The DIRECTOR GENERAL of human resources and of professions having regard to Directive 2005/36/EC of the European Parliament and of the Council of September 7, 2005 on the recognition of professional qualifications as well as amended by Directive 2006/100 EC of November 20, 2006; Having regard to the Legislative Decree November 9, 2007, # 206, implementing Directive 2005/36/EC; Visto l'art. 16, paragraph 5, of the aforementioned legislative decree n. 206 of November 9, 2007, which stipulates that the provisions referred to in paragraph 3 of this article shall not apply if the application for recognition has as its object the titles are identical with those for which it was provided with previous decree and in the cases referred to in chapter IV, sections I, II, III , IV, V, VI, and VII of the said Decree; Having regard in particular to articles 31, 32, 35, 43 and 45 of chapter IV of the mentioned Legislative Decree concerning "recognition on the basis of coordination of minimum training conditions '; Having regard to the request of March 7, 2010, together with relevant documentation, with which Mr. Oliver Lotter, born in Albstadt-Ebingen (Germany) on September 14, 1973, of German nationality, asked this Ministry recognition of title "Zeugnis über die Ärztliche Prüfung" released on May 11, 1999 the Regierungspräsidium Stuttgart-Germany-at the end of the year, in Italy, of the medical profession; Ensured completeness and regularity of the documents submitted by the person concerned; Ascertained the existence of legal requirements for the automatic recognition of the title in question on the basis of coordination of the minimum training conditions referred to in Legislative Decree n. 206 of November 9, 2007; Having regard to the Legislative Decree March 30, 2001, n. 165 as amended;
Decrees: Art. 1 from the date of this Decree, the title "Zeugnis über die Ärztliche Prüfung" awarded by the Regierungspräsidium Stuttgart-Germany-May 11, 1999 to Mr. Oliver Lotter, born in Albstadt-Ebingen (Germany) on September 14, 1973, of German nationality, is recognized as an enabling title to the exercise of the profession of doctor in Italy.
