THE REPUBLIC OF INDONESIA ' S LEGAL AND HUMAN RIGHTS MINISTER,

DRAWS: that to implement the provisions of Section 205 Regulation

Government Number 31 Year 2013 on Regulation

Implementation of Act Number 6 of the Year 2011 on

Immigration as amended by Regulation

Government Number 26 Year 2016 on Change of

Government Regulation No. 31 Year 2013 on

Regulation of Implementation of Act Number 6 Year 2011

on Immigration, need to establish the Minister Regulation

Human Rights and Human Rights on Intelligence

Immigration;

SET: THE RULES OF THE MINISTER OF LAW AND HUMAN RIGHTS

BAB I

provisions of UMUM

Article 1

In this Ministerial Ordinance referred to:

1. Immigration is a matter of people's traffic that

in or out of Indonesia as well as

its supervision in order to keep its pressure

the sovereignty of the country.

2. Immigration Intelligence Operations is the activities of Intelligence

which is implemented by all working units in the field

Immigration Intelligence is compiled and organized

special.

3. Immigration clearance is an immigration document, a visa,

sign in, as well as an exit sign.

4. A foreigner is a person who is not a citizen

Indonesia.

5. The Minister is the minister who organizes affairs

governments in the field of law and human rights.

6. The Director General is the Director General of Immigration.

7. Immigration officials are employees who have been through

immigration special education and have expertise

technical immigration and have the authority to

carry out duties and responsibilities based on

The Act No. 6 of 2011 on

Immigration.

BAB II

FUNCTION, AUTHORITY, AND DUTIES

IMMIGRATION INTELLIGENCE

Article 2

The Immigration Intelligence Functions include:

a. Immigration Intelligence investigation; and

b. Immigration Intelligence Security.

Article 3

(1) The Immigration Intelligence Function is exercised by the Officials

Immigration.

(2) In performing functions, Immigration Officials are authorized:

a. obtain a description of the community or

government agency;

b. Coming up to a place or a possible building

can be found information about

the existence and activities of the Stranger;

c. conducting an Immigration Operations Intelligence Operation; or

d. Conducting security for data and

Immigration information as well as execution of duty

Immigration.

(3) In performing the authority referred to

in paragraph (2), the Immigration Officer has a task:

a. search, obtain, acquire,

collect, and process data and/or

target object information related to

Immigration Field;

b. created the immigration of Immigration Intelligence Operations;

and

c. created the report of Intelligence Operations results

Immigration as a surveillance material

Immigration.

Article 4

(1) Immigration Intelligence Functions as referred to

in Article 3 may also be carried out by the Operations team

Immigration Intelligence.

(2) The Immigration Intelligence Operations Team as

referred to in paragraph (1) is formed by:

a. Director General for at central level;

b. Head of the Area Office for at the Provincial level;

and

c. Head of the Immigration Office for at the level

District/City.

(3) The membership of the Immigration Intelligence Operations team is composed

over chairman and member.

BAB III

IMMIGRATION INTELLIGENCE INQUIRY

Article 5

Investigations Immigration Intelligence as intended

in Section 2 of the letter a is executed to search,

obtain, acquire, collect, and process

data and/or information related to the target object

in the field Immigration.

Article 6

(1) The Investigation of Immigration Intelligence as

referred to in Section 5 can be tactical and

strategic.

(2) The Immigration Intelligence Inquiry as

referred to the paragraph (1) is executed by stage:

a. planning;

b. collection of data and/or information;

c. data processing and/or information; and

d. The presentation of the results report.

Article 7

The Immigration Intelligence Inquiry as intended

in Section 6 can be implemented:

a. open; and/or

b. closed.

Article 8

Open Immigration Intelligence Investigation publicly

as referred to in Article 7 of the letter a can

be executed through:

a. research;

b. interviews; and/or

c. interrogation.

Article 9

Closed Immigration Intelligence Inquiry closed

as referred to in Section 7 of the letter b can

be executed through:

a. observation or depiction;

b. The climbs;

c. hearing;

d. tapping;

e. break-in;

f. storage; and/or

g.

Article 10

The Director General sets the implementation guidelines

Immigration Intelligence investigation.

BAB IV

IMMIGRATION SAFEGUARDS

Article 11

(1) Security Immigration as intended in

Article 2 of the letter b aims for early detection and

prevention efforts against threats, challenges,

obstacles, and the lament of Functions

Immigration.

(2) The Immigration Security Guard as referred to

paragraph (1) is executed against:

a. Immigration clearance;

b. personnel;

c. materials and documents; and

d. office and vital installation.

