The Minister of environment, land and sea protection having regard to law no 979 December 31, 1982 laying down rules for the defense of the sea; Having regard to act July 8, 1986, n. 349, establishing the Ministry of the environment; Having regard to the framework law on protected areas December 6, 1991, n. 394, and subsequent amendments; View the agreement enshrined in the Joint Conference on July 14, 2005 between the Government, the regions, the autonomous provinces of Trento and Bolzano and the local autonomies in accordance with art. 8, paragraph 6, of the law June 5, 2003, # 131, on concessions of assets of the maritime domain and sea areas within marine protected areas, published in the Official Journal No. 174 of July 28, 2005; Having regard to the Legislative Decree July 18, 2005, n. 171 on the new code of Yachting; Visto l'art. 3, paragraph 339, December 21, 2007, law n. 244, which changed the composition of the Board of reserve under art. 28 December 31, 1982, law n. 979 and art. 2, paragraph 16, of law December 9, 1998, # 426; Having regard to the Decree of the President of the President of the Council of Ministers July 10, 2014, n. 142 laying down the organisational regulations of the Ministry of environment and protection of land and sea, of the independent performance assessment and direct collaboration offices and, in particular, article. 6, paragraph 1, letter a) conferring on the Directorate-General for the protection of nature and the sea the functions relating to land, mountain and marine protected areas; Having regard to the order of the Minister of the environment and protection of land and sea marine protected area October 21, 2009 establishment of «Costa degli Infreschi and Masseta» contextual and entrustment of management to the National Park of Cilento Vallo di Diano and Sapwood; Having regard to the order of the Minister of the environment and protection of land and sea n. 219 of July 28, 2009, laying down the rules of activities permitted in the protected marine area "Costa degli Infreschi and Masseta»; Having regard to the proposal for an implementing regulation and organization of the marine protected area "Costa degli Infreschi and Masseta», adopted on June 18, 2010 with resolution No. 22 by the Board of Directors of the National Park of Cilento and Vallo di Diano Alburni, subsequently modified by the integrated management body on the basis of the results of the investigation carried out by the responsible technical technical secretariat for the protection of the sea and the sustainable navigation, definitively adopted by resolution of the Board of Directors n. 15 of June 15, 2011 and forwarded to the Ministry of environment and territory with note prot. 9393 of June 16, 2011; Having regard to Decree-Law of July 6, 2012, n. 95, converted with amendments by law no August 7, 2012. 135, with which the technical secretariat for the protection of the sea and the sustainable navigation was abolished and its functions were transferred to the General Directorate for the protection of nature and the sea; Having regard to the decrees of the Minister for the environment and protection of land and sea. # 68 of March 5, 2013 and n. 265 of October 9, 2013, with which it was formed and integrated the Board of reserve of the marine protected area "Costa degli Infreschi and Masseta» composition established by art. 3, paragraph 339, December 21, 2007, law # 244; Having regard to the opinion required, no obligation expressed by the Commission in April 17, 2014 sitting on the proposal for an implementing regulation and organization of the marine protected area "Costa degli Infreschi and Masseta»; Having regard to resolution No. 12 of August 12, 2014 extraordinary Commissioner of the National Park of Cilento and Vallo di Diano Alburni which approves and transmits the integrated Regulation scheme and modified according to the instructions of the Ministry of environment and the Committee; Given the favourable opinion given by the Board of Auditors with the # 48 minutes September 17, 2014, pursuant to paragraph 10 of article. 9 of law No 394 of 1991, as amended by art. 1, paragraph 4, of P.r.decree # 73 of April 16, 2013; Visto l'art. the final paragraph of the law 28 December 31, 1992, # 979, as replaced by art. 2, paragraph 12, of Act July 8, 1986, # 349, under which the implementing regulation and organization and is approved by Decree of the Minister for the environment and protection of land and sea; Decided to proceed with the approval of the implementing regulation and organization of the marine protected area "Costa degli Infreschi and Masseta», on the basis of preliminary investigation and of technical deep dive discussions following the Commission's opinion on the proposal presented by the reserve National Park of Cilento and Vallo di Diano Alburni;
Decreed: it approved the implementing regulation and organisation of the marine protected area "Costa degli Infreschi and Masseta», annexed to this Decree to form an integral part.
