The HEAD of the provincial Labour Office of Foggia having regard to the Decree of the President of the Republic April 30, 1970, # 639 and especially the art, as replaced by article 34. 44 of the law 88/1989; Having regard to act March 9, 1989, # 88, and in particular paragraph 3 of art. 46 laying down the rules of litigation services; Having regard to the circular of the Ministry of labour and Social Security Directorate of pension and social assistance, Division III, n. 33/89 of April 19, 1989, they were given instructions regarding the Constitution of the special commissions mentioned in art. 46 on invoked; Having regard to its Decree No. 2/2003 of March 3, 2003, with which it was made the provincial Committee at the headquarters of the I.N.P.S. of Foggia; Considered that it is necessary to appoint four representatives of the category of craftsmen in the Special Committee of the provincial Committee at the headquarters of the I.N.P.S. of Foggia; Given that, according to the third paragraph of art. 35 of the Decree of the President of the Republic April 30, 1970, # 639, the same representatives must be appointed on the nomination of the most representative trade union organizations operating in the province; Considering that, for the correct wording of the judgement on the degree of reliability ' of these organizations have been identified as a precautionary measure the following assessment criteria: 1) number of subjects represented by unions;
2) attendance at training and conclusion of collective bargaining agreements;
3) participation in the discussion of individual and collective labour disputes multiple at Foggia D.P.L.;
4) territorial and sectorial distribution of organisational structures and amplitude and on the provincial plan;
5) participation in commissions and committees established at public bodies operating in the province; Given that the results of investigative activities and the resulting comparative evaluations, carried out in the establishment of the provincial Committee I.N.P.S. and complete as of the indicated criteria, are more representative of the following unions: the autonomous Confederation of artisans ' unions (CASA);
Confartigianato-Unione Provinciale artisans of Capitanata (UPAC);
National Crafts Confederation (CNA); Visto l'art. 38 of Decree of the President of the Republic No. 639/1970, which provides for the appointment of representatives, trade unions are required to do within their assigned designations; that if the absence of designations within the prescribed period, the leader of the organisation is replaced D.P.L. defaulting; Whereas as regards confirmation no autonomous unions craftsmen (CASA) reports on this and that, therefore, it is considered to name outgoing Rep; Given the designations made by the competent trade unions;
Decrees: the Special Committee of artisans within the provincial Committee at the headquarters of the I.N.P.S. of Foggia is so composed: Connoisseur Antonio-President-representative of self-employed craftsmen INPS, within the Committee;
Hisham Palace-Director of the provincial Labour Office of Foggia;
Bruno zanin-Regent ad interim provincial director of local accounting function of the State;
GANAPATHY Francis-Director of the provincial Office of the. N.P.S.; representing employed persons by category: unions styling: R Karl Anton, (home);
Sahib Giovanni, Confartigianato (UPAC);
Fat Gal Rino, Confartigianato (UPAC);
Infants Romeo, (CNA). The Special Committee, composed as above, pursuant to paragraph 3 of art. March 9, 1986 Law 46, # 88 and in accordance with art. 1 of the Decree of the President of the Republic April 30, 1970, # 639, will serve until the expiration of the provincial Committee. This Decree is enforced immediately pursuant to art. 5, paragraph 1, of Decree-Law January 17, 1994, # 33, ex last paragraph of art. 35 of the Decree of the President of the Republic # 639/1970. The head of the provincial headquarters of the I.N.P.S. of Foggia is responsible for implementation of the measure. Against this decree it's feasible appeal to the TAR Puglia within the deadlines and with the terms provided by law by anyone who is interested. This Decree will be published in the official journal of the Italian Republic and in the Bulletin of the Ministry of labour and social policy.
