The HEAD of the CIVIL PROTECTION DEPARTMENT Viewed the art. February 24, 1992, 5 of the Law # 225; Visto l'art. March 31, 1998, 107 of Legislative Decree No. 112; Having regard to the Decree-Law September 7, 2001, n. 343, converted, with amendments, by law November 9, 2001, # 401; Having regard to Decree-Law of May 15, 2012, n. 59 converted, with amendments, by law, July 12, 2012 # 100; See in particular art. 3, paragraph 2, the last period of the aforementioned Decree-Law No 59/2012 where it is determined that for the continuation of the interventions by the commissarial administrations still operating under law February 24, 1992, n. 225 apply art. 5, paragraph 4-ter and 4-c of the Law # 225/1992; Having regard to the Decree of the President of the Council of Ministers of January 13, 2010, with which it was declared a State of emergency in relation to freak weather events that have affected the regions of Emilia Romagna, Liguria and Tuscany in the last decade of December 2009 and in the first days of January 2010, most recently extended by Decree of the President of the Council of Ministers of December 23, 2011 limited to regions of Emilia-Romagna and Liguria; Having regard to the order of the President of the Council of Ministers of February 19, 2010, # 3850 and subsequent amendments and additions; Having regard to the order of the President of the Council of Ministers # 4004 of February 16, 2012, and in particular art. 6, paragraph 1, whereby the Commissioner-President of Tuscany region, it was authorized, until October 31, 2012, to complete, ordinary, the initiatives already undertaken under the above order of the President of the Council of Ministers of February 19, 2010, # 3850; Having regard to the order of the Head of the Civil Protection Department # 84 of May 28, 2013 bearing: «Civil Protection Ordinance to encourage and regulate the takeover of the region Emilia Romagna, Liguria and Tuscany in initiatives aimed at overcoming the situation of criticality due as a result of exceptional weather adversity, that occurred in the last decade of December 2009 and in the first days of January 2010.» and in particular art. 3; Having regard to the note # 316508 of December 23, 2014 with which the person liable under art. 3, paragraph 2, of the Ordinance of the Chief of the Civil Protection Department n. 84/2013 described above, in transmitting the report on the implementation of assistance, asked for the extension of the period of duration of the validity of special accounting # 5414, over a period of 24 months; Recognized the need to ensure the completion, no uninterruptible power solutions, interventions aimed at overcoming critical context under review, even in a context of necessary prevention against possible danger to the public and private safety; Considered therefore necessary, adopt an Ordinance pursuant to art. 3, paragraph 2, last sentence, of Decree-Law May 15, 2012, # 59, converted, with amendments, by law no July 12, 2012. 100, which allow the prosecution, ordinary, of initiatives aimed at overcoming the situation of criticality; Gained the agreement of the Tuscany region; In consultation with the Ministry of economy and finance;
Features: Art. 1 1. To allow the performance of financial activities, the Executive Head of the regional civil protection system of the Tuscany region, appointed in accordance with art. 3 of the order of the head of the Civil Protection Department # 84 of May 28, 2013, owner of special accounting # 5414, is authorised to keep open the aforesaid accounting until December 31, 2016. 2. Stand still the reporting requirements in accordance with art. 5, comma 5-bis of law February 24, 1992, n. 225 and subsequent modifications and integrations. This Ordinance will be published in the official journal of the Italian Republic.
