OUTSIDE THE COUNTRY

PRESIDENT OF THE REPUBLIC OF INDONESIA,

Weigh: a. that changes and developments are happening at the national and international level, have provided greater opportunities and challenges for the host of foreign relations and the conduct of foreign politics so that an increase in the Organizational capacity and the readiness of the human resources;
B. That the demands of a clean, capable and professional government are to be strengthened, so as to be necessary for the executors of qualified diplomacy to host foreign relations and the conduct of foreign politics. focused, selective, comprehensive, coordinated, efficient, and effective;
c. that the organizational structure of the Representative of the Republic of Indonesia in Foreign Affairs as set out in Presidential Decree Number 51 of 1976 on the subject of the Organization of Representatives of the Republic of Indonesia in Foreign Affairs as it has been several times amended The last time with the Presidential Decree No. 74 of the year 2000 is deemed to be unsuitable to demands needs;

5. Law No. 24 Year 2000 on International Covenant (State Sheet 2000 Number 185, Additional Gazette State Number 4012);
6. Presidential Decree Number 102 Year 2001 on Position, Duties, Functions, Authority, Organizational Arrangement and Department of Work as amended by the Presidential Decree Number 45 of 2002;
7. Decree President Number 109 of 2001 on the Unit of Organization and Duty of Eselon I Department as it has been several times amended last with Presidential Decree Number 88 of 2003;

DECIDED:

SET: THE PRESIDENT ' S DECISION ON THE ORGANIZATION OF THE REPRESENTATIVE OF THE REPUBLIC OF INDONESIA ABROAD.

BAB I
UMUM PROVISIONS

Section 1
In this President ' s Decision, which is referred to by:
1. Representative of the Republic of Indonesia in Foreign Affairs, later called Representative is the Diplomatic Representative and Representative of the Consular Republic of Indonesia which formally represents and championed the interests of the Nation, the State, and the Government of the Republic of Indonesia. The Republic of Indonesia as a whole in the State of the recipient or on the International Organization
2. The recipient country is the country where the Representative is.
3. The International Organization is the international organization of the recipient of a position of Representative.
4. Diplomatic Representative is the Embassy of the Republic of Indonesia and the Permanent Envoy of the Republic of Indonesia which conducts diplomatic activities throughout the territory of the State of the Recipient and/or on the International Organization to represent and fight for Nation, State and Government of the Republic of Indonesia.
5. The Consular Representative is the Consulate General of the Republic of Indonesia and the Consulate of the Republic of Indonesia who conducts consular activities in the region of work within the territory of the State of the Recipient to represent and fight for the interests of the Nation, State, and Government of Republic of Indonesia.
6. Foreign Service Officials are Civil Servants who have been following special education and exercises for duty in the State Department and Representative of the Republic of Indonesia.
7. Ambassador Extraordinary and Full Power, and Permanent Representative of the Republic of Indonesia is the Acting State Officer appointed by the President to represent and fight for the interests of the Nation, State, and Government of the Republic of Indonesia as well as being a private representative President of the Republic of Indonesia in one Recipient Country or more or on the International Organization.
8. The Consul General and the Consul who led the Consular Representative are the Home Office filled by the Acting Foreign Service and/or other eligible civil servants, appointed by the President on the proposal of the Minister of Foreign Affairs to represent and fight for the interests of the Nation, State, and Government of the Republic of Indonesia in one or more work areas within the territory of the State of the Recipient
9. Power of the Fixed Effort is the Acting Foreign Service accredited to the Minister of Foreign Affairs of the Ministry of State for the lead of the Diplomatic Representative.
10. Diplomatic and Consular officials, who are subsequently called Diplomatic Officials are Foreign Service Officials carrying out diplomatic and consular activities to fight for the interests of the Nation, State, and the Government of the Republic of Indonesia in the The State of the Recipient or the International Organization.
11. Atase Defence is an Indonesian National Army officer stationed in a specific Diplomatic Representative to carry out duties in the field of defence.
12. Technical Atase is a Public Service Officer of the Department or a Non-Department Government Institution who is assigned to a specific Diplomatic Representative to perform tasks that are in the field of authority of the Department or of the Non-Department Government Institution.
13. Technical staff are Public Employees of the Department or the Non-Department Government Institution housed in a particular Consular Representative.
14. Consul General of Honor and Honorary Consul is the Citizen of the Recipient appointed by the President on the proposal of the Foreign Minister who has certain qualifications to carry out the function of the consultanate and/or promotion function in the region State Recipient.
15. Non Diplomatic Staff is a civil servant in the Department of Foreign Affairs who is responsible for assisting the Organizing Administration and the Representative.
16. Local employees are non-permanent employees who are employed on the basis of a working contract for a particular period of time, in order to perform certain tasks in the Representative.
17. Diplomatic title is a single-level title given to the Acting Foreign Service Officer who has qualifications based on international law and customs, as well as applicable national laws.
(1) The Defence Atase, Technical Atase and Technical Staff are operationally and administrative are inseparable parts of the Representative.
(2) Technical coaching of the execution of the task and function of the Defence Atase and Technical Atase is carried out by the Department or the Non-Department Government Institution concerned.

