The Minister of agricultural food and forestry policies having regard to Regulation (EU) no 1308/2013 of the European Parliament and of the Council of December 17, 2013 on the common organisation of the markets in agricultural products, and in particular art. 220 relating, inter alia, market support measures related to animal diseases; Having regard to Council Regulation (EU) No. 1071/2014 of October 10, 2014 on certain exceptional market support measures in the eggs and poultry sector in Italy; Having regard to Council Regulation (EC) No 652/2014 of the European Parliament and of the Council laying down rules for the management of expenditure relating to the food chain, animal health and welfare, plant health and plant reproductive material; Having regard to the legislative decree 165 of May 27, 1999 and subsequent amendments, under which it was established the Agenzia per le erogazioni in Agricolture (AGEA), in accordance with art. 11 March 15, 1997, law # 59; Considered that in the period between 14 August and September 5, 2013, Veneto and Emilia Romagna regions, were detected and notified to the European Commission of the cases of high pathogenicity avian influenza as a result of which it has been necessary sanitary measures aimed at curbing the spread of the epidemic, in particular through the establishment of protection and surveillance zones and further restriction; Considering that, as a result of this epidemic, the Italian Government asked the Commission enabling exceptional market support measures for eggs and poultry, as well as provided for by specific Community legislation; Given that implementation of the Regulation (EU) no 1071/2014 the Commission should indemnify the producers who have suffered damage as a result of these measures the health restriction, implemented until June 30, 2014; Considered that art. 1 of the implementing Regulation (EU) no 1071/2014 has 50% EU co-financing at Member State of the market support measures; Given that the delivery of aid to beneficiaries must take place by September 30, 2015; Deemed it necessary to establish procedures for the provision to interested parties of assistance, for individual types, as well as arranged by the invoked legislation; Gained the agreement of the Standing Conference for the relations between the State, the regions and the autonomous provinces of Trento and Bolzano in its session of December 18, 2014;
Decrees: Art. 1 scope 1. In implementation of the implementing Regulation (EU) No. 1071/2014, October 10, 2014, exceptional market support measures Italian poultry, identified by the following art. 2, shall apply to the following categories: chicken, Guinea fowl, duck, laying hen, pullet, chicken and Turkey and eggs of the genus Gallus.
