HEALTH MINISTER having regard to articles 2, 13 and 14 of the Decree of the President of the Republic October 9, 1990, # 309, as amended containing: "consolidated text of the laws concerning the regulation of narcotic drugs and psychotropic substances and of prevention, treatment and rehabilitation of their States of drug dependence», hereinafter referred to as ' text only '; In particular the tables I, II, III and IV that indicate the substances with strong tossicomanigeno power and misused in order of decreasing potential for abuse and dependence and table of medicines, divided into five sections, indicating the substances with pharmacological activity and are therefore used in therapy, according to the criteria for the formation of the tables referred to in art. 14 of the consolidated text; February 12, 2014 October 31, 2013 notes and views with which the drug policy Department of the Presidency of the Council of Ministers, through the national early warning and rapid response System for drugs, reported a high level of alert for the registration in Europe of deaths followed the assumption of AH-7921 and molecule for cases of seizure of products containing the molecule 251-NBOMe; Having regard to the EU Council implementing decision of September 25, 2014, published in the official journal of the European Union L 287 of the 1 St October 2014, which referred to measures to monitor substances 2.5-dimethoxy-4-iodo-N-(-2-methoxybenzyl) phenethylamine (25I-NBOMe), 3.4-Dichloro-N-[(1-(dimethylamino) cyclohexyl) methyl] benzamide (AH-7921), 3.4-methylenedioxypyrovalerone (MDPV) and 2-(etilamino)-2-(3-methoxyphenyl) cyclohexanone (metossietamina) in view of the health hazards and lack of property or therapeutic uses of such substances; Considered that the substances Metilendiossipirovalerone (MDPV) and Metossietamina, the subject of that decision, are already under control in Italy and included in table I annexed to the single act; Having regard to the opinion of the higher Institute of health, rendered with a note of November 6, 2014, favour inclusion in table I of the consolidated text of the substances 2.5-dimethoxy-4-iodo-N-(-2-methoxybenzyl) phenethylamine (25I-NBOMe) and 3.4-Dichloro-N-[(1-(dimethylamino) cyclohexyl) methyl] benzamide (AH-7921); Having regard to the note May 6, 2014 by which the drug policy Department of the Presidency of the Council of Ministers, through the national early warning and rapid response System for drugs, reported a high level of alert following registration in Sweden of 11 deaths and analytical identification of the molecule MT-45 in the femoral blood of victims; Having regard to the warning note issued on the same date by the Ministry of health General Directorate of prevention to the departments of health of the autonomous regions and provinces, aimed at preventing the rapid spread of such substances on the market for drugs and through the internet; Having regard to the opinion of the higher Institute of health, rendered with a note of November 11, 2014, favour inclusion in table I of the consolidated sostanza1-cyclohexyl-4-(1.2-difeniletil)-piperazine (MT-45); Having regard to the opinion of the High Council of health, expressed at its meeting of December 9, 2014, favour inclusion in table I of the consolidated text of the substances 2.5-dimethoxy-4-iodo-N-(-2-methoxybenzyl) phenethylamine (25I-NBOMe) and 3.4-Dichloro-N-[(1-(dimethylamino) cyclohexyl) methyl] benzamide (AH-7921) and of the substance 1-cyclohexyl-4-(1.2-difeniletil)-piperazine (MT-45), deemed necessary to these inserts to protect public health;
Decrees: Art. 1 in table I of the Decree of the President of the Republic October 9, 1990, # 309, as amended, are included, in alphabetical order, the following substances: (25I-NBOMe): 4-iodo-proprietary 2.5-dimethoxy-N-(-2-methoxybenzyl) phenethylamine: chemical name;
(AH-7921): 3.4 name-Dichloro-N-[(1-(dimethylamino) cyclohexyl) methyl] benzamide: chemical name;
(MT-45): common name 1-cyclohexyl-4-(1.2-difeniletil)-piperazine: chemical names.
