DECIDED: Establishing: REGULATION OF THE MINISTER OF ENVIRONMENT AND

FORESTRY ON THE METHOD OF GIVING, EXPANSION OF WORKSPACE AND AN EXTENSION OF THE ATTEMPTED USE OF TIMBER FOREST PRODUCTS IN NATURAL FORESTS, A PERMIT FOR THE USE OF FOREST FOREST RESTORATION EFFORTS, OR THE PERMIT FOR THE USE OF FOREST WOOD FOREST PRODUCTS IN THE PRODUCTION FORESTS.

BAB I

provisions of UMUM Article 1

In Regulation of this Minister, referred to: 1. The production forest is a forest area that has a staple function

producing forest results.

2. An unproductive production forest is a forest reserved by the Minister as an area of plant forest development.

3. The use of wood forest products is to utilize and attempt to produce wood by non-destructive environments and not reduce the function of the cigarette.

4. IUPHHK-HA (IUPHHK-HA), formerly known as IUPHHK-HA (IUPHHK-HA), formerly known as Forest Management (HPH), is a permit to use the production forest for which its activities consist of harvesting or logging, enrichment, and enrichment of the forest. the maintenance and marketing of wood forest results.

14. The Director-General is the Director General of the task and is responsible for the forest management of sustainable production forests.

15. The Head of the Provincial Service is the Head of the Provincial Service, which is the duty and responsibility of the forestry.

BAB II

TERMS AREAL, THE APPLICANT ' S CONDITION AND THE LICENSING FEES

Part of the Areal Terms for IUPHHK-HA, IUPHHK-RE, and IUPHHK-HTI

Section 2

Section 3 (1) Petitioner:

a. Personal; b. Cooperative;

c. Private Property Agency of Indonesia (PT, CV, Firm);

d. State Owned Entity (BUMN); or e. The Regional-owned Business Agency (BUMD).

(2) the applicant as referred to in paragraph (1) letter a, letter b and letter c, for:

a. Individuals may form a CV or a Firm and include a founding deed passed by the authorized instance; or

b. cooperative, and BUMSI must have a deed of establishment as well as its changes that are authorized by the authorized agency.

(3) The applicant IUPHHK-HTI by the Indonesian Private Property Agency as referred to in paragraph (1) of the letter c, its capital may be from a foreign investor.

(4) The format of the request as contemplated on paragraph (1), as set forth in Appendix I of this Minister Rule.

The Third Part of the Licensing

Section 4 (1) of the licensing process not subject to charges includes:

a. Indicators of Indicator Map Information for Forest Production Areas That Are Not Encumbered For The Use Of Wood Forest Products;

b. Recommendations from the Governor; c. service/registration on the PTSP loket;

d. Administration check; e. proposal assessment (exposition);

f. field checking by UPT or Provincial Forest Service;

g. Principle approval; h. creation of working areal works; and

i. BKPM Chief Decision publishing on behalf of the Minister about granting Permits.

(2) Licensing fees imposed as non-tax revenue (PNBP) as a result of a timber forest yield (IIUPHHK) license for the size of a timber forest product (IIUPHHK). comply with the terms of the laws and are informed on the PTSP BKPM locket.

CHAPTER III OF THE GRANT GRANT

section 5 (1) The application is submitted by the applicant to the Minister u.p. Head

Article 6

(1) In terms of the recommendation of the Governor as referred to in Article 5 of the letter e, not published in the term of 21 (two

(2) In case the Governor does not publish a recommendation as referred to by paragraph (1), the applicant attaches proof of a recommendation request received by the instance in question as fulfillment of the completeness of the requirement.

(3) In terms of a Province it has formed a unified licensing ministry, the recommendation of the Governor may be published by integrated licensing service body.

(4) Example format of recommendation from The Governor as referred to in Article 5 of the paragraph (1) of the letter e as set forth in Appendix II.

Article 7 (1) Head of the BKPM in the term 1 (one) working day performing

examination of the completion of the requirements as referred to in Section 5, which is performed by the Ministry of Environment and Forestry which is placed on the BKPM (Liaison Officer).

(2) In the case of a request does not meet the completeness of the requirements as referred to in paragraph (1), the application of the application is returned.

(3) In the case of the request meets the completeness of the requirements as referred to in paragraph (1), Liaison Officer forwarded a request to the Secretary General to be delivered to the Director General in the term 1 (one) working day.

(6) Further provisions on the assessment of the technical proposals as referred to in paragraph (4) are governed with the General Director Ordinance.

Section 8

(1) In terms of the Technical Verification results, the Areal Willingness and the Map and the Technical Proposal assessment as referred to in Section 7 of the paragraph

(5) does not pass, Head of BKPM in term 5 (five) business days publishing letter of rejection permission.

