The MINISTER of ECONOMIC DEVELOPMENT having regard to article 1, paragraph 845 of the Act December 27, 2006, # 296 (Finance Act 2007) and subsequent amendments and additions, which provides that the Minister of economic development may establish, by Decree, specific aid schemes in compliance with Community rules; Considered appropriate to establish a specific aid scheme aimed at supporting, through facilitating the creation and development of cooperative societies, the growth of economic activities and employment levels; Having regard to Council Regulation (EC) No 651/2014 of June 17, 2014, declaring certain categories of aid compatible with the common market in application of articles 107 and 108 of the Treaty, published in the official journal of the European Union L 187 of June 26, 2014 and, in particular, article 17 establishing the conditions for considering compatible with the common market and exempt from the obligation to notify investment aid in favour of SMEs; Having regard to Council Regulation (EU) No 1407/2013 December 18, 2013 Committee on the application of articles 107 and 108 of the Treaty on the functioning of the European Union to de minimis aid, published in the official journal of the European Union L 352 of December 24, 2013 and subsequent amendments and additions; Having regard to act February 27, 1985 n. 49, containing "Provisions for the credit cooperation and urgent measures to safeguard employment levels", as amended by article 12 of law No 57, March 5, 2001 and subsequent modifications and integrations and, in particular, article 17, which sets out the method of intervention of the Ministry of economic development, through equity participation of finance companies specially formed to support the development of small and medium-sized enterprises established in the form of cooperative societies or small cooperative society; Having regard to article 23 of Decree-Law No June 22, 2012. 83, converted, with amendments, by law no December 17, 2012. 221, by which it is established in the Ministry of economic development the Fund for sustainable growth; Having regard to the Decree of the Minister of economic development, in consultation with the Minister of economy and finance, March 8, 2013, published in the Gazzetta Ufficiale della Repubblica italiana n. 113 of May 16, 2013, which are identified within the meaning of article 23, paragraph 3, recalled of Decree Law No 83 of 2012, prioritize, the shapes and the maximum aid intensity granted under the Fund for sustainable growth and, in particular, article 3, paragraph 2, point b), of the aforementioned ministerial order, where it is expected that the Fund for sustainable growth supports direct interventions "to strengthen the country's industrial structure , reuse of production facilities and to revitalising areas facing complex crisis situations of national significance "; Having regard to the Legislative Decree March 31, 1998, n. 123 and subsequent amendments and additions, containing "Provisions for the rationalization of public support to enterprises, in accordance with article 4, paragraph 4, point c) of law March 15, 1997, # 59"; Having regard to the order of the Minister of economy and finance and the Minister of economic development, February 20, 2014, n. 57, published in the Gazzetta Ufficiale della Repubblica italiana n. 81 of April 7, 2014, which identifies the modalities according to which account is taken of the rating of legality attributed to enterprises for the purpose of granting of loans by public administrations and of access to bank credit, in accordance with article 5-ter, paragraph 1, of Decree-Law No 1 January 24, 2012, converted, with amendments, by law March 24, 2012 , # 27; Given the need to support the birth, throughout the country, cooperative company promoted and consist of workers from companies in crisis, in line with the provisions in article 3, paragraph 2, point b), of the aforementioned ministerial decree March 8, 2012, of social cooperatives and cooperatives who manage companies confiscated from the organized crime, as well as the development and strengthening of cooperative companies located in the regions of southern Italy in order to create a stable and lasting development, through the creation of new businesses and the resulting increase in employment levels, Decrees: Art. 1 Definitions 1. For the purposes of this Decree, the following definitions are adopted: a) "Ministry" means the Ministry of economic development;
b) "finance companies" means the finance companies participate by the Ministry in accordance with the provisions of article 17, paragraph 2, of law February 27, 1985 n. 49 and subsequent amendments and additions;
c) "cooperative society": the companies cooperatives, small and medium sized pursuant to annex 1 to the regulation, whose financial company delivers enough subsidized loan has already acquired, pursuant to article 17 of law February 27, 1985, # 49, a temporary minority participation;
d) "sustainable growth fund" means the Fund referred to in article 23 of Decree-Law No 83 June 22, 2012, converted, with amendments, by law, August 7, 2012 # 134;
e) "block exemption regulation": Regulation (EU) No. 651/2014 of June 17, 2014, declaring certain categories of aid compatible with the common market in application of articles 107 and 108 of the Treaty, published in the official journal of the European Union L 187 of June 26, 2014;
f) "de minimis regulation": Regulation (EU) No. 1407/2013 December 18, 2013 Committee on the application of articles 107 and 108 of the Treaty on the functioning of the European Union to de minimis aid, published in the official journal of the European Union L 352 of December 24, 2013 and subsequent amendments and additions;
g) TFEU ": Treaty on the functioning of the European Union, the Treaty establishing the European Community;
h) "southern regions": the regions Abruzzo, Basilicata, Calabria, Campania, Molise, Apulia, Sardinia and Sicily.
