The MINISTER of health having regard to law no 183 April 16, 1987; Having regard to the Decree of the President of the Republic March 3, 1993, # 587, laying down rules for the implementation of Directive 90/539/EEC on veterinary standards for intra-Community trade in, and imports from third countries of, poultry and hatching eggs; Having regard to the Decree of the President of the Republic November 15, 1996, n. 656 laying down rules for the implementation of Directive 92/40/EEC introducing Community measures for the control of avian influenza; Having regard to the Decree of the President of the Republic November 15, 1996, n. 657 laying down rules for the implementation of Directive 92/66/EEC laying down Community measures against Newcastle disease; Having regard to Council Directive 93/120/EC amending Directive 90/539/EEC; Deemed necessary for the implementation into domestic law of Council Directive 93/120/EC, make certain adjustments to the rules laid down in Decree of the President of the Republic No. 587/1993, in accordance with the contents of that directive; Having regard to article 17, paragraph 4 of the law no 400 August 23, 1988; Hearing the opinion of the State Council, expressed in the meeting of the consultative section the legislation of December 15, 1997; Having regard to the communication to the President of the Council of Ministers, made with footnote 3/243 600.3/AG. on January 15, 1998;
A d o t t in this Regulation: Art. 1.1. The Decree of the President of the Republic March 3, 1993, # 587, is amended as follows: article 2, paragraph 2): 1) the letter c) that's replaced: "c) day-old chicks: all poultry less than 72 hours not yet fed. However, Muscovy ducks (Cairina moschata) or their crosses may be fed; 2) the letter g) that's replaced: "g) herd means all poultry of the same health status kept on the same premises or in the same enclosure and constituting a single epidemiological unit. For poultry in battery pack includes all birds sharing the same environment "; 3) point 3) letter i) that's replaced: "3) breeding establishment: an establishment for the breeding of poultry, which is an establishment which activities is to reproductive poultry before the stadium as reproductive rearing establishment of productive poultry, which is an establishment which activities is to ovaiolo poultry prior to the laying stage eggs"; 4) the letter q) is suppressed.
B) article 5 is replaced by the following: "Art. 5.-1. To be traded within the community: a) hatching eggs, day-old chicks, breeding poultry and productive poultry must satisfy the conditions laid down in articles 6, 12, 15 and 17 as well as all the conditions laid down pursuant to articles 13 and 14; In addition, the conditions must be met: 1) in article 7, for hatching eggs;
2) in article 8, for day-old chicks; 3) in article 9, for breeding poultry and productive poultry; b) slaughter poultry must satisfy the conditions set out in articles 10, 12, 15 and 17 and those laid down pursuant to articles 13 and 14; c) poultry-including day-old chicks intended for restocking supplies of wild game supply shall comply with the conditions laid down in articles 12, 15 and 17 10-bis, and those laid down pursuant to articles 13 and 14. "
C) in article 6, paragraph 1:1) point 3) of (a)) that's replaced: "3) must be located in an area subject to animal health reasons, to restrictive measures in accordance with Community legislation, adopted as a result of an outbreak of a disease to which poultry is susceptible; 2) letter b) that's replaced: "b) a flock which, at the time of consignment, presents no clinical sign or suspicion of contagious poultry disease".
D) article 7 is replaced by the following: "Art. 7.-1. At the time of consignment, hatching eggs must come from flocks which: a) that: 1) stay, for more than six weeks in one or more establishments referred to in article 6, paragraph 1, point a), paragraph 1), located on Community territory; 2) if vaccinated, have been under the conditions of annex III; 3) have been tested with the following methods, among them 3 alternatives: a) to an animal health examination carried out by an official veterinarian or authorized veterinarian during the 72 hours preceding consignment and, at the time of this review, did not show any clinical sign or suspicion of contagious disease; 3 b) an animal health examination carried out by an official veterinarian or authorized veterinarian on a monthly basis, on the understanding that the most recent inspection must be made at the latest 31 days before shipment. The) article 11:1) the letter c) of paragraph 2 that's replaced: "c) that, if vaccinated, vaccination conditions in annex III satisfies"; 2) the letter e) of paragraph 2 that's replaced: "e) located outside from an area subject to animal health reasons, to restrictive measures in accordance with Community legislation, as a result of an outbreak of a disease to which poultry is susceptible; 3) letter f) of paragraph 2 is repealed;
4) after paragraph 2, the following paragraph 3 is added: ' 3. In the month preceding their shipping all poultry shipment must have undergone, with negative results, serological tests for antibodies of salmonella pullorum and salmonella gallinarum in accordance with annex II, chapter III. For hatching eggs or day-old chicks, in the three months prior to dispatch the herd of origin must undergo serological tests for salmonella pullorum and salmonella gallinarum research, such as to identify with a degree of reliability of 95% an infection with a prevalence of 5% ".
L) in article 12, the following paragraph 2 is added: ' 2. For the purpose of recognising non-vaccination status for the entire country or only for certain regions, the Ministry of health in the community may submit a program that also contains the additional guarantees, General or specific to be required in intra-Community trade ".
M) in article 15:1) il comma 1 that's replaced: 1. b) have a label stating: 1) the Member State and region of origin; 2) the approval number of the establishment of origin referred to in annex II, chapter I, point 2; 3) the number of chicks or eggs contained in each package; 4) the species of poultry to which the chicks or eggs "; 2) in subsection 3, letter c) is deleted; 4, subparagraph 3) after it added the following paragraph 4 bis. In relation to imports of poultry and hatching eggs the criteria for classifying third countries with regard to avian influenza and Newcastle disease are established with Community decisions; in the community may also be laid down conditions to allow for the applicability of the provisions referred to in paragraph 1, only a part of the territories of third countries. " P) in article 19, paragraph 2, point h), after the words "a stamp" are added the words "and a signature".