Section 23
The establishment of the organizational structure and the work order of each Representative is set forth by the Secretary of State after receiving written approval from the Minister in charge of the field of atonement for the state apparatus based on national interests, the weight of the mission, activities, intensity, and degree of Indonesian relations with the State of the Recipient.

BAB VIII
SUPERVISION

Section 24
(1) The supervision and control of the duties and functions of the Representative as well as matters concerning the acceptance and expenses of the finances in the Representative are conducted in accordance with the provisions of the applicable laws.
(2) The Chief Representative is required to conduct internal oversight and control to improve the accountability of the Representative's performance.

BAB IX
OPENING AND CLOSING
REPRESENTATIVE OFFICE

Section 25
(1) The opening and closing of the Office of the Diplomatic Representative or the Representative of the Consular in another Country or the Representative Office on the International Organization is established with the Presidential Decree.
(2) The implementation of the Presidential Decision as referred to in paragraph (1) is carried out by the Minister of Foreign Affairs.

BAB X
OTHER LAIN-CONDITIONS

Section 26
(1) In terms of the Head of the Diplomatic Representative not in place and/or hindrous, the Temporary Powers Appointed to carry out the principal duties and functions of the Chief Diplomatic Representative are:
a. Deputy Chief Representative for Representative who has Deputy Chief Representative;
B. Diplomatic officials who have the most diplomatic titles for the Representative do not have the Deputy Chief Representative.
(2) In the event the Chief Representative of the Consular is not in place and/or hindrous, appointed Acting Acting Chief of the Consular Representative to carry out the principal duties and functions of the Chief Representative of the Consular.

Section 27
The appointment of the Honorary Consul General and Honorary Consul is set by the Presidential Decree on the proposal of the Foreign Minister.

Section 28
(1) Local employees are appointed and dismissed with the Chief Representative ' s Decision after obtaining written consent from the Minister of Foreign Affairs.
(2) The guidelines and layout of the appointment and dismissal of the Local Employees are further regulated by the Foreign Minister.

Section 29
(1) In certain respects, the Ambassador Extraordinary and Full-Power, Consul General and Consul may bring together some of the State of the Capture Recipients and the consular work area of the catch.
(2) The provisions of the designation of the Embassy of the Diplomatic Representative and the Consular Representative as referred to in paragraph (1) are further governed by the Minister of Foreign Affairs.

Section 30
(1) In order to increase and attainment of the mission of the Representative, the Minister of Foreign Affairs may conduct a review of the representative organization upon receiving approval from the Minister responsible in the field of the country's apparatus and the Minister's office. Finance.
(2) In the event of a review of a representative organization as referred to in paragraph (1), it concerns the number and composition of the Defence Atase, Technical Atase and/or Technical Staff, the Foreign Minister conducted the discussion together with the Minister. be responsible for the management of the country's apparatus and the Finance Minister, as well as the Chairman of the Department or the Chairman of the associated Non-Department Government Institution.

BAB XI
THE TRANSITION PROVISION

Section 31
The transition period and the adjustment of representative organizations based on this President's Decision, completed at least 2 (two) years from the date of the President's Decision.

Section 32
The current organization of Representatives of the Republic of Indonesia is governed under Presidential Decree No. 51 of 1976 on the subject of the Organization of Representatives of the Republic of Indonesia in the Foreign Affairs of the Republic of Indonesia as well as the last modified several times. with Presidential Decree No. 74 of 2000 and its implementation regulations still remain in effect until the formation of a new organization in accordance with this President's Decision.

BAB XII
CLOSING PROVISIONS

Section 33
With the enactment of the Presidential Decree, the Presidential Decree No. 51 of 1976 on the subject of the Organization of Representatives of the Republic of Indonesia, as amended by the Presidential Decree No. 74 of the Year, 2000 as well as other regulatory provisions as opposed to this President ' s Decision, stated do not apply.

Section 34
This President ' s decision comes into effect at the set date.
