THE MINISTERIAL COMMITTEE FOR ECONOMIC PLANNING Having regard to Law 15 January 1994, n. 65, the ratification of the Framework Convention of the United Nations on Climate Change, signed in New York in 1992 on the "stabilization of concentrations of greenhouse gases into the atmosphere at a level that would prevent dangerous interference Activities' human climate system" ; Having regard to Legislative Decree 31 March 1998, n. 112, which transfers al1e regions and local authorities additional functions and responsibilities for the environment and energy and considering the functions attributed by art. 8 of the Legislative Decree 28 August 1997, n. 281, the Joint Conference for relations between the State, regions, autonomous provinces, local self-government; Given the Protocol, adopted on 10 December 1997 in Kyoto by the Third Conference of the Parties to the Climate Change Convention, which commits the EU Member States to reduce, within the period between 2008 and 2012, greenhouse gas emissions by 8% compared to 1990 levels; View the communication of the European Commission Com (98) 353 "Climate Change - Towards an EU post-Kyoto strategy", which identifies the lines of development of European policies and measures for the implementation of the Kyoto Protocol, with particular reference to energy , transport, agriculture, industry, fiscal measures, to scientific research and development of new technologies, besides 'the use of the flexibility mechanisms'; Given the decision of the Council of Environment Ministers of the European Union of 17 June 1998 which commits Italy - as part of the EU's obligations under the Kyoto Protocol - to reduce their greenhouse gas emissions to the extent of 6.5% compared to 1990 levels (corresponding to an effective reduction of 100 million tons - of carbon dioxide equivalent) within the period between 2008 and 2012, on the basis of a program that reductions must 'be implemented from 2002 and verified annually by the EU; Given the aforementioned EU Directives referred to the decision of 17 June 1998: 96/61 / EC on the use of best available techniques for environmental protection and energy efficiency, to support the authorization of new industrial plants and the reauthorization of existing facilities; 96/92 / EC on the liberalization of the market and efficient use of energy as well as' the Directive approved on 11 May 1998 concerning the distribution and natural gas carriage; Having regard to the White Paper of the European Commission on renewable sources of 26 November 1997, and decisions of the Council of EU Energy Ministers of 8 December 1997 and 11 May 1998, also recalled the decision of 17 June 1998, which stress the need to promote by appropriate technical and fiscal regulations promotion to all Member States of the renewable sources of natural gas combined cycles, energy efficiency; Given the European Commission's Communication on "Transport and CO2 '(COM (98) 204) setting out the measures for the reduction of transport emissions, related to the manufacturing technology of the vehicles, the application of the best and most' efficient techniques available for the organization of the different modes 'of transport, the use of taxation' as an instrument of cost internalization and promotion of forms of transport with lower emissions; Given the European Union's Fifth Framework program for research and technological development activities and 'demonstration 1998-2002; Given the renewable energy from biomass national program, prepared by the Ministry of Agriculture June 24, 1998; Given the "Green Paper on renewable sources of energy" developed by ENEA in collaboration with the ministries of industry, environment and scientific and technological research in July 1998; Given the economic and financial planning document 1999-2001, and in particular Chapter V devoted to employment policies and development, which calls among other things the need to develop policies and measures for environmental protection and in particular for the reduction of greenhouse gas emissions in the various sectors; Having regard to its resolution of 3 December 1997 on the "Second National Communication to the UNFCCC", which indicated the programs for the containment of emissions of greenhouse gases to be prepared by the competent authorities in a coordinated manner with each other and according to the criteria of the highest environmental and economic efficiency; The Order of the President of the Council of Ministers of 20 March 1998 establishing the interministerial working group (set up by decree of the President of the Council of Ministers on March 20, 1998 to ensure a high level of coordination of programs of local authorities in the areas identified by resolution CIPE of 3 December 1997); Having regard to its resolution on August 5, 1998 on the Rules of Procedure of CIPE and in particular art. 2, paragraph 1, establishing inter alia, in support of the attivita 'of the Committee, the Commission on Sustainable Development; Given the results of the inaugural session of this commission dated September 8, 1998, in particular as it regards the inclusion of the aforementioned working group established by the President of the Council of Ministers of March 20, 1998 as part of the committee; Given the legislative decree, approved by the Cabinet on 10 July 1998 