The GENERAL MANAGER for the accreditation of testing and certification and consumer protection having regard to Council Regulation EC No 882/2004 of the European Parliament and of the Council of April 29, 2004, on official controls performed to ensure the compliance with feed and food law and animal health and animal welfare rules; Having regard to Council Regulation (EC) No 834/2007 of the Council of June 28, 2007 on organic production and labelling of organic products and repealing Regulation (EEC) No 2092/91; Having regard to Council Regulation (EC) no 889/2008 of September 5, 2008 amending for the application of Regulation (EC) No 834/2007 on organic production and labelling of organic products with regard to organic production, labelling and controls and subsequent amendments and additions; Having regard to Council Regulation (EC) no 1235/2008 of December 8, 2008 amending for the application of Regulation (EC) no 834/2007 as regards the arrangements for imports of organic products from third countries, as amended and supplemented; Having regard to Council Regulation (EU) No. 392/2013 of April 29, 2013 amending Regulation (EC) No 889/2008 as regards the control system for organic production; Having regard to the Legislative Decree of March 17, 1995, n. 220 regarding the implementation of articles 8 and 9 of Regulation (EEC) no 2092/91 concerning organic farming and food; Having regard to the Ministerial Decree of December 5, 2006, its control bodies, authorised pursuant to Legislative Decree n. 220/95, which is obliged to inform the Ministry changes in its structure and system documentation; Having regard to the Ministerial Decree of February 26, 2007 amending Decree December 5, 2006; Having regard to the ministerial order of November 27, 2009, n. 18354 May 28, 2010, as amended by Ministerial Decree laying down rules for the implementation of regulations (EC) no 834/2007, no. 889/2008 and n. 1235/2008 and subsequent modifications regarding organic production and labelling of organic products; Seen the Decree April 15, 2013 concerning the procedure for granting an authorization of the inspection bodies for certification and inspection activities and in particular annex 2 laying down specific requirements for the evaluation of the documentation to be attached to the authorization; Having regard to Council Regulation (EC) no 765/2008 of the European Parliament and of the Council of July 9, 2008 that sets out the requirements for accreditation; Having regard to the Ministerial Decree December 22, 2009, «Italian national body of Accredia Designation as the only authorised to carry out activities for accreditation and market surveillance in accordance with Regulation (EC) no 765/2008, pursuant to art. 4, paragraph 4, of Act July 22, 2009, # 99», giving the single national Body "ACCREDIA" empowered to perform the accreditation of private control bodies; Having regard to the Decree of the President of the Council of Ministers in February 27, 2013, n. 105 regulation on organisation of the Ministry of agricultural food and forestry policies, in accordance with art. 2, paragraph 10-ter of Decree-Law No July 6, 2012. 95, converted, with amendments, by law, August 7, 2012 # 135; Given the constant evolution of Community legislation and national control bodies that required a continuous updating of the system documentation and subsequent examination of the documentation by the Directorate General for the accreditation of testing and certification and consumer protection; Whereas on March 15, 2013 intervened an agreement between the Directorate-General and ACCREDIA in order to streamline the licensing procedures and, at the same time, the burden on inspection bodies; Considering that from October 2013 has been developed and set up a new procedure for computerized management system documentation that the inspection bodies are obliged to report to the Executive Board for the accreditation of testing and certification and consumer protection office VICO I-and ACCREDIA by loading the said documentation on a specific area of the site of ACCREDIA;
Decrees: Art. 1 the inspection bodies authorised to carry out monitoring activities on operators that produces, prepares, stores or imports from a third country products as specified in art. 1, comma 2 of Reg. (EC) 834/2007, through loading in the breakfast area of the ACCREDIA site, are obliged to report to the Executive Board for the accreditation of testing and certification and consumer protection office VICO I-of this Ministry the documentation about the changes to their structure and/or system documentation listed in annex 1 of the Decree April 15, 2013 within 15 days after the formal approval of those changes.
