The MINISTER of ECONOMIC DEVELOPMENT having regard to the Decree of the President of the Council of Ministers December 5, 2013, # 158, embodying the organisational regulations of the Ministry of economic development, for the responsibilities of supervision of cooperative; Having regard to the Decree-Law No 95 July 6, 2012, converted into law August 7, 2012, # 135; Having regard to the findings of the ministerial review concluded on July 17, 2014 and of the investigation concluded on October 2, 2014, which detects this insolvency of societa ' cooperativa "regional Consortium housing associations Vesta societa ' cooperativa»; Considered what emerges from the updated Chamber, made ex officio at the competent commercial register, in relation to corporate officers, at the registered office and the fulfilment of obligations relating to deposits; Considering that in November 25, 2014 date it was communicated, in accordance with art. 7 of the Law 241/90, the initiation of proceedings for placing under receivership to the legal representative of the cooperative, the Court of first instance and the competent Chamber of Commerce for the area; As the time for such remarks and counterclaims is passed without the Administration have received communications from interested parties; Noted the decree issued on September 6, 2014 by the judge for preliminary investigations of the FAO which ordered, inter alia, the preventive seizure of all the shares of the regional Consortium housing associations Vesta s.c.a.r.l. and the appointment of prof. Emanuele D'innella which administrator and custodian of excisable goods; Consider the reasons contained in the aforementioned issuance Decree of preventive seizure and deemed it necessary to have the forced liquidation of that Consortium; Having regard to art. 2545-l c.c. and 198 Royal Decree March 16, 1942, # 267; Deemed appropriate, in order to ensure the necessary coordination and the profitable and efficient conduct of activities by Commission, appoint as liquidator of «regional Consortium housing associations Vesta societa ' cooperativa» the same professional appointed by the competent court as administrator and custodian of the assets of the Consortium subject to preventive seizure; Given the specific expertise and experience of prof. Emanuele D'innella, as detected by CVS;
Decrees: Art. 1 The societa ' cooperativa "regional Consortium housing associations Vesta societa ' cooperativa», established in Rome (fiscal code 00493510580) is placed in receivership, according to art. 2545-l c.c. and prof. Emanuele D'innella, C.F. DNNMNL48B10B907S born in Spinazzola (BT) on February 10, 1948, and resident in Rome, via Giovanni Nicotera, n. 29 he appointed liquidator.