laying down the ENEA functions as the national agency for energy and the environment, aimed in particular to "provide specialist technical support to the competent authorities for public shares in national and international level "; Considering that the Kyoto Protocol on 10 December 1997: a) has established that need to be reduced emissions of the six main greenhouse gases not controlled by the Montreal Protocol for the protection of the ozone layer, identified in the carbon dioxide (C02) , methane (CH4), nitrous oxide (N2O), hydrofluorocarbons (HFCs), perfluorocarbons (PFCs) and sulfur hexafluoride (SF6); b) it identified the actions to be implemented by the countries "Annex 1" (with industrialized countries and economies in transition countries) to reduce emissions, with particular reference to: promote energy efficiency in all sectors; development of renewable sources for energy production and innovative technologies for reducing emissions; protection and extension of forests for carbon sequestration; promoting sustainable agriculture; limiting and reducing methane emissions from landfills and other energy sectors; appropriate fiscal measures to discourage greenhouse gas emissions; c) it has established three mechanisms of flexibility ', complementary to national actions, to contribute to the implementation of emission reduction commitments through the implementation of joint initiatives involving more' Countries "Annex 1" (Joint Implementation), or through cooperation with countries "non-Annex 1" (countries developing or newly industrialized) for compatible development (Clean development Mechanism), or through international trade of emission permits (emissions Trading); d) it identified as an additional measure to reduce emissions also carbon absorption achieved by activities' afforestation and reforestation since 1990; Considering that the programs identified by the aforementioned resolution of 3 December 1997 are consistent with the actions identified in the Kyoto Protocol and with the policies and measures referred to by the decision of the Council of EU Environment Ministers on 17 June 1998; Considering that the national energy market must 'implement within a short time determined deep changes from the implementation of the European directives on the liberalization of the market and efficient use of energy, besides', in the field of distribution and natural gas carriage and to this end, and 'was convened on 25 to 28 November 1998, the national Conference on the environment and energy; It considered that the programs for the reduction of greenhouse gas emissions identified by the CIPE decision of December 3, 1997, and prepared in accordance with the indications of the Kyoto Protocol and within the guidelines defined by the European Union, will be an opportunity 'for Italy's modernization according to the environmental and energy efficiency criteria, and open up new prospects for international cooperation with developing countries and those of centroest Europe with economies in transition; It took note of the "Guidelines document for national policies and measures for reducing greenhouse gas emissions", prepared by the inter-ministerial working group; Given the proposals of the Ministry of the Environment No. 3782/98 / SIAR of 29 September 1998; Resolution: 1. For the promotion and development of national actions, pending the establishment of a special fund for climate protection, will 'front as well as with ordinary budget lines of each Administration concerned, with an earmarked financial resources, according the provisions of the bill to the finance '99 (act 5267 Room, art. 8, letter e), at the industry compensatory measures with incentives for emission reduction for energy efficiency and renewable sources. 1.2. The Commission for Sustainable Development, prepares the implementing measures provided for in this resolution, and plays in a general way the activities 'monitoring on the implementation of national policies and measures identified by the guidelines, evaluating altresi' the consistency of programs and investments public with the emission reduction targets identified in the present resolution and taking into account the realization level of the actions provided for in compliance with EU decisions by the other EU countries. 1.3. Technical support to the attivita 'of sustainable development Commission and' assured by the inter-ministerial working group mentioned in the introduction - integrated by representatives of the Ministries of Foreign Affairs, Finance and Foreign Trade - and supported by ENEA, in ' scope of program agreements with the ministries of environment and industry. The criteria and methods 'of the working group functioning as well as' any changes in the composition, will be established by a Commission decision. 1.4. The Commission will promote 'the organization of an observatory to monitor the implementation of programs and measures envisaged by this resolution in collaboration with ENEA, ANPA, the government departments, regions and autonomous provinces. 