THE MINISTERIAL COMMITTEE FOR ECONOMIC PLANNING Having regard to Law 21 December 2001 n. 443 (so-called 'target law'), which, in Article. 1, has determined that the public and private infrastructure and strategic installations and major national interest, to be carried out for the modernization and development of the country, they are identified by the government through a program formulated according to the criteria and procedural directions contained in that Article delegating to this Committee to approve, in the first application of the law, that program by 31 December 2001; Having regard to Act 1 August 2002, n. 166, which, in art. 13, in addition to bear changes to the mentioned art. 1 of Law no. 443/2001 and to authorize commitment in fifteen-limits for the design and construction of the works included in the program approved by this Committee, provides, in particular, that the operations are included in the general framework agreements between the government and each region or Province autonomously, in order of the joint coordination and execution of works; Having regard to Legislative Decree 20 August 2002, n. 190, implementing art. 1 of the mentioned law n. 443/2001; Visas, in particular, Article. 1 of Law no. 443/2001, as amended by art. 13 of Law no. 166/2002 and Article. 2 of Legislative Decree n. 190/2002, which attribute the responsibility 'of the investigation and the function of support to the activities' of this Committee to the Ministry of Infrastructure and Transport, which can' in this regard to make use of a special "mission technical structure"; In view of art. 4 of Law 24 December 2003 n. 350, and having regard in particular to paragraphs 134 and following, under which the allocation of resources required to this Committee, for strategic infrastructure projects that have a potential economic return from operations and are not included in the financial plans of the concessionaires and in future additional documents, it must be accompanied by a cost-benefit analysis and a business plan prepared in the format type approved by this Committee; Having regard to Legislative Decree 17 August 2005, n. 189, which makes changes and additions to the said decree 20 August 2002, n. 190; Resolution views December 21, 2001, n. 121 (Official Gazette no. 51/2002 SO), with which this Committee, under the most 'sometimes called art. 1 of Law no. 443/2001, has approved the 1st program of strategic works, which reports Annex 1, under the heading 'port Hub', the intervention "Trieste logistics platform" for which he indicates a total cost of 414.198 Meuro; Given the resolution July 25, 2003, n. 63 (Official Gazette no. 248/2003), with which this Committee approved the "Unified project sheet" which shall accompany the investigation report prepared by the Ministry of Infrastructure and Transport as well 'has made indications of a procedural nature concerning the attivita 'of support that the Ministry of infrastructure and transport, and' called upon to play in the supervision on the implementation of the interventions included in the 1st strategic infrastructure program; Given the decision May 27, 2004, n. 11, with which this Committee approved the scheme type of business plan pursuant to the mentioned art. 4, paragraph 140, of Law no. 350/2003, providing that as a rule - in support of the request for funding from the resources to art. 13 of Law no. 166/2002 - to be submitted to the synthetic plan, but explaining that this same Committee, during the investigation, may 'require the submission of a complete plan; Given the resolution December 20, 2004, n. 99 (Official Gazette no. 148/2005), with which the Committee approved, with prescriptions and recommendations, the preliminary draft of the "Hub port of Trieste - logistics platform between the airport timber and mineral oils free point", noting that the award of the work would be provided by concession or use of the figure of the general contractor; Note view October 18, 2005, n. 458, with which the Ministry of Infrastructure and Transport has submitted the report on the investigation's preliminary draft modified and integrated with the financial plan for the concession tender regarding the implementation, as part of Trieste port hub, the "logistics platform between the timbers airport and the free mineral oils', thereby representing the changes of the same project compared to the drafting approved by this Committee with resolution no. 99/2004 and proposing the partial financing intervention in via programmatic, out of resources provided for in the Finance Bill 2006 to refinance art. 13 of Law no. 166/2002; Note view 14 November 2005, n. 533, with which the Ministry of Development sent the former boards Resolution no. 63/2003 and the economic-financial intervention plan; As this Committee has given programmatic reported to the financial framework in Annex 1 of Resolution no. 121/2001, subject to subsequent to the recognition of the different sources of funding available for each intervention; Having heard the report of the Minister of Infrastructure and Transport; Acquired in session the agreement of the