The Minister of agricultural food and forestry policies Saw the Legislative Decree March 29, 2004, n. 102 concerning, inter alia, the national solidarity fund in support of the agricultural enterprises affected by natural disasters and adverse weather events; Having regard to the Legislative Decree of April 18, 2008, # 82, adjustment of national solidarity fund regulation, referred to in Legislative Decree No 102/2004, for conformity to the guidelines for State aid in the agriculture and forestry sector 2007-2013 (2006/C 319/01) and Regulation (EC) 1857/2006, of December 15, 2006; Having regard to articles 5, 6, 7 and 8 of the same Legislative Decree No 102/04, as amended by Legislative Decree No 82/2008, governing compensatory damages, emergency interventions in areas and for uninsurable risks with preferential policies, assisted by State contribution; See, in particular, article. 6 identifying the procedures and methods for enabling on-demand assistance interventions in the region or autonomous province concerned, leaving this Ministry the Declaration of the exceptionality of adverse events, the identification of damaged territories and granted as well as the periodic allocation provisions of financial resources of the national solidarity fund to enable regions the aid delivery; Having regard to the European Union guidelines for State aid in the agriculture and forestry and rural areas 2014-2020 (2014/C 204/01); Having regard to Council Regulation (EU) No 702/June 25, 2014 2014 's declaring compatible with the internal market, in accordance with articles 107 and 108 of the Treaty on the functioning of the European Union, certain categories of aid in the agricultural and forestry sectors and rural areas, and repealing Regulation (EC) No 1857/2006; Examined in particular art. 25 of the above Reg. # 702/2014 regarding aid to compensate damages caused by natural disasters like weather adversity; Having regard to the Ministerial Decree of December 29, 2014, recorded at the Court of Auditors on March 11, 2015, Reg.ne Provv. # 623, and published on the website of the Ministry concerning the application of the provisions of legislative decree 102/04 in the light of the new rules on State aid to agriculture and forestry; Considered that the abovementioned decree December 29, 2014, must be communicated to the European Commission-free and therefore the provisions contained therein can have effect only following notice; Considered also necessary to proceed with the recognition of the existence of the exceptionality of the natural disasters in question to enable them to carry out investigative activities aimed at identifying the beneficiaries of the national solidarity fund provisions; Given that aid may not be granted pending the exemption of its notification to the European Commission of the Ministerial Decree of December 29, 2014 mentioned; Having examined the proposal by the regione Liguria for a declaration adverse events listed below, for the application in the territories damaged the national solidarity fund providences torrential rain from 10/9/2014 to 11/15/2014 in the province of Genoa torrential rain from 11/11/2014 to 11/15/2014 in the province of Savona acknowledged the Liguria region to have made the necessary findings which show that the events covered by this request for a declaration took the character of exceptionality in art. 1, paragraph 2 of the d.lgs. # 102/04 and s; Decided to accept the proposal of the Ligurian region of activation of national solidarity fund compensatory measures in affected areas to corporate structures, Decrees: Art. 1 Declaration of the exceptionality of weathering is declared the existence of the exceptionality of the disasters listed alongside the following provinces for damage to farm structures in the following agricultural territories, where they can apply the specific intervention measures provided for in Legislative Decree March 29, 2004, n. 102, as amended by Legislative Decree No 82 April 18, 2008;