2. On the basis of the work of the Commission on Sustainable Development and in view of the National Conference Energy Environment conclusions, recalled in the introduction: 2.1. By 30 April 1999 the Minister for the Environment, in agreement with the Ministers of Education, University 'and scientific and technological research, public works, industry, of Agriculture, after consultation with the Joint Conference, submit it to the CIPE the "national Programme for information on climate change", with priority reference to: a) development of public information programs by public administrations; b) promotion of information campaigns on the part of public and private companies, associations, through agreements with the government. 2.2. By 30 April 1999 the Minister for the Environment, in agreement with the Minister of the University 'and scientific and technological research, industry, public works and agriculture policies, consultation with the Joint Conference, shall submit for approval CIPE the "national program for climate research", based on the following criteria: a) census of the activities' of Italian research on climate protection; b) development of research programs, in liaison with the community 'international scientific, and programs International, with priority 'to the attivita' organized within WMO and IPCC. 2.3. By 30 April 1999 the Minister of Agriculture, in consultation with the Ministers of the environment, industry, transport, finance and university 'and scientific and technological research, consultation with the Joint Conference, submit to 'CIPE approval of the "national Programme for the enhancement of agricultural and forestry" to achieve the objectives set out in the guidelines, which defines the criteria and guidelines aimed at: a) crops totally or partially allocated to energy production; b) recovery of waste and agricultural by-products, forestry, and agro-zootechnical for the production of energy; c) production of bio-fuels and biofuels; d) production of thermal energy and / or electricity from biomass; e) use of biomass energy in the transport and heating; f) application of compensation measures, facilitation and incentives for non-food agricultural production, and for the production of biofuels and bio-fuels; g) of carbon absorption by forest biomass; h) voluntary agreements between the authorities and economic operators in the agricultural and agro-industrial sector to achieve the objectives identified by the guidelines. 2.4. By 30 April 1999, the Minister of Industry, in consultation with the Environment Ministers of Agriculture, Public Works, Finance and the University 'and scientific and technological research, consultation with the Joint Conference, to order to achieve the objectives identified by the guidelines, submit it to the CIPE the "white Paper for the exploitation of energy from renewable sources", prepared under the "green Paper" mentioned in the introduction. 2.5. By 31 December 1999 on the basis of the Commission's sustainable development work, the Minister of Transport, under the general transport plan, in agreement with the Ministers of the environment, industry and public works, after consulting the Conference unified, in order to achieve the objectives identified by the guidelines, draw up and submit for approval by the CIPE to the "white Paper on mobility 'sustainable'. 3. By 30 June 1999 based on the work of the Commission on Sustainable Development Minister for the Environment, in agreement with the Minister of Health ', industry, of Agriculture, after consultation with the Joint Conference, in order to achieve objectives identified by the guidelines, shall adopt measures concerning: a) definition of the criteria for the application of best available techniques laid down in Directive 96/61 / EC, for the purpose of better energy efficiency of the power plants and industrial; b) regulation of the combustion of biomass for energy purposes; c) regulation of the use of biofuels and biofuels in accordance with art. 2 of the Law of 8 July 1986, no. 349. 4. By 31 December 1999, on the basis of the Commission's sustainable development work, the Minister of Industry, in consultation with the Ministers of the Environment and Public Works, having heard the unified Conference, establishes standards and guidelines user guide energy devices more 'efficient and to reduce energy consumption for heating and air conditioning, in the civil construction sector, both public and private, in order to achieve the objectives identified by the guidelines. 5. By 31 December 1999, where they have not been entered into voluntary agreements between operators and aministrazioni that meet the objectives set by the guidelines, based on the sustainable development of the Commission's work: 5.1. The Minister for the Environment, in agreement with the Minister of Health ', industry, for agriculture and transport policies, consultation with the Joint Conference, also in view of Directive 96/62 / EC on the protection of quality' of 'air, the European "auto-oil" directives on emissions from cars, the decisions adopted by the EU Council of Ministers regarding the reduction of fossil fuel consumption, of law no. 413/1997 concerning the prevention of air pollution through benzene and polycyclic aromatic hydrocarbons, in order to achieve the objectives identified by the guidelines, shall adopt measures concerning: a) mandatory use of biodiesel in motor vehicles for public transport, starting from the municipalities with more than 100,000 inhabitants; b) use mandatory for biodiesel blended with diesel fuel distributed in the network; c) use of bioethanol, for the production of ETBE to be mixed in gasoline distributed in the network; d) mandatory use of biodiesel mixed with diesel fuel intended for recreational boating. 