The GENERAL MANAGER of food safety and nutrition Saw art. 6 of the law No 283, April 30, 1962 amended by art. 4 February 26, 1963, law No. 441; Having regard to the Legislative Decree March 17, 1995, n. 194, concerning the implementation of Directive 91/414/EEC concerning the placing of plant protection products; Having regard to the Legislative Decree March 30, 2001, # 165, laying down general rules on the sort of labour employed by public administrations; Having regard to the Decree of the President of the Republic April 23, 2001, no. 290 on the regulation for the simplification of the procedures for authorising the production, marketing and sales of plant protection products and adjuvants; Given the managerial Decree of February 21, 2005 suspension of the marketing authorisations and the use of all plant protection products containing the active substance carbendazim «»; Having regard to Commission Directive 2006/135/EC of December 11, 2006 on the «carbendazim as active substance in annex I to Directive 91/414 '/EC; View, in particular, the part A of the annex to that directive, which identifies the uses of the active substance «carbendazim» judged under the conditions laid down in accordance with art. 5, paragraph 1, letter a) and b) of Directive 91/414/EC; Found that plant protection products set out in the annex to this Decree are currently allowed only for uses other than those set out in Part A of the annex to that directive to ' active substance carbendazim»; Was therefore considered of having to proceed with the withdrawal of plant protection products containing the active substance carbendazim «», set out in the annex; Given that-having the aforementioned Decree February 21, 2005 granted to undertakings enjoying a period of ninety days to provide for withdrawal of stocks then lying on the market-there are currently on the market packages of such products; Visto l'art. 23 of Legislative Decree No 194 March 17, 1995 laying down penalties for any person who places on the market and use of plant protection products and the subsequent reform of penalty system rules;
Decrees: Art. 1.1. The authorisations for plant protection products containing the active substance CARBENDAZIM, listed in the annex, shall not be withdrawn from the date of this Decree as granted exclusively for crops other than those listed in Part A of the annex to that Directive 2006/135/EC membership. This Decree will be notified administratively to the undertakings concerned and will be published in the official journal of the Italian Republic.