Article 12

(1) The security clearance of the immigration permit as

referred to in Article 11 of the paragraph (2) of the letter includes:

a. Immigration document consists of:

1. Travel Documents of the Republic of Indonesia; and

2. permission to stay,

b. visa; and

c. sign of entry and exit of Indonesia.

(2) The security clearance of the immigration permit is exercised

at the time of submission of the application until

the issuer of immigration clearance.

Article 13

Securing personnel as referred to in Section 11

paragraph (2) letter b is implemented for:

a. prevent an occurrence of deviation and misuse

authority by personnel in carrying out tasks and

functions in the Immigration field; and

b. presents the data and information needed by

leaders as consideration materials in

placement policy and career coaching

any immigration personnel.

Section 14

The Custodto materials and immigration documents

as referred to in Section 11 of the paragraph (2) of the letter c

is exercised to prevent material misuse and

documents related to Immigration.

Article 15

Securing the material and immigration documents

as it is in Section 14 is implemented with

the way:

a. Inventories and inventories;

b. Electronic administrations; and

c. surveillance in storage and distribution.

Section 16

(1) The security of the office and the vital installation

as referred to in Section 11 of the paragraph (2) of the letter d.

is implemented to prevent any threat,

challenges, obstacles, and interruption to the office

and vital installations in carrying out tasks and functions

in the Immigration field.

(2) The office of office security as referred to in paragraph (1)

is implemented against:

a. building of the Directorate General of Immigration, the Immigration Office,

and the Immigration Detension House; and

b. There is a means of infrastructure inside and in

the building environment of the Directorate General of Immigration,

The Immigration Office, and the Immigration Detension House.

(3) The security of the vital installation as referred to

paragraph (1) was executed against:

a. Immigration General Directorate data center;

b. data stored in the information system

immigration management; and

c. means of communication.

Article 17

The security against office and vital installation as

referred to in Article 16 is implemented. by way of:

a. Datasets, inventories, and identification;

b. supervision and surveillance;

c. report regularly against office conditions and

vital installations; and

d. report on first opportunity to the leadership

against suspected threats and security interference

offices and vital installations.

Article 18

The Director General sets the implementation guidelines

The Custodour Immigration Intelligence.

BAB V

IMMIGRATION INTELLIGENCE PRODUCTS

Article 19

Any implementation of Operation Intelligence Intelligence should

be poured in the form of the product of Operation Intelligence results

Immigration.

Article 20

The product of the Immigration Intelligence Operations result as

referred to in Article 19 is made by stage:

a. collection;

b. Note:

c. assessment;

d. analysis;

e. the estimated state

f. interpretation; and

g. conclusions and/or recommendations.

Article 21

The product of the Immigration Intelligence Operations results as

referred to in Section 20 is compiled in the form of a report.

Section 22

Product as referred to in Section 21 delivered

to the Director General berjenjang

Article 23

The Director General sets the implementation guidelines

The product drafting of the Immigration Intelligence Operations product

as referred to in Article 22.

Article 24

(1) In addition to the results implementation of the intelligence operation

Immigration as referred to in Article 19,

The product of the results of the Immigration Intelligence operation may come from

from the Immigration Forens report.

Article 25

The Director General sets out the product composition guidelines

results of the Immigration Intelligence Operations.

BAB VI

IMMIGRATION INTELLIGENCE COOPERATION

Article 26

(1) In conducting Operation Intelligence Intelligence Officer

Designated Immigration may cooperate with

government agencies are either at the central level or at the level

area.

(2) Instancy as referred to in paragraph (1) consists of

ministry/agency, government agency

nonministry, local government, Intelligence Agency

Country, State Police Republic of Indonesia, Army

National Indonesia, and/or Prosecutor.

Article 27

In support of the Immigration Intelligence operation, Officials

Designated Immigration may carry out the cooperation

with individual persons or community groups.

Article 28

The Director General sets the implementation guidelines

An immigration of Immigration Intelligence cooperation.

BAB VII

SUPPORT FOR THE IMPLEMENTATION OF THE INTELLIGENCE FUNCTIONS

IMMIGRATION

Article 29

(1) In implementing the Immigration Intelligence function

required support of the means and prasarana.

(2) Sarana and the prasarana as referred to in paragraph

(1) are at least composed of:

a. Forensic lab; and

b. base data in the Management Information System

Immigration.

BAB VIII

PROTECTION OF IMMIGRATION INTELLIGENCE PERSONNEL

Article 30

(1) Directorate General of Immigration granted

the protection of any Intelligence Personnel

In immigration carry out tasks and functions

Immigration Intelligence.

(2) The contemplaation as referred to in paragraph (1)

includes personal protection and protection against

her family as per the terms of the perinvite rule-

invitation.

BAB IX

Article 31

The Regulation of the Minister goes into effect on the date

promulred.
