The Director-General of the autonomous administration of State monopolies in consultation with the HEAD of the DEPARTMENT of development policies of the Ministry of agricultural food and forestry policies having regard to Legislative Decree No 496 April 14, 1948, and subsequent modifications and additions concerning the regulation of gaming activity; Having regard to the Decree of the President of the Republic of April 18, 1951, n. 581, establishing regulations for the application and enforcement of Legislative Decree No 496 April 14, 1948, on the regulation of gaming activity; Having regard to the Legislative Decree July 30, 1999, # 300, as amended, regarding reform of the Government; Having regard to the Legislative Decree March 30, 2001, n. 165; Visto l'art. 12, paragraph 2, of law October 18, 2001, # 383, which ruled that the Minister of Finance shall, by Decree, the Ante circle of participation in betting, betting games and contests; Having regard to the Decree of the President of the Republic January 24, 2002, n. 33, issued pursuant to art. 12 October 18, 2001, law No. 383, which he attributed to the autonomous administration of State monopolies managing state functions relating to the organisation and management of the games, betting and betting competitions; Having regard to the Legislative Decree July 3, 2003, n. 173; Having regard to Regulation enacted by Decree of the President of the Republic April 8, 1998, # 169, with whom he completed the reorganization of the field of gaming and betting related to horse races in relation to organizational, functional, and tax penalties, as well as the apportionment of its proceeds; Having regard, in particular, article. 4, paragraph 5, of that regulation that defers to the decrees of the Minister of economy and finance, in consultation with the Minister of agriculture and forestry, also on the proposal of MERGING the determination of types of bets can be made on horse races, its rules of conduct and limits placed on bets; Seen the Decree interdirettoriale of the Director-General of the autonomous administration of State monopolies and the head of Department of quality food products and services of the Ministry of agriculture and forestry of April 3, 2003, which, inter alia, extended to the betting companies the chance to market sports-based predictions and competitions other games related to sports events , pursuant to art. 22, paragraphs 10 and 16 of law December 27, 2002, n. 289; Visto l'art. 1, paragraph 498 of December 30, 2004, # 311, which included the establishment, by decision of the Ministry of economy and finance-conducting autonomous administration of State monopolies, heard the Ministry of agriculture and forestry-quality Department of agri-food products and services, to a new bet horse racing in Tote, proposed by UNITE. With the said instrument shall be laid down provisions for the implementation for the new bet horse racing, to be carried out in networks of outlets of sports betting, betting outlets and competitions as well as racecourses, considering that the collection should be divided by 72 per cent as prize money and reward for the management activities of the bet, the 8 percent as compensation point of sales activities 6 percent, as revenue in the form of single tax levy and 14 per cent as levy in favour of UNITE; Having regard to the Decree of the Director-General of the autonomous administration of State monopolies, in consultation with the head of the Department of development policies of the Ministry of agriculture and forestry of December 15, 2005, issued in implementation of article. 1, paragraph 498 of the law December 30, 2004, n. 311, which introduced a new bet horse racing totalizator betting formulas and more articulated that predicted that the bet «Trio», from the natural expiration of its franchise agreement, December 31, 2005 mounted, it is subject, on an experimental and temporary, discipline pursuant to art. 1, paragraph 498, December 30, 2004, law n. 311, configured as a totalizer betting horse racing formula referred to in paragraph 498; Having regard to the Decree of the Director-General of the autonomous administration of State monopolies of December 20, 2005, which approved the regulations governing formula of the new equestrian totalizer betting technique called ' New Kind '; Having regard to the licences for the exercise of sports-based predictions and competitions of any other games related to sports events, concluded with the dealers referred to selection list advertised with the press release of the Ministry of economy and finance published in the Gazzetta Ufficiale-serie generale-# 136 of June 14, 2003; Visto l'art. 38 of Decree-Law July 4, 2006, converted, with amendments, and supplemented by law No 248 August 4, 2006; Considering that the outcome of the public selection procedures under art. 38, paragraphs 2 and 4 of the Decree-Law July 4, 2006, converted, with amendments and additions, the law August 4, 2006, # 248, concession agreements have been entered into public games, involving, among others, with effect from 1 July 2007, the formulas of the bet horse racing in Tote under art. 1, paragraph 498 of the law December 30, 2004, # 311, called horse racing; Considering that the formulas of bet horse racing in Tote under art. 1, paragraph 498 of December 30, 2004, # 311, are distributed in accordance with the directorial decrees June 26, 2007 and September 7, 2007, until 31 December 2007, through retail outlets, betting agencies and linked to dealers to carry racecourses competitions sport-based predictions, as well as any other games related to sports events, whose licences have expired on June 30, 2007; Given that the aforementioned betting formulas under art. 1, paragraph 498 of the law December 30, 2004, # 311, are distributed, since 1 July 2007, by the dealers identified as a result of public selection procedures under art. 38, paragraphs 2 and 4 of the Decree-Law July 4, 2006, converted, with amendments and additions, the law August 4, 2006, # 248; Considered that the dealers identified as a result of public selection procedures under art. 38, paragraphs 2 and 4 of the Decree-Law July 4, 2006, converted, with amendments and additions, the law August 4, 2006, # 248, have perfected during the year 2007, the conclusion of its franchise agreements and that the activation of the respective sales networks will be implemented gradually, depending on the speed of completion, by each dealer, the numerous preparatory activities at start of outlets and it still is the eighteen-month period for its complete activation; Considering that, pursuant to art. 38, paragraph 2, point l) and art. 38, paragraph 4, letter l) of Decree-Law July 4, 2006, converted, with amendments and additions, the law August 4, 2006, n. 248, new methods of distribution of the game are defined by ensuring the protection of the licensees of fixed odds betting on events other than horse races governed by Regulation pursuant to Decree of the Minister of economy and finance 1° March 2006, # 111, as well as the dealers of collecting bets governed by regulation referred to the Decree of the President of the Republic April 8, 1998 , # 169; Given the opportunity, in the prevailing public interest in maintaining the current level of revenue revenue derived from the collection of the bet horse racing under art. 1, paragraph 498 of the law December 30, 2004, # 311, by dealers under art. 38, paragraph 2, point l) and art. 38, paragraph 4, letter l) of Decree-Law July 4, 2006, converted, with amendments and additions, the law August 4, 2006 # 248;
Features: Art. 1.1. With effect from 1 January 2008, the dealers under art. 38, paragraph 2, point l) and art. 38, paragraph 4, letter l) of Decree-Law July 4, 2006, converted, with amendments and additions, the law August 4, 2006, # 248, their right to exercise the collection of the bet horse racing totalizator foreseen by art. 1, paragraph 498 of the law December 30, 2004, # 311, through liaison with dealer outlets as public selection procedures established by art. 38, paragraphs 2 and 4 of the same decree-law. 2. the cash flows of the new bet horse racing totalizator pursuant to subsection 1, shall be governed by the Decree of the Director-General of the autonomous administration of State monopolies of June 18, 2007 and were adopted in the communication protocol RDP, approved by Decree of the General Director of the autonomous administration of State monopolies of May 2, 2007.