Minister of Economy and Finance; Notes 1) the findings of the investigation carried out by the Ministry of Infrastructure and Transport, in particular: under the technical and procedural aspects: the update of the preliminary draft of the logistics platform is submitted to this Committee in order to proceed to the award in concession the final design, the reclamation of the site, the construction and management of the work, as shown by the decision of the Authority 'Trieste port n. 281 of 7 September 2005; that the Ministry instructor confirms the strategic importance of the work itself, which arises in implementing the project function "motorways of the sea" - added to the list of priority projects under the trans-European transport network - and that is an opportunity to strengthen Corridor 5, the development of which would allow to enhance the localization of Italy in the Mediterranean; that the aforementioned Ministry confirms the general design approach already 'approved, which recovers the use port a total area of ​​250,000 square meters, of which 140,000 made from areas currently occupied by sea by artificial adjustment of the line of the existing costs and realization of a platform of marine sediment, which includes - among other things - the creation of new road and rail connections, the construction of the quay crane and a new berth for Ro-Ro ships, possibly doubled; that, in the perspective indicated in the introduction, the preliminary draft approved by this Committee by resolution no. 99/2004 and 'been reworked according to a process of deepening and optimization of the technical aspects of transport terms and of the port of Trieste development strategies; which were considered in particular the evolution of the traffic on a time horizon to 2020, to identify the steps needed for the application of an air traffic potential, and favorable consequent repercussions to the involvement of private capital in the construction and then the management work in order to ensure cost-shared a private dealer and simultaneously to mitigate the business risks for the Authority 'port; that major changes and additions made to the project include: the provision of an office building 2,250 square meters total profits on five levels, with ample parking and the implementation of which assumes strategic importance because 'allows the best operability' to the dealership and makes space available to rent to customers who choose to transfer part of its activities' in the port of Trieste; the variation in the intermodal yard destination with the forecast of a storage area for vehicles 50,000 square meters and an area of ​​90,000 square meters for parking trucks; the conversion of one of the two in the refrigerator warehouse deposits positioned differently and not more 'served by railway siding, place which perishable food products are traditionally transported on rubber; the reduction of port cranes from 10 to 2 with gauge suitably expanded; that the entire area affected by the construction of the platform and 'owned' state property and not 'affected by occupations under multiannual formal acts; that the Authority 'port of Trieste, awarding authority, sent to the Ministry of Infrastructure and Transport with known 20 July 2005 prot. n. 0009060 the revised preliminary draft and integrated with the financial plan for the concession, requiring the approval of the relevant bodies; that the Ministry of Infrastructure and Transport is not proposing here for additional requirements and recommendations to be formulated, basically confirming previous and particularly stressing that - being the port of Trieste included among the polluted sites of national interest and bounded by decree of the Minister of Environment and Protection of Natural Resources on February 24, 2003 - the awarding authority, at the final draft is submitted , we must 'have carried out investigations and analyzes provided by the "environmental characterization plan' and have been approved by the said Ministry, of its environmental remediation project; under the implementation aspect: that the contracting party under the Legislative Decree n. 190/2002 and 'confirmed in authority' port of Trieste; that, by dissolving the original alternative, it is expected - as stated above - the award of the work by the concession; it is expected that the logistics platform is made of five years of starting its work, and it is assumed that a duration of the preliminary stages of the opening of the 24-month construction sites; that that timetable must 'be made compatible, if necessary, with the times and procedures of the aforementioned environmental remediation; that the project in question and 'was awarded the CUP C21B0300060001, to highlight the administrative and accounting documents concerning the operation referred to in this resolution; under the financial aspect: the financial cost of the examination, according to the economic framework set out in the report investigation, amounted to EUR 278 898 625 of which 239 081 000 for work-based auction and 39,817,625 Euros for amounts available; that the overall increase compared to the approved project cost with resolution no. 99/2004, amounting to EUR 6,898,625, and 'resulting from the increase of the amount of work to 10,475,000 euro and the amounts available for 1,623,625 Euros, and a simultaneous reduction of VAT for 5,200,000 Euros due to the lower number of cranes to be purchased; that between the cost items on the rise are of particular importance the amounts destined to the realization of the store, to effect transformation of the detected one of them for cold storage and the increase of the useful area of ​​both the maritime and road works, for effect the demolition of existing shacks, and environmental remediation; that, as regards the last aspect considered preceding paragraph, the Authority 'port, by note of 22 September 2005. 