The HEAD of the DEPARTMENT for higher education and research given the Decree-Law May 16, 2008, # 85 containing "urgent provisions to adapt structures of Government pursuant to article 1, paragraphs 376 and 377, December 24, 2007, law n. 244", published in Official Gazette No. 114 of May 16, 2008, converted with amendments into law July 14, 2008, # 121 published in Official Gazette No. 164 of July 15, 2008; Seen the D.P.C.M. of February 11, 2014 n. 98 "organisational regulations of the Ministry of education, University and research having regard to the Act of January 14, 1994 # 20 laying down:" provisions on jurisdiction and control by the Court of Auditors "; Having regard to the Legislative Decree of March 30, 2001, n. 165 recante: "general rules on labour sort employed by public administrations" and subsequent amendments and additions; Viewed Legislative Decree of September 6, 2011, n. 159 recante: "code of anti-mafia laws and preventive measures, as well as new arrangements for anti-mafia documentation, in accordance with articles 1 and 2 of law August 13, 2010, # 136"; Having regard to the Legislative Decree of July 27, 1999, # 297: "reorganization of discipline and streamlining procedures for the support of scientific and technological research, technology deployment, mobility of researchers"; Having regard to the Ministerial Decree of August 8, 2000 n. 593, establishing "procedural modalities for the granting of the facilities provided by the Legislative Decree of July 27, 1999, # 297" and, in particular, article. 11 regulating the granting of subsidies to projects independently submitted for research activities proposed by nascent society; Having regard to the Ministerial Decree No. 98 of May 2, 2002 establishing the Commission pursuant to paragraph 8 of article. 11 of the said Ministerial Decree 593; Having regard to the Ministerial Decree No. 115 of February 19, 2013 which provides in art. 11 paragraphs 2 and 3 that the competent offices of the Ministry to replace the functions and responsibilities previously conferred on the Board FAR; Having regard to the Decree of the Ministry of economy and finance # 90402 of October 10, 2003, in agreement with the Ministry of education, University and research, registered by the Court of Auditors on October 15, 2003 and published in the Official Gazette No. 274 of November 25, 2003; Having regard to the D.M. Prot. Gab/4 of January 2, 2008, published in the Official Gazette No 119 of May 22, 2008 laying down: "adapting the provisions of the Ministerial Decree of August 8, 2000 # 593 the Community framework on State aid to research, development and innovation communication 2006/C 323/01"; Given the directorial Decree n. 2405/Ric. the November 16, 2006, under which it was admitted to funding the research project No 4/6 entitled "TOP CELLS-innovative cellular models for evaluation of biological activity of compounds of natural origin" with a benefit MIUR 426,690.00 euros; Having regard to the note received by the MINISTRY of EDUCATION on July 6, 2011, prot. 7201 with which the Phitoremedial Srl has requested the granting of an additional 10% for size of company; Having regard to the note of August 3, 2011, prot. 7914, with which the Ministry asked the partner institution to verify the existence of the requirement for small and medium enterprises; Having regard to the note of July 17, 2014, prot. # 17365, by which the final report is forwarded to the Italian MIUR Mediocredito of scientific expert in which it is reported that the company PHITOREMEDIAL Srl has resorted to collaborations or EPR at least 10% of the total value of the project, resulting in the loss of the mark-up of 10% laid down in the aforementioned D.D. # 2405/Ric. the November 16, 2006; Having regard to the note of July 17, 2014, prot. 17365 cited above, in which he also confirmed Italian subsistence Mediocredito upon Constitution of society, of the requirement of SMEs; Considered the necessity of proceeding, for the project in question, the adoption of a specific measure of rectification to the directorial Decree n. 2405/Ric. the November 16, 2006;
