The MINISTER of ECONOMIC DEVELOPMENT Saw the art. 1, paragraph 845 of the Act December 27, 2006, n. 296 and subsequent modifications and additions, which provides that the Minister of economic development may establish, by Decree, specific aid schemes in compliance with Community rules; Visto l'art. 14, paragraph 1, of law No 46 February 17, 1982, which established the Ministry of industry, Commerce and crafts the Special Fund for technological innovation; Having regard to the decree-law June 22, 2012, n. 83 laying down "urgent measures for the country's growth», converted, with amendments, by law, August 7, 2012 # 134, which under art. 23, paragraph 2, provides that the Special Fund for technological innovation renamed the Fund for sustainable growth; Having regard to the Decree of the Minister of economic development, in consultation with the Minister of economy and finance, March 8, 2013, published in the Gazzetta Ufficiale della Repubblica italiana n. 113 of May 16, 2013, by which, in accordance with art. 23, paragraph 3, of that Decree-Law No 83 of 2012, priorities have been identified, the shapes and the maximum aid intensity granted under the Fund for sustainable growth; See, in particular, article. 17 of the aforementioned Decree March 8, 2013, under which, in the first phase of implementation, the operation of the interventions mentioned in art. 14 February 17, 1982, law # 46; Having regard to Directive January 16, 2001 of the Minister of industry, Commerce and crafts, containing guidelines for the granting of the advantages of the Special Fund for technological innovation; Having regard to Directive July 10, 2008 of the Minister of economic development on the adaptation of Directive January 16, 2001 the Community framework for State aid for research and development and innovation (2006/C 323/01), published in the Official Gazette on September 10, 2008, # 212; Having regard to Council Regulation (EC) No 800/2008 of August 6, 2008, published in the Official Gazette L 214 of August 9, 2008 declaring certain categories of aid compatible with the common market in application of articles 87 and 88 of the EC Treaty (General block exemption regulation), and in particular art. 31 establishing the conditions for considering compatible with the common market and exempt from the obligation to notify the aid for research and development projects; Having regard to the Legislative Decree March 31, 1998, n. 123, containing "provisions for the rationalization of public support to enterprises, in accordance with art. 4, paragraph 4, point c) of law March 15, 1997, # 59 '; Having regard to the Special Commissioner's Decree of the Presidency of the Council of Ministers April 16, 2009, n. 3, as subsequently supplemented by the Decree of July 17, 2009, n. 11, concerning the identification of common damaged by the earthquakes which hit the province of L'Aquila and other towns in the Abruzzo region the day April 6, 2009; Having regard to the CIPE # 135 of December 21, 2012, as amended by resolution, pending, taken by the Committee at its meeting of July 19, 2013, that, in the context of assistance for reconstruction in the Abruzzo region after the earthquake in April 2009, has allocated €100,000,000.00, drains on the resources of the Fund for development and cohesion, to support productive activities and research in the area of seismic crater aquilano; Having regard to the Decree of the Minister for territorial cohesion April 8, 2013 who shared these resources, allocating €15,000,000.00 to finance projects of industrial research and experimental development prevalent; Given the need to begin the procedures for the granting of incentives in favour of r & d projects capable of increasing the competitiveness of companies in the seismic crater aquilano;
Decrees: Art. 1 Definitions 1. For the purposes of this Decree, the following definitions are adopted: a) "Ministry" means the Ministry of economic development;
b) directive: directive July 10, 2008 of the Minister of economic development on the adaptation of Directive January 16, 2001 to the Community guidelines on State aid for research, development and innovation (2006/C 323/01), published in the September 10, 2008 G.U.R.I., # 212;
c) ' GBER ' means the Regulation (EC) no 800/2008 of August 6, 2008, published in the Official Gazette L 214 of August 9, 2008 declaring certain categories of aid compatible with the common market in application of articles 87 and 88 of the EC Treaty (General block exemption regulation) and subsequent amendments and additions;
d) ' industrial research ' means planned research or critical investigation aimed at the acquisition of new knowledge, to be used for developing new products, processes or services or to allow a significant improvement in existing products, processes or services. It includes the creation of components of complex systems, which is necessary for the purposes of industrial research, notably for generic technology validation, to the exclusion of prototypes;

e) "experimental development ' means the acquiring, combining, shaping and use of knowledge and existing scientific, technological capacity, sales and more, in order to produce plans, projects or designs for new products, processes or services, modified or enhanced. Can also be other activities intended for the conceptual definition, planning and documentation relating to new products, processes and services. These activities may include the development of designs, drawings, plans and other documentation, as long as they are not intended for commercial use. Beyond the experimental development prototyping can be used for commercial purposes and of pilot projects to technological and commercial experiments, when the prototype is necessarily the final commercial product and its manufacturing cost is too high to be able to use it only for demonstration and validation. Any further exploitation, demonstration projects or pilot projects for commercial purposes means the deduction of income so generated by the eligible costs. Experimental development does not include routine or periodic changes changes made to products, production lines, manufacturing processes, existing services and other operations in progress, even when those changes are improvements.
f) ' research entities ' means entities such as universities or research institutions, irrespective of their legal status (constituted under private law or public) or funding source,) whose main purpose is to carry out basic research, industrial research or experimental development and disseminate results, through teaching, publication or technology transfer , ii) whose profits are reinvested in research activity, in the dissemination of their results or teaching and research capacity and iii) whose results are not accessible preferentially to businesses able to exert an influence on them, such as in their capacity as shareholders or members;
g) "territory of the crater ' means the territory of the municipalities of Aquila, earthquake detected by the Decree of the Special Commissioner of the Presidency of the Council of Ministers of April 16, 2009, # 3, as subsequently supplemented by the Decree of July 17, 2009, # 11, of Acciano, Arsita, Barete, Barisciano, Bugnara, Brittoli, Bussi sul Tirino, Cagnano Amiterno, Campotosto, Capestrano, Capitignano, Caporciano, Carapelle Calvisio, Castel del Monte, Castel di Ieri , Castles, Castelvecchio Calvisio, Castelvecchio Subequo, Cocullo, Collarmele, Colledara, Civitella Casanova, Cugnoli, Fagnano Alto, Fano Adriano, Fontecchio, pit, Gagliano Aterno, Goriano Sicoli, L'Aquila, Lucoli, Montebello di Bertona, Montereale, Montorio al Vomano, Navelli, Ofena, Ocre, Ovindoli, Penna Sant'Andrea, Pietracamela, Pizzoli, Poggio Picenze, peoples, Prata d'ansidonia, Rocca di Cambio, Rocca di Mezzo, San Demetrio ne ' Vestini, San Pio delle Camere, Sant'Eusanio Forconese, Santo Stefano di Sessanio Scoppito, Tione degli Abruzzi, L'aquila, Torre de ' Passeri, Tossicia, Villa Santa Lucia degli Abruzzi and Villa Sant'Angelo;
h) ' contract ' means the contract network under art. 3, paragraph 4-ter of Decree Law February 10, 2009, n. 5 April 9, 2009, converted, with amendments, by law, no. 33, as amended and supplemented;
the Horizon 2020 programme) ' means the framework programme for research and innovation set out in the communication from the European Commission COM (2011) 808 final of November 30, 2011.
