Implementation of Directive 2002/89 laying down «214/EC on protective measures against the introduction into and the spread within the community of organisms harmful to plants or plant products "; Having regard to the European Commission's implementing decision No 2014/497/EU on measures to prevent the introduction into and the spread within the European Union of Xylella fastidiosa (Well and Raju); Having regard to the order of the Minister of agriculture, food and forestry of September 26, 2014 bearing "emergency measures for the prevention, control and eradication of Xylella fastidiosa (Well and Raju) in the territory of the Italian Republic" with which they were governed the activities to be put in place; Having regard to the resolution of the Board of Ministers of February 10, 2015 with which it was declared, for 180 days, a State of emergency as a result of the spread in the region of Puglia of quarantine pathogenic bacterium Xylella fastidiosa (Well and Raju) in view of the need for extraordinary powers to implement the measures in question; Seen the need to place more timely implementation of necessary emergency measures aimed at tackling the aforementioned emergency context; Considered making use, in the present case, the conditions under art. 5, paragraph 2, lett. c) February 24, 1992, law No. 225, for the adoption of an order of the head of the Department of civil protection; Gained the agreement of the Puglia region; Heard the Ministry of agriculture, food and forestry;
Features: Art. Appointed Commissioner 1 and plan of operations 1. In order to face the emergency linked to the spread of Xylella fastidiosa (Well and Raju) in the region of Puglia, the Regional Commander of the State Forestry Corps for the region of Puglia is appointed Special Commissioner. 2. The regional agency for irrigation and forestry activities in the region Puglia is appointed Special Commissioner's implementing body. 3. For the purpose of carrying out the activities referred to in this Ordinance, the Commissioner, which is free of charge, can avail themselves of the State Forestry Corps and, even as the subject actuators, Puglia region, Servizio fitosanitario regionale, municipalities, provinces, non-territorial public authorities concerned, as well as private parties with public participation that contributes to overcoming the context of criticality. The Special Commissioner ensures a constant information to the Ministry of agriculture, food and forestry and the Puglia region with regard to the activities carried out in pursuance of this order for the resulting information that those administrations have a responsibility to provide the Commission with the EU. 4. The Commissioner shall, within the limits of the financial resources under art. 4, within twenty days from the date of this order, a plan for more rapid implementation of the measures referred to in articles 10 and 11 of the Decree of the Minister of agriculture, food and forestry of September 26, 2014 for the approval of the Civil Protection Department, after investigation of the Monitoring Committee referred to in paragraph 6, with respect to the aspects connected with the localization of the interventions to be , the list of same, with its schedule, as well as the estimate of the costs. 5. The aforementioned plan can be subsequently reformulated and integrated, limited to the schedule of activities and its estimated costs, within the limits of the resources referred to in art. 4 and with the terms of paragraph 4, as well as any additional phytosanitary measures identified in a subsequent decision of the Minister of agriculture, food and forestry in accordance with art. 10, paragraph 9, of the Ministerial Decree dated September 26, 2014 quoted above. 6. The Civil Protection Department sets up a Committee to monitor the activities carried out by the Special Commissioner, ensuring all appropriate links with the scientific and Technical Committee referred to in the Decree of the Minister of agriculture, food and forestry of September 12, 2014. The Monitoring Committee is composed of seven members: three appointed by the Ministry of agriculture, food and forestry, including one acting as Chairman, two appointed by the Civil Protection Department and two from the Puglia region. 7. To participate in the Committee referred to in paragraph 6 are not due to add fees, attendance fees or other emoluments. 8 any charges relating to reimbursement of expenses incurred by members of the Committee referred to in paragraph 6 are borne of resources under art. 4 and, for that purpose, in the plan of assistance referred to in paragraph 4 are quantified sums required.
