The MINISTER of labour and social policy having regard to the Decree of the President of the Republic June 30, 1973, # 478, Constitution of the Institute for the development of vocational training of workers (ISFOL) and subsequent amendments; Having regard to the Legislative Decree of October 29, 1999, n. 419, bearing the «Reordering of national public bodies in accordance with articles 11 and 14 of the law March 15, 1997, # 59» and, in particular, article. 10, which includes the aforementioned Institute between research institutes; Having regard to the Decree of the President of the Council of Ministers November 23, 2007 laying down ' Definition of relations of the Ministry of labour and social security and of social solidarity, relating to the Institute for the development of vocational training of workers (ISFOL), work Italy s.p.a. and the Italian Institute of social medicine (IIMS) ' and, in particular, article 1, paragraph 1; Having regard to the Decree-Law May 31, 2010, n. 78 laying down "urgent measures concerning economic competitiveness and financial stabilization», signed into law July 30, 2010, n. 122 and, in particular, article. 7, paragraph 15; See, also, article. 6, paragraph 3, of this Decree-Law May 31, 2010, # 78, concerning administrative apparatus "cost reduction"; Having regard to the Decree of the President of the Council of Ministers ' approval of the new statute laying down of January 11, 2011 Institute for the development of vocational training of workers (ISFOL)», published in the Gazzetta Ufficiale della Repubblica Italiana n. 77, April 4, 2011; See, in particular, article. 6, paragraph 1, of the Statute, which provides that the President of ISFOL Institute is appointed by Decree of the President of the Council of Ministers, after deliberation by the Council of Ministers, on a proposal of the Minister of labour and Social Affairs, after consultation with the parliamentary committees; See, also, article. 7, paragraph 2, of the aforementioned Statute ISFOL, which provides, inter alia, that the members of the Board of Directors shall be appointed by Decree of the Minister of labour and Social Affairs, two of which are designated by the Minister of labour and Social Affairs, two by the Conference of Presidents of the regions from the regional departments competent in matters covered by the Institute's activities , and one appointed by the Minister for education, University and research; See also art. 9, paragraph 2, of the aforementioned Statute ISFOL, which provides, inter alia, that the Board of Auditors of the Institute is appointed by the Minister of labour and Social Affairs and consists of a Chairman appointed by the Minister of economy and finance and by two members, appointed by the Minister of labour and social policy and the Joint Conference of legislative decree 281 of 1997 as well as by an alternate designated by the Minister of labour and social policy, which is not paid any fee and who takes over the functions in the event of death, resignation or disqualification of the Auditors; See, also, article. 16, paragraph 1, of the aforementioned Statute ISFOL, which provides that the President, the Board of Directors, the Board of Auditors in Office on the date of entry into force of the new staff regulations, shall expire with the appointment of new bodies, which shall be within the following sixty days and during that period, perform the functions of course; Having regard to the Decree-Law May 16, 1994, # 293, establishing a "Discipline of the extension of administrative bodies», converted with amendments by law no 444 July 15, 1994, and in particular, art. 3, which provides that administrative bodies not recovered within the time limit of their duration shall be extended for not more than 45 days from the day of expiry of the term thereof and that, during the period when they are extended, expired organs may take, on pain of nullity, only acts of ordinary administration as well as urgent and unavoidable acts with specific indication of the reasons of urgency and indifferibilita '; Considered that, having regard to the provisions of art. 16 of the Statute of ISFOL and further extension period, referred to in Decree-Law May 16, 1994, # 293, the President, the Board of Directors, the Board of Auditors ISFOL, in Office on the date of entry into force of the Statute, shall expire with effect from July 18, 2011; Considered also, which to date has not completed the procedure for the appointment of new bodies ISFOL, also due to the fact that it's being the approval of the appointment of the new President and not d.p.c.m. still received the designation of competence respectively of the Conference of Presidents of regions and autonomous provinces and the Joint Conference of legislative decree 281/1997; Considered, therefore, pending the reconstitution procedure of new organs, having to proceed to the appointment of a special Commissioner in order to ensure the continuation of the activity of ISFOL and the good performance of the administrative action and ensure the ordinary and extraordinary administration; Decrees:

Art. 1 1. Dr. Sergio Trevisanato is appointed extraordinary Commissioner of the Institute for the development of vocational training of workers (ISFOL), with effect from July 18, 2011 until the date of actual settlement of the new bodies of the Institute appointed under articles 6, paragraph 2, subparagraph 1, 7, and 9, paragraph 2, of the Statute, and in any case not later than December 31, 2011; 2. The Commissioner shall assume the powers already conferred by law and the articles of Association of the ISFOL to the President and to the Board of Directors and is responsible for ensuring the ongoing management and adopt the acts of ordinary and extraordinary administration, necessary and appropriate to ensure the functionality of the Institute and the good performance of administrative action; 3. The Commissioner, in carrying out its functions, should follow these general guidelines formulated by the Ministry of labour and Social Affairs, in accordance with art. 1, paragraph 1, of the Decree of the President of the Council of Ministers November 23, 2007.
