The GOVERNMENT COMMISSIONER having regard to the order of the President of the Council of Ministers # 2409 of June 28, 1995, by which the President of the region and was appointed, in accordance with art. 5 February 24, 1992, law No. 225, Commissario governativo per l'emergenza idrica in Sardegna;
Having regard to the order of the President of the Council of Ministers No. 2424 of February 24, 1996, which amendments have been made to that Ordinance No. 2409 of June 28, 1995;
View the Ordinance of the Minister of Home Affairs-civil protection delegate # 3196 of April 12, 2002-articles 13 and 14;
Having regard to the order of the President of the Council of Ministers No. 3243 of September 29, 2002, with which they were conferred additional powers to the Government Commissioner;
Having regard to the Decree of the President of the Council of Ministers of January 29, 2004, whereby it was extended a State of emergency in Sardinia until the date of December 31, 2004;
Having regard to the orders of n. 25 of December 31, 1995, n. 42 of May 20, 1996, # 52 of August 9, 1996, # 111 of November 17, 1998, n. 128 of December 28, 1998, # 148 of July 16, 1999, # 152, July 26, 1999, n. 171 of November 11, 1999, # 255 of October 23, 2001, n. 268 of October 24, 2001, # 296 of June 19, 2002, # 299 of June 27, 2002, # 304 of July 11, 2002, 305 of July 11, 2002, n. # 307 of July 15, 2002, # 337 of December 31, 2002 and # 246 of March 20, 2003, which have been spotted commissarial interventions to overcome water crisis in Sardinia;
Having regard to the order of the Presidency of the Council of Ministers No. 2443 of which May 30, 1996, notwithstanding the current regulations, the Cassa depositi e prestiti and was authorized to grant loans up to a maximum of 300 billion to the autonomous region of Sardinia or its entities as foster instrumental assistance, with guarantee of the region, at the request of the Government Commissioner for the water crisis in Sardinia for the implementation of interventions intended to face her and whose line of funding was initially scheduled on private funds;
Having regard to regional law No 12 April 2, 1997 authorising the regional administration and the contraction of loans with deposits and loans Fund for the construction of infrastructure and plant planned by the Government Commissioner for the water crisis in Sardinia;
Having regard to regional law No 11 April 15, 1998 which provides, among other things, the possibility of contracting the loans provided for in regional law 12/1997 with other credit and financial institutions, and warrants, while the contraction of loans themselves, using the specific regional budget allocation-1998, Council for forecasting exercise of public works-chapter 08173-00;
Since by order No. 148 of July 16, 1999, it was included among the works of the commissarial program, with financing funds referred to in chapter 08173-00 of the regional budget-financial year 1998, completing the Central Western aqueduct-schema "# 12 I fear" for the total amount of 1,549,370.70 Euros ($ 3 billion);
Since that order No. 148 of July 16, 1999 identified the regional Department of public works as a Director of the intervention in argument and the E.S.A.F. which body actuator, and has also qualified these authorities what structures commissarial pursuant to and for the purposes of the Ordinance # 2409/1995, art. 5;
Since that order # 148/1999 has also predicted that the Government Commissioner provide, at special funds referred to Treasury accounting 1690/3, to pay the first instalment, equal to 25% of the amount of individual planned interventions based on mutual Cassa depositi e prestiti, the immediate benefit of institutions for actuators, by way of replenishment of sums paid by the regional Department of public works to the Consortium for the aqueduct on the Rio Govossai for the intervention Community Programme INTERREG IIC;
Since the regional Department of public works, has delegated to it. S.a.f., with determination of the Director-General n. 713/1999, the implementation of the work;
Since by order # 268 of October 24, 2001, as a result of the assignment to the E.S.A.F. additional financial resources to complete this action: completion of the Central-Western aqueduct-diagram no. 12 I'm afraid "and was intended to replace, the action adjustment of potable water treatment plant for the water supply of the towns of the West-Central Sardinia in derivation of Fear ';

Considered as a result of having to provide, in relation to the approval and intervened. Project «opera adaptation of s.a. F potable water treatment plant for the water supply of the towns of the West-Central Sardinia in derivation of Fear "for the total amount of Euro 1,549,370.00, to pay for E.S.A.F. of 387,342.67 Euro equal to 25% of the amount of assistance;
# 81 of the commissarial Ordinances views July 12, 1997 and no. 154 of July 30, 1999, in which the Coordinator of the Office of the Commissioner, pursuant to art. 2 of Ordinance # 2409/1995, he was appointed Sub-Government Commissioner for the books and for the implementation of programming Commissioner;
Expected therefore that the enactment of this act falls within the governmental functions delegated to Sub-Commissioner with the Ordinances mentioned commissarial;
Order: Art. 1.1. For the purposes of this Ordinance is the acknowledgement of the competent approval bodies intervened and. 2. With the Act of determining that immediately follows this Ordinance will pay for E.S.A.F. the sum of Euro 387,342.67.
3. unless expressly provided in this Ordinance, will draw upon the provisions of Ordinance No 148 of July 16, 1999 and the Ordinance # 268 of October 24, 2001.
It is compulsory to anyone it is to observe and enforce this Ordinance.
This Ordinance is immediately enforceable and is published in the official journal of the Italian Republic, in accordance with art. February 24, 1992, 5, of law No. 225, and in the Official Gazette of the region of Sardinia, part II.