(2) In terms of Technical Verification results, Areal Inclusion and Maps as well as Technical Proposal Assessment as referred to in Section 7 of the paragraph (5) is declared a pass, the Chief of BKPM on behalf of the Minister establishes the candidate for a permit in the term 5 (five) of the working day by publishing the Approval Principle (RATTUSIP), which contains the order for: a. assemble and deliver the AMDAL and IL documents for

IUPHHK-HA in accordance with the provisions of the invite-invitation rules;

b. assemble and deliver AMDAL or UKL and UPL and IL for IUPHHK-HTI in accordance with the provisions of the legislation;

c. compiling UKL and UPL and IL for IUPHHK-RE in accordance with the provisions of the laws of the laws; and

d. make an areal limit geographic coordinates against the prospective work area with the technical guidance of the Technical Managing Unit (UPT) that leads to the monitoring of the forest region.

Section 9 of the fulfilment of the order in the Principle Approval Letter (RATTUSIP) as referred to in Article 8 of the paragraph (2), delivered to BKPM (Liaison Officer) is: a. IL and the AMDAL or IL documents and the UKL and UPL documents

that have been approved or authorized from the authorized officials as referred to in Section 8 of the paragraph (2) of the letters a, letter b and the letter c; and

b. news of the event results of the creation of geographical coordinates of the areal limits on prospective work areal as referred to in Section 8 of the paragraph (2) of the d.

Section 10

(1) The obligation of fulfillment of the document as referred to in Article 9 of the letter a and letter b, completed in the longest term of 150 (one hundred fifty) calendar days.

(2) In case the applicant is not completed The obligation of the document as referred to in paragraph (1), the Letter of the Approval Principle (RATTUSIP) is null and void and the Chief of BKPM on behalf of the Minister makes a notice of the cancellation of the Approval Principle (RATTUSIP).

Article 11 (1) BKPM (Liaison Officer) delivered IL with the AMDAL document

(6) Within 5 (five) business days after receiving the Ministerial Decree, Chief of BKPM a.n. Minister publishes the Minister's Decision regarding the granting of permits and its work areal map attachments.

CHAPTER IV APPLICATION EXPANSION APPLICATION

Article 13 (1) Licensee IUPHHK-HA, IUPHHK-HTI or IUPHHK-RE, can

apply for the expansion of the work area with the criterion:

a. location which borders directly/side by area of the permit,

b. As long as it is not for the purpose of the forest utilization effort; and c. does not exceed the length of the specified permit.

(2) The expansion of the work areal expansion as referred to in paragraph (1), given to the holder of IUPHHK-HA, IUPHHK-HTI or IUPHHK-RE in A certified production forest is medium or good.

(3) The process of subsequent expansion permits refers to the provisions as referred to Section 5 to Section 12 of the Regulation of this Minister, with the exception of: a. the requirements as defined in Section 5 of the paragraph (1) of the letter

e and the letter f; and

b. the execution of a technical proposal assessment as referred to in Section 7 of the paragraph (4),

is not required. BAB V

EXTENSION IUPHHK-HA

Article 14 (1) Areal which is impaced for extension IUPHHK-HA i.e. work areal

Section 17

Process of application of extension IUPHHK-HA further refers to the provisions of the PTSP BKPM. as referred to Section 6 to the Article 12 of the Regulation of this Minister, with the exception of: a. in the issuance of the Approval Principle (RATTUSIP), only

contains an order for: 1) convex the Environmental Permit (IL) in accordance with the provisions

Article 18

Article 21

BAB VII ELSEWHERE

Article 23 (1) In terms of the District/City there is a production forest that is not

saddled with a limited free license and only please by IUPHHK-HA, the following is the case for the following conditions: IUPHHK-HT or IUPHHK-RE, and there is no backup for the People's Plant Forest (HTR) by the Minister or has not been proposed to the HTR backup, then against IUPHHK-HA, IUPHHK-HT or IUPHHK-RE applications in the District/City, the Minister allocates the areal with at least 20% (twenty-perhundred) of the area of the area of effective application for HTR .

(2) In terms of the District/City there is HTR side by side with IUPHHK-HA, IUPHHK-HTI, and IUPHHK-RE, then the permit holder does the technical coaching of HTR.

Article 24 In terms of IUPHHK-RE application, the source of funding for activities is not justified to be obtained from foreign country loans or grants.

BAB VIII provisions CLOSING

Article 25 At the time the Minister's Ordinance came into effect, then:

A. Regulations Minister Forestry Number P. 31/Menhut-II/2014 on the Order of the Giving and Enlargement of Areal Work Utilization Of Timber Forest Results (IUPHHK) In Natural Forests, IUPHHK Restoration Ecosystem, or IUPHHK Forest Plant Industry in the Forest Production; and

b. Regulation of Forestry Minister Number P. 51/Menhut-II/2014 on Tata Cara and Requirement Extension Requirements of Wood forest results in the Natural forests of the Production Forest,

revoked and declared to be not applicable. Article 26

The Minister ' s Regulation is beginning to apply to the date of the undrased.
