The MINISTER of agriculture and forestry having regard to act June 18, 1931, no. 987, containing provisions for the protection of crops and agricultural products by the enemy and causes its services as amended; Having regard to regulation for the application of that law, approved by Royal Decree October 12, 1933, # 1700, as amended by Royal Decree, December 2, 1937 # 2504; Having regard to Council Directive 2000/29/EEC No EC, May 8, 2000 as amended, on protective measures against the introduction into the community of organisms harmful to plants or plant products and against their spread within the community; Having regard to Legislative Decree No 536 December 30, 1992, concerning the implementation of Council Directive No. December 19, 1991 91/683/EEC on protective measures against the introduction into the Member States of organisms harmful to plants and plant products; Having regard to the Ministerial Decree of January 31, 1996, published in the ordinary Supplement No. 33 the Official Gazette No. 41 of February 19, 1996, on protective measures against the introduction into and the spread within the territory of the Italian Republic of organisms harmful to plants or plant products and subsequent modifications; Having regard to the Ministerial Decree of March 6, 1996, which incorporates the Commission directives no 95/65/EC and no 95/66/EC of December 14, 1995, concerning amendments to the annexes of the Ministerial Decree of January 31, 1996 concerning protective measures against the introduction into and the spread within the territory of the Italian Republic of organisms harmful to plants and plant products; Having regard to the Ministerial Decree of February 19, 1997, transposing Directive No. 96/78/EC of December 6, 1996 concerning amendments to the annexes of the Ministerial Decree of January 31, 1996 concerning protective measures against the introduction into and the spread within the territory of the Italian Republic of organisms harmful to plants and plant products; Having regard to the ministerial order of November 27, 1997 transposing directives no. 96/14/EC of March 12, 1996, n. 96/15/EC of March 14, 1996, no. 96/76/EC of November 29, 1996 and # 97/14/EC of March 21, 1997 amending certain annexes to Directive No. 77/93/EEC and Directive 92/76/EEC recognising protected zones exposed to particular plant health risks in the community; Having regard to the Ministerial Decree of February 13, 1998, transposing Directive No. 97/46/EC of July 25, 1997 amending Directive 95/44/EC laying down the conditions under which certain harmful organisms, plants, plant products and other objects listed in annexes I, II, III, IV and V to Directive No. 77/93/EEC may be introduced or transferred from one place to another in the community or certain protected zones thereof for trial or scientific purposes and for work on varietal selections; Having regard to the Ministerial Decree of July 9, 1998 transposing the directives # 98/1/EC and no 98/2/EC of January 8, 1998 amending certain annexes to Council Directive 77/93/EEC on protective measures against the introduction into and the spread within the community of organisms harmful to plants and plant products; Having regard to the Ministerial Decree of October 19, 1998 transposing Directive 98/22/EC Commission of April 15, 1998 setting out the minimum requirements for carrying out of plant health checks in the community, at inspection posts other than those at the place of destination, of plants, plant products and other objects coming from third countries; Having regard to the Ministerial Decree of July 8, 1999 transposing Directive No. 1999/53/EC of May 26, 1999 amending Annex III to Directive 77/93/EEC n. on protective measures against the introduction into the community of organisms harmful to plants and plant products; Having regard to the Ministerial Decree of August 4, 2001 amending annexes to the Ministerial Decree of January 31, 1996 concerning protective measures against the introduction into and the spread within the territory of the Italian Republic of organisms harmful to plants or plant products: Commission directives 2001/32/EC and no 2001/33/EC of May 8, 2001 amending certain annexes. 2000/29/EC. Having regard to the ministerial order of September 22, 2003 amending annexes to the Decree January 31, 1996 concerning protective measures against the introduction into and the spread within the territory of the Italian Republic of organisms harmful to plants or plant products: Commission directives 2003/46/EC and 2003/47/EC of June 4, 2003 amending certain annexes to Council Directive 2000/29/EC; Having regard to the Ministerial Decree of March 31, 2004 amending annexes to the Decree January 31, 1996 concerning protective measures against the introduction into and the spread within the territory of the Italian Republic of organisms harmful to plants or plant products: transposition of Commission Directive No 2003/116/EC of December 4, 2003 amending certain annexes to Council Directive 2000/29/EC; Having regard to the Ministerial Decree of July 20, 2004 amending annexes to the Ministerial Decree of January 31, 1996 concerning protective measures against the introduction into and the spread within the territory of the Italian Republic of organisms harmful to plants or plant products: transposition of Commission Directive No 2004/31/EC of March 17, 2004 amending certain annexes to Council Directive 2000/29/EC and Commission Directive 2004/32/EC of March 17, 2004 on the amendment to Directive 2001/32/EC as regards certain protected zones exposed to particular plant health risks in the community; Having regard to Directive 2004/105/EC of October 15, 2004 determining the models of official phytosanitary certificates or phytosanitary certificates for re-export accompanying plants, plant products or other objects from third countries and listed in Council Directive 2000/29/EC; Given the need to transpose Commission directive above;
Decrees:

Art. 1. The national plant protection service, referred to in Legislative Decree December 30, 1992, n. 536, accepts the ' official ' phytosanitary certificates or phytosanitary certificates for re-export ', ' referred to in articles 37 and 38 of the Ministerial Decree of January 31, 1996, accompanying plants, plant products or other objects listed in annex V, part B, of the Ministerial Decree of January 31, 1996, coming from third countries which are Contracting Parties to the International Plant Protection Convention (IPPC) only if they comply with the models set out in annex I and if are completed according to international standard for phytosanitary measures No 12 of FAO related guidelines for phytosanitary certificates.
