The DIRECTOR-GENERAL of civil justice Viewed the art. the second paragraph 490 of the code of civil procedure, as amended by art. 2, third paragraph, point e) of Decree-Law No 35 of March 14, 2005, converted, with amendments, by law May 14, 2005, n. 80; Visto l'art. 173-ter of the implementing provisions of the code of civil procedure, added by art. 2, section 3-ter of Decree-Law No 35 of March 14, 2005, converted, with amendments, by law May 14, 2005, n. 80, that "the Minister of Justice shall determine by Decree the websites intended for placement of notices under art. 490 of the code and the criteria and methods by which they are trained and made available '; Visto l'art. 159 of the implementing provisions of the code of civil procedure in which are found the institutions licensed by auction of movable property and judicial administration of real estates; Visto l'art. 2 of the Ministerial Decree of October 31, 2006 (identification of internet sites intended for inclusion of notices of sale under art. 490 of the code of civil procedure) which States that ' the websites operated by the persons in possession of the professional requirements laid down in art. 3 and with the technical requirements laid down in art. 4, are entered on the list maintained in the Department for Justice Affairs of the Ministry, General Directorate of civil justice '; Seen the P.D.G. of April 2, 2009 with whom: it's been ordered the establishment of the list of websites operated by persons in possession of the professional requirements laid down in art. 3 and with the technical requirements laid down in art. 4; In addition, for the advertising of goods, websites managed by authorised institutions pursuant to subsection fifth art. Ministerial Decree of 2 October 31, 2006;
It was established on register in which shall be kept admission decrees of the companies in the list of internet sites who are applying as well, for the advertising of goods, of institutions licensed under subsection fifth art. 2 of the Ministerial Decree of October 31, 2006, as well as the decrees of refusal and cancellation; Having regard to the request of February 17, 2011 prot. m. dg DAG 22/2/20110 # 25107. And integrated with note by e-mail (Prot. 15236/DIGSIA and 1 St June 2011), with which the company Edicom Services S.r.l., with registered office in Palermo, via Marchese di Villabianca, 21 tax code # 05899750821, website: www.asteavvisi.it, presented application of that company in the list of internet sites and said he wanted to make the ad in the districts of the Court of appeal of: Ancona, Bari, Bologna , Brescia, Cagliari, Caltanissetta, Campobasso, Catania, Catanzaro, Firenze, Genova, L'Aquila, Lecce, Messina, Milan, Naples, Palermo, Perugia, Potenza, Reggio Calabria, Rome, Salerno, Turin, Trento, Trieste and Venice; Given that the requirements possessed by the company «Edicom Service S.r.l.» are in accordance with the provisions of the P.D.G. of April 2, 2009; Verified in particular: the professionalism and technical requirements;
the absence of situations of incompatibility;
possession of the operating manual and site safety plan; Having regard to the favourable opinion by the Directorate-General for automated information systems (Prot. m. 1 St June 2011 dg dog # 15333. U);
Features: the inscription of the company «Edicom Services S.r.l., with registered office in Palermo, via Marchese di Villabianca, 21 tax code # 05899750821, website: www.asteavvisi.it, in section A of the list of websites operated by persons in possession of the professional requirements laid down in art. 3 and 4 of the Ministerial Decree of October 31, 2006. Registration is effective from the date of this provision. From the date of the registration, the company is authorized to carry out the advertising at the districts of the Court of appeal of: Ancona, Bari, Bologna, Brescia, Cagliari, Caltanissetta, Campobasso, Catania, Catanzaro, Firenze, Genova, L'Aquila, Lecce, Messina, Milan, Naples, Palermo, Perugia, Potenza, Reggio Calabria, Rome, Salerno, Turin, Trento, Trieste and Venice. The company is obliged to immediately communicate all the events and data requirements, amending the lists communicated for the purposes of registration. The Director-General of civil justice reserves the right to verify the maintenance requirements and the implementation of the commitments undertaken. The Director-General of civil justice will proceed in accordance with art. Ministerial Decree 8 October 31, 2006. Ascertaining the absence or default of the requirements and conditions laid down in articles 2, 3 and 4 will result in cancellation of the internet site from the list under art. 2 of that Decree. Please note that in accordance with art. 8, second paragraph, of the Ministerial Decree of October 31, 2006, are deleted from the list the sites that carry out the publicity of acts related to enforcement proceedings pending before the courts of the districts of the Court of appeal other than those for which they are enrolled.
