The Minister of agricultural food and forestry policies having regard to Regulation (EC) No 2003/2003 of the European Parliament and of the Council of October 13, 2003, relating to fertilisers; Having regard to law no December 24, 2012. 234 on the "general rules on Italy's participation in the formation and implementation of legislation and policies of the European Union"; Having regard to Legislative Decree no April 29, 2010. 75 "reorganization and review of the guidelines in the field of fertilizers in accordance with art. 13 of Act July 7, 2009, # 88 "; Having regard to Council Regulation (EC) no 764/2008 of the European Parliament and of the Council of July 9, 2008 laying down procedures relating to the application of certain national technical rules to products lawfully marketed in another Member State and repealing Decision No 3052/95/EC; Having regard to the instances of inclusion of new products in annexes 2, 6 and 7 of June 15, 2009,. # 13970, August 13, 2009, n. 19334, March 3, 2010, # 4557, July 13, 2010, # 15688, received this Ministry; Acquired the positive opinion of the Technical-Consultative Commission for fertilizers, under art. 9 of the d.lgs. 75/2010, expressed in meetings of May 25, 2010, March 22, 2012 and July 12, 2012; Acquired the opinion of Central Inspectorate Department of protecting quality and fraud repression of agri-food products, General Directorate of prevention and fight against fraud agri-food, made with notes of June 13, 2013, # 11148, December 11, 2013, # 24678 and December 11, 2013, # 24679; Given that the procedure for the provision of information in the field of technical standards and regulations laid down in Directive 98/34/EC of the European Parliament and of the Council of June 22, 1998, ended without comments on the inclusion of new products in annexes 2, 6 and 7, as disclosed in note of September 23, 2014, n. 18989, transmitted by the central unit by notification of the Ministry of economic development; Deemed it necessary to proceed to the adoption of these changes in annexes 2, 6 and 7 of the Legislative Decree of April 29, 2010, # 75; Considering that, in accordance with articles 9 and 10 of legislative decree April 29, 2010, # 75, the amendments to the annexes are set up by Decree of the Minister of agricultural food and forestry policies;
Decrees: Art. 1 1. 2, 6 and 7 Annexes, of Legislative Decree no April 29, 2010. 75 "reorganization and review of the guidelines in the field of fertilizers in accordance with art. 13 of Act July 7, 2009, # 88 ", shall be amended and supplemented by the annex to this Decree. 2. From the date of entry into force of this Decree is granted a period of twelve months for the disposal of the national fertilizers whose production was in compliance with the regulations in force before that date. 3. this Decree does not entail restricting the marketing of fertilizers lawfully manufactured and marketed, or lawfully marketed in one Member State of the European Union or in Turkey, or lawfully manufactured in one of the signatory States of the European Free Trade Association (EFTA), a Contracting Party to the agreement on the European economic area (EEA), as long as the same guarantee, reliability and information security levels equivalent to those prescribed in this Decree. 4. In accordance with Regulation (EC) no 764/2008 of the European Parliament and of the Council of July 9, 2008 laying down procedures relating to the application of certain national technical rules to products lawfully marketed in another Member State and repealing Decision No 3052/95/EC, the competent authority for the purpose of applying, where necessary, of the conformity assessment procedures provided for in the Ministry of agricultural food and forestry policies. This Decree will be sent to the monitoring body to register and shall enter into force on the day following its publication in the Official Gazette of the Italian Republic.
