REGULATIONS OF THE PRESIDENT OF THE REPUBLIC OF INDONESIA NUMBER 74, 2008

ABOUT THE GENERAL ALLOCATION FUNDS OF THE PROVINCE, COUNTY,

AND KOTA IN 2009

WITH THE GRACE OF GOD ALMIGHTY

THE PRESIDENT OF THE REPUBLIC OF INDONESIA,

Weigh: a. that in accordance with the provisions of Article 40, Section 42, Section 43,

and Article 46 of the Government Regulation No. 55 of 2005 on the Balance Fund, the Government has conducted the formulation of the formula and the calculation of the Provincial General Alocation Funds, County, and City of 2009;

b. that the formulation of the formula and the calculation of the General Alocation Fund as referred to in the letter is done with regard to the results of the People's Representative Council's Budget Committee Meeting with the Government in the discussion of the Revenue Budget Plan and State Shopping 2009 on 29 October 2008;

c. that in connection with the letter a and letter b, as well as to meet the provisions of article 48 paragraph (1) Government Regulation No. 55 of 2005 on the Balance Fund, Dana The General Allocations of the Province, County, and the City of 2009 need to be established with Presidential Rule;

DECIDED:

SET: THE PRESIDENT ' S REGULATION ON FUND THE GENERAL ALLOCATION OF PROVINCES, COUNTIES, AND CITIES IN 2009.

Article 1

(1) The General Alocation Fund is made up of: a. The General Allocations Fund for the Provincial Area;

. The General Allocations Fund for the District and the City. (2) The overall number of General Alocations of the Year 2009 was set

26% (twenty-six percent) of the Internal Revenue Neto set in the State Budget and Shopping Year 2009 Budget Year.

(3) The Proportion Of General Allocation Funds for Provincial, County, and City Regions is designated as follows: a. For Provincial Regions of 10% (ten percent) of

the overall number of General Alocations Funds as specified in paragraph (2);

b. For District and City Areas of 90% (ninety percent) of the total number of General Alocations Funds as specified in paragraph (2).

section 2

(1) The calculation of the General Alallocation Fund for each of the Provincial, County, and City Regions is conducted using the General Alocation Fund formula in accordance with Law Number 33 of the Year 2004 on Financial Balance between the Central Government and the Local Government.

(2) The General Alocation Fund of a Provincial, County, and City Region is allocated based on a formula that consists of a fiscal and basic allocation gap.

(3) Provincial Regional Fiscal Gap, County, and City are calculated from the fiscal needs reduced with fiscal capacity Each country, county, county, and city.

(6) General Alocation funds on the basis of the fiscal loophole are calculated based on the weight of the fiscal loophole of each of the Provincial District, County, or City with the number of General Alocation Funds of the entire Province Area or General Alocation Fund of the entire County and City.

(7) The General Alocation Fund on the basis of basic allocation is calculated based on the number of Regional Civil Servants (PNSD) salaries proportionally including the increase in principal pay, the awarding of the 13th month, and the salary for the Candidate of the Civil Service. Area.

Article 3

(1) The area that has a fiscal gap value is greater than 0 (zero), accepting the General Alocation Fund of the base allocation plus the fiscal loophole.

Section 4

Article 6

The President Regulation is beginning to apply on the 1st January 2009.