5.2. The Minister of Industry, in consultation with the ministers of environment and health ', after consultation with the Joint Conference - also in view of Directive 96/61 / EC for the prevention and integrated pollution control and 96 / 92 / EC on the liberalization of the market and the efficient use of electricity - identifies the criteria and measures to increase the efficiency of thermal power plants, from the production of energy plants which require high consumption and low yields and that they are destined to a marginal role, as a result of that liberalization of the electricity market. 5.3. The Minister of Industry, in consultation with the Minister, after consultation with the Joint Conference, establishes the standards and guidelines for the reduction of energy consumption in the industrial and service sector, in order to achieve the objectives set out in the guidelines . 5.4. The Minister for Transport, in agreement with the Ministers of the environment, industry, and public works, consultation with the Joint Conference, shall adopt the measures relating to the reduction of carbon dioxide emissions in the transport sector, in order to achieve the objectives set by the guidelines, considering the following order of priority ': a) gradual replacement of public fleet vehicles with low-emission vehicles; b) the rapid development of mass transport in urban and metropolitan areas, with the simultaneous limitation of the private motor vehicle traffic, and the promotion of urban cycling routes; c) transfer of a progressive quota of freight from rail / road cabotage. 5.5. The Minister for the Environment, in agreement with the Ministers of Industry and of Agriculture, in consultation with the Joint Conference adopts measures relating to the reduction of emissions in non-energy sectors, in order to achieve the objectives set out in the guidelines, recital the following order of priority ': a) reducing nitrous oxide emissions from industrial processes; b) promotion of waste recycling; c) the reduction of methane emissions from landfills; d) the reduction of methane emissions from livestock farming; e) limitations on the use of hydrofluorocarbons, perfluorocarbons, sulfur hexafluoride, in industrial processes and in the use of equipment containing those substances. These measures and measures can also be issued with reference to specific areas in which voluntary agreements, aimed at achieving the objectives identified in the guidelines have not been defined, namely in case of non-compliance with voluntary agreements. 6. By 30 June 1999, based on the sustainable development of the Commission's work: 6.1. The Minister for the Environment, in consultation with the Ministers of Industry, of Agriculture, Public Works, scientific research, finance, treasury, and foreign trade and foreign affairs, heard the Joint Conference, identifies the criteria and measures to encourage the initiatives to be developed through the mechanisms of "Joint Implementation" and "Clean Development mechanism", and in particular establish: a) the modalities' through which the Italian representatives in the countries Parties to the Kyoto Protocol at the United Nations, and with the multilateral financial institutions, will promote and assist Italian cooperation programs as part of the Kyoto Protocol mechanisms, in particular highlighting the effects of economic and industrial cooperation programs reduction of greenhouse gas emission trends. To this end, the Ministry of Foreign Affairs issues the appropriate directives to the Italian representatives in the signatory countries of the Kyoto Protocol at the United Nations and multilateral financial institutions; b) the measures in favor of enterprises participating in international cooperation programs in the context of the Kyoto Protocol mechanisms, on the basis of voluntary agreements with public administrations; c) the establishment of a secretariat "of the flexible mechanisms of the Kyoto Protocol" with the participation of the Ministry of Environment, the Ministry of Industry, Treasury and Foreign Affairs for the promotion of projects They will still have to be implemented within the framework of voluntary agreements between the administration and businesses. 6.2. The Minister of the Treasury, in consultation with the Ministers of Finance, Environment, Industry, Foreign Trade, in consultation with the Joint Conference, establishes the procedures for trade in emission permits under the mechanism of "Emissions Trading" adopted by the Kyoto Protocol, and sets out the modalities' through which the secretariat referred to in paragraph 5.1. c) certifies transactions of emission permits. 7. By 31 December 1999 the Minister for the Environment, based on the proposals made by the Sustainable Development Commission, will present 'a report to the CIPE and the Joint Conference on the implementation of this resolution. The report, in addition to documenting the status of implementation of the programs and of the measures envisaged, will have to 'indicate, as far as possible, the articulation and the size of the regional scale of the reduction measures.
