 2013;
e) «crisis Area of Airola» the municipalities of Airola, Arpaia, Bonea, Bucciano, Forchia, Moiano, Montesarchio, Paolisi (all in the province of Benevento);
«Crisis Area of Acerra» the municipalities of Acerra, Brusciano, Caivano, Afragola, Casalnuovo di Napoli, Castello di Cisterna, Marigliano, Nola, Pomigliano d'Arco (all in Italy);
«Crisis Area of Avellino» all municipalities in the province of Avellino;
«Crisis Area of Caserta» all municipalities in the province of Caserta;
«Crisis Area of Castellammare di Stabia» the municipalities of Boscoreale, Boscotrecase, Cercola, Ercolano, Castellammare di Stabia, Gragnano, Ottaviano, Palma Campania, Poggiomarino, Pollena Trocchia, Pompeii, Portici, San Gennaro Vesuviano, San Giuseppe Vesuviano, San Giorgio a Cremano, San Sebastiano al Vesuvio, Santa Maria la Carita ', Sant'Anastasia, Sant'Antonio Abate, Saviano, Somma Vesuviana, Striano, Terzigno, Torre Annunziata, Torre del Greco, Trecase (Italy)-Angri Castel San Giorgio, Cava dei Tirreni, Corbara, Mercato San Severino, Nocera Inferiore, Nocera Superiore, Pagani, Roccapiemonte, San Marzano sul Sarno, Sant'Egidio del Monte Albino, San Valentino Torio, Sarno, Scafati, Siano (province of Salerno);
f) «Macro crisis area» means all the crisis areas identified at point e);
g) ' production unit ' means a production facility, equipped with technical autonomy, organizational, managerial and functional, possibly on more property and/or plants, even physically separate but connected functionally;
h) ' GBER ' means the Regulation (EC) no 800/2008 of August 6, 2008, published in the official journal of the European Union L 214 of August 9, 2008 declaring certain categories of aid compatible with the common market in application of articles 87 and 88 of the Treaty (General block exemption regulation) and subsequent amendments and additions.
