The Minister of agricultural food and forestry policies Saw the Legislative Decree March 30, 2001, # 165 on "general rules on labour employed by Government order" and in particular article 4, concerning the division between political and administrative address and function management function and concrete performance of administrative activities; Having regard to the Decree of the President of the Council of Ministers in February 27, 2013, # 105, establishing the Ministry of agricultural food and forestry policies, in accordance with article 2, paragraph 10 (b) of Decree-Law No 95 July 6, 2012, convertito con modificazioni dalla legge August 7, 2012, # 135; Having regard to Council Regulation (EU) no 1308 of the European Parliament and of the Council of December 17, 2013 establishing a common organisation of agricultural markets and repealing Regulations (EEC) no 922/72, (EEC) No 234/79, (EC) no 1037/01 and (EC) no 1234/07 and in particular articles 61 to 72; Having regard to Council Regulation (EC) No 555 of June 27, 2008, and subsequent amendments on the common organisation of the market in wine as regards support programmes, trade with third countries, production potential and to controls in the wine sector which shall apply until the adoption of any delegated by the Commission to be paid within the December 20, 2020; Having regard to paragraph 1 of article 68 of Regulation (EU) no 1308, of December 17, 2013, which lays down the possibility for that Member State, to extend to December 31, 2020 deadline for submitting an application for conversion of rights clearances; Paragraph 2 of article 68 of the Regulation (EU) 1308, of December 17, 2013, stipulating that the permissions granted after conversion of rights have the same validity of planting rights from which they originate; Having regard to the Ministerial Decree of July 27, 2000, published in the Official Gazette No. 184 of August 8, 2000, as amended by Ministerial Decree of July 29, 2005, related to implementing rules of Regulation (EC) No 1493/1999 and Regulation (EC) no 1227/2000, relating to the common organisation of the market in wine; Considered it appropriate to make use of the extension referred to in paragraph 1, the second paragraph of article 68 of Regulation (EU) no 1308/2013; Considered appropriate to align, as established by Regulation (EC) no 1308/2013, the national rules regarding the validity of replanting rights so as not to create disparity between the holders thereof; Considered a prerequisite, for the transition to the new authorization system for new wine-growing areas, facilitate the exchange of replanting rights between holders to favour primarily use; Given the lack of understanding expressed by the Standing Conference for the relations between the State, the regions and the autonomous provinces of Trento and Bolzano at the sitting of October 30, 2014; Considered it necessary to adopt the Decree enabling the procedure laid down in article 3, paragraph 3, of legislative decree August 28, 1997, # 281, which includes the involvement of the Council of Ministers, who can intervene with reasoned deliberation, after unnecessarily thirty days after failure to agree State-regions Conference; Having regard to the Council of Ministers shall act motivated by which, in accordance with article 3, paragraph 3, of legislative decree August 28, 1997, # 281, at its meeting of February 10, 2015 was approved the draft decree examined by the Standing Conference for the relations between the State, the regions and the autonomous provinces of Trento and Bolzano authorizing the Ministry of agricultural food and forestry policies to adopt Decrees :
Art. 1 1. Pursuant to article 68, paragraph 1 of the Regulation (EU) no 1308/2013, the deadline for submitting a request for conversion under permission of planting rights granted to producers before December 31, 2015, it's set at December 31, 2020.
