The Minister for infrastructure and transport Saw the art. 2, paragraph 8, of the Legislative Decree of April 30, 1992, # 285, new highway code, which gives the Ministry of infrastructure and transport the competence concerning the classification and declassification of national roads; Visto l'art. 3, paragraph 2 of the Decree of the President of the Republic December 16, 1992, # 495, regulation of execution of the new highway code, which prescribes that for national roads declassification is introduced by Decree of the Minister of infrastructure and transport, at the proposal of ANAS or region concerned for the territory, in accordance with the procedures set out in art. 2, paragraph 2, of the regulation; Visto l'art. 4, paragraph 2 of the Decree of the President of the Republic December 16, 1992, n. 495, which prescribes that the recruitment and dismissal of State roads or individual logs take place by order of the Minister of infrastructure and transport, on a proposal by one of the institutions concerned, after consulting the other competent authorities, in consultation with the Superior Council of public works; See paragraph 3 of the same article. 4 cited that provides that, by way of derogation from the procedure set forth in paragraph 2, the existing stretches of highways decommissioned following variants, which do not alter the cornerstones of road alignment, forgiveness of law the ranking of State roads and, if they are still usable, must be transferred to a province or municipality; Visto l'art. 3 of Legislative Decree No 461 October 29, 1999, which provides that in the autonomous provinces of Trento and Bolzano, in relation to the specific competences attributed to them, the subject matter by the same Decree remains governed by it already stipulated in specific provisions of the Statute; Visto l'art. 19 of the Decree of the President of the Republic March 22, 1974, # 381, implementing rules special statute for Trentino-Alto Adige region in the field of urban planning and public works, as amended by Legislative Decree No 320 September 2, 1997, which provides that as from 1 July 1998 are delegated to autonomous provinces of Trento and Bolzano, for the respective territory the functions in the field of roads and road of the State which proprietors and Ente nazionale per le strade (ANAS), excluding highways; Visto l'art. 4 of Decree of the President of the Republic March 22, 1974, # 381, implementing rules special statute for Trentino-Alto Adige region in the field of urban planning and public works, which provides that the classification as local roads and provincial highways and the reclassification of roads are maintained by the State in consultation with the province concerned; Considering that the said by-laws do save the previous rules provided for in Legislative Decree of April 30, 1992, # 285, new highway code, and by the Decree of the President of the Republic December 16, 1992, # 495, regulation of execution of the new highway code, on the classification of state highways as complementary to statutory discipline itself, with the only difference being that the same provinces are successors to the ANAS in their capacity as managing body of national roads to the senses of the art. 19 of the Decree of the President of the Republic March 22, 1974, # 381; Having regard to the note. 13/491969/177ALF/19.5.6/s106 of September 11, 2013, with which the autonomous province of Trento has applied for classification as part of State Road s.s. 612 ' variation of the Cembra Valley», to the village of Molina di Fiemme, which extends from km at km 41.235 42.080, and declassification in strada comunale underlying tract; Having regard to the vote # 110/13 made in the meeting of July 31, 2014, with whom the Higher Council of public works-V section, gave a favourable opinion on the request for classification to s.s. 612 ' variation of the Cembra Valley», to the village of Molina di Fiemme and contextual declassification to municipal road of its section;
Decrees: Art. 1 the variant to the village of Molina di Fiemme, with a length of the stroke, which underlies existing 0.910 km s.s. 612 «Val di cembra» by km at km's 41.235 42.080 classified road s.s. 612 variant of Molina di Fiemme (TN).
