The Minister of agricultural food and forestry policies having regard to Regulation (EC) No 1760/2000 of the European Parliament and of the Council of July 17, 2000, and in particular title II regarding the labelling of beef and beef products; Having regard to Council Regulation (EC) no 1825/2000 of August 25, 2000, as amended, laying down rules for implementing Council Regulation (EC) no 1760/2000 of the European Parliament and of the Council as regards the labelling of beef and beef products; Having regard to Council Regulation (EU) no 1169/October 25, 2011 2011 the European Parliament and of the Council on the provision of food information to consumers, regulations (EC) No 1924/2006 and (EC) No 1925/2006 of the European Parliament and of the Council and repealing Council Directive 87/250/EEC, Directive 90/496/EEC , Directive 1999/10/EC, Directive 2000/13/EC of the European Parliament and Council Directives 2002/67/EC and 2008/5/EC and Regulation (EC) no 608/2004 of the Commission; Having regard to Council Regulation (EU) no 653/2014 "amending Regulation (EEC) No 1760/2000 as regards electronic identification of cattle and the labelling of beef" and in particular article 1, point 17 that from December 13, 2014, 16, 17 and 18 articles suppresses on a "voluntary" system replacing the header in title II, section II with the word "voluntary" and introduces the article 15 bis "general rules" of mandatory food information other than those provided for in articles 13, 14 and 15 that are added on the labels voluntarily by operators or organisations marketing beef; Having regard to article 4, paragraph 3, of law December 29, 1990, n. 428, on "measures to meet the obligations resulting from Italy's membership of the European communities", which provides that the Minister of agricultural food and forestry policies, with the agreement of the Standing Conference for the relations between the State, the regions and the autonomous provinces of Trento and Bolzano, within its competence, shall by order to the application within its territory of the regulations issued by the European Community; Having regard to article 1 of law no 1047, paragraph 296 December 27, 2006 under which the State functions of supervision over the activities of public and private bodies in the field of quality registered agri-food schemes are delegated to the Central Inspectorate Department of protecting quality and fraud repression of agri-food products; Having regard to the Ministerial Decree of August 30, 2000 on "Directions and methods of application of Regulation (EC) no 1760/2000 on mandatory labelling and voluntary beef and beef products "; Considered the note # 22600 of August 30, 2000 with which, according to the provisions of the abovementioned regulation No 1760/2000 of the European Parliament and the Council was notified the EU Commission that the Ministry of agriculture and forestry is designated as the "competent authority" for the purposes of the application of Community rules on the labelling of beef; CONSIDERED that the system of voluntary labelling provided for in title II of Regulation (EC) No 1760/2000, in force until December 13, 2014, ensured uniform conditions for the formulation of consumer information to ensure maximum transparency and, at the same time, he raised the beef market in the wake of several market crises caused by emergencies; CONSIDERED that the optional information added on the labels by operators or organisations marketing beef should be objective, verifiable by the competent authorities and understandable for consumers, and that the same information should conform to the horizontal legislation on labelling, and in particular to Regulation (EU) no 1169/2011 of the European Parliament and of the Council; Considered it necessary to regulate the voluntary labelling of beef and beef products, as provided for by article 15 already (a) of Regulation (EC) No 1760/2000 in order to ensure good communication and maximum transparency in the marketing of certain optional information not found from the official documentation concerning beef, breeding and feeding techniques; Considered appropriate to repeal the Ministerial Decree of August 30, 2000 on "Directions and methods of application of Regulation (EC) No 1760/2000 on mandatory labelling and voluntary beef and beef products"; CONSIDERED, finally, the need to adopt the necessary measures to ensure compliance with the provisions of article 22 of Regulation (EC) No 1760/2000, and proceeding with the utmost objectivity, simplicity and transparency to the verification of optional information added on the labels by operators or organisations marketing beef; GAINED the agreement of the Standing Conference for the relations between the State, the regions and the autonomous provinces of Trento and Bolzano on December 18, 2014;
DECREES: Article 1 (definitions) 1. For the purposes of this Decree, the definitions set out in article 12 of Regulation (EC) No 1760/2000; also, does "competent authority": a) ": the Ministry of agriculture, food and forestry, hereinafter referred to as the" Ministry "; b) "beef delivered prepackaged (prepackaged)": sales unit meant to be presented as such to the consumer and to the collective, consisting of beef and from the packaging in which it was entered before being marketed, shrouded entirely and partly from such packaging but still so that the contents cannot be altered without the package is opened or altered; c) "preincartata beef": sales unit consisting of beef and the enclosure in which it was placed or wrapped in the periods of sale at the request of the consumer or preincartata for the ' direct sale; d) "self-control": each operator control of the supply chain as well as that exercised through inspectors of the Organization; e) "control" means control exercised by an independent body authorized by the competent authority and designated by the Organization; f) "supervision": official control exercised by the public authorities to ensure compliance with the provisions contained in Regulation (EC) no 1760/2000 and norms of this Decree; g) "operators" and "organisations": subject marketing beef and shall label them with the compulsory information referred to in article 13 of Regulation (EC) No 1760/2000 as well as those working for third parties.