11272, has - among other things - sent to the Ministry instructor a descriptive report of remediation, the cost of which is to rise from 14 million euro to 40 million euro, specifying that the original preliminary draft had been drawn up before the ' entry into force of the decree of the Minister for the environment, which established the polluted site of national interest "Trieste" and that the new value and 'was obtained from characterization plans carried out in neighboring areas and experiences gained after the resolution no. 99/2004; and in relation to economic conditions as above redefined, the awarding authority, in the aforementioned resolution of 7 September 2005 n. 281, has allocated resources to the work in question arising out of loans with a cost to the State - pursuant to art. 9 of Law no. 413/1998, as refinanced art. 54 of the Law of 23 December 1999, n. 488, and art. 144 of the Law of 23 December 2000, n. 388 - for € 2,000,000 and obtainable resources from loans to be contracted, always with a cost to the State, pursuant to art. 36 of Law no. 166/2002, for 44.8 million euro; - exactly as specified in the aforementioned resolution of the awarding authority - the sources of private funding, resulting from sharing assumptions of the subject that will be 'identified by the concession tender, they are estimated at 27,098,630 Euros, so to ensure complete coverage financial intervention would be necessary integration borne by the "objective law" of 205 million euro; that the business plan submitted in support of the preliminary report, shows a design initiative economic internal rate of return equal to 7.43% and a net present value of project-3,611 K €; that the Ministry of Infrastructure and Transport proposes programmatic allocation of 205 million euro from the funds earmarked for the implementation of the 1st program of strategic works; 2) the outcome of the debate in today's session and in particular: it is agreed whether ', already' emerged in the preparatory meeting, not to proceed with programmatic allocations to assert its lending earmarked for the implementation of the 1st Infrastructure Program strategic before the related resources are made available by the Finance Act 2006 under approval and then to examine the request for funding after that approval, even in light of the outcomes of the evaluation of the business plan at the time examination unit 'technical-Finance project; that the Minister of Infrastructure and Transport is proposed to approve the preliminary draft Meanwhile, as amended and supplemented above, in technical innovation; Resolution: 1. Approval of amended preliminary draft. 1.1. Pursuant to and by effect of art. 3 of Legislative Decree n. 190/2002 and 'it approved the preliminary draft of the modified' 'port Hub Trieste - logistics platform between the timber yard and the entrepot mineral oils. " Are confirmed with the provisions and recommendations contained in the annex to decision 20 December 2004, n. 99, which 'intended conditioned this approval as well as' other effects and provisions contained in the same resolution. 1.2. Pursuant to Art. 3, paragraph 3, of Legislative Decree n. 190/2002 the amount of EUR 278 898 625, in the above acknowledgment, constitutes the new expenditure limit. 2. Final clauses. 2.1. The Ministry of Infrastructure and Transportation will provide 'to ensure, on behalf of this Committee, the preservation of documents in the preliminary draft approved by this resolution. 2.2. The said Ministry will provide 'to ensure that the final design will acknowledge the requirements which must be addressed in this planning stage and taking into account, as regards the economic situation, also of the comments made by the Board of Public Works in the examination of the previous version. The awarding authority will verify 'that, in the later stages to approval of the final project, the implementation of any other requirements set out in that Annex, giving assurance to the Ministry of Infrastructure and Transport. 2.3. The mentioned ministry will provide 'to carry out the activities' support designed to allow this Committee to carry out the duties of monitoring the implementation of the works assigned to it by the abovementioned legislation in the introduction, taking into account the information referred to resolution no. 63/2003 referred to above.
