ABOUT THE CHANGE IN FORESTRY MINISTER REGULATION NUMBER

P. 16/MENHUT-II/2007 ABOUT THE INDUSTRY ' S DEFAULT COMPLIANCE PLAN (RPBBI) PRIMARY WOOD FOREST RESULT

WITH THE GRACE OF THE GOD ALMIGHTY REPUBLIC OF INDONESIA,

DRAWS: A. that under the provisions of Article 115 paragraph (1) of the Order of Government Regulation No. 6 of 2007 as amended by the Government Regulation No. 3 of 2008, one of the obligations for the Primary Industry Contractual Permit Holder of the Forest Results (IPHH) composed the and deliver the Industrial Raw Materials Fulfillment Plan (RPBBI) annually;

b. that RPBBI Primary Industries Primary Wood Forest Results have been set up with the Ordinance of Forestry Minister Number P. 16/Menhut-II/2007 about the Industrial Default Material Fulfillment Plan (RPBBI) Primary Wood Forest Results;

c. that based on the results of the evaluation of The Minister of Forestry Regulation is a grain of grain, that the primary industrial supply control system of the primary industrial forest is not yet effective;

d. that in respect of the above consideration, it is necessary to change some provisions in the Regulation of the Forestry Minister Number P. 16/Menhut-II/2007 on the Plan of Fulfillment Of Industrial Raw Materials (RPBBI) Primary Results of Wood Forest, with the Regulation of Ministers Forestry;

Given: 1. m e m u t u s k a n: Setting: REGULATION OF FORESTRY MINISTER ABOUT

THE UPPER CHANGE REGULATION OF FORESTRY MINISTER NUMBER P. 16/MENHUT-II/2007 ON THE PLAN OF FULFILMENT OF THE PRIMARY INDUSTRY ' S RAW MATERIALS OF WOOD FOREST RESULTS.

Article I Some provisions in the Regulation of the Minister of Forestry Number P. 16/Menhut- II/2007 on the Plan of Fulfillment Of The Primary Industries Of The Primary Industry The Result Of Timber Forests, were changed as follows: 1. The provisions of Article 1 are amended so that it reads as follows:

Article 1 In this Regulation is referred to as:

1. The Primary Industry of Wood Forest Results (IPHHK) is a round and/or small round wood processing into half-so or freight-like goods.

2. An industrial type is a part of an industrial branch that has special features with certain products produced from the production process.

3. Forest results are biological, non-biological and derivative objects, as well as services originating from the forest.

4. Primary forest results are the result of wood forest and not wood that is directly levied from the forest.

5. The forest of the right or forest of the people is a forest which is on the property of the property.

6. Industrial raw materials are forest products that are processed or untreated and can be used as production materials in the industry.

7. Other Authorized Permits (ILS) are the Wood Expediency Permit (IPK) of the use of the State Forest designated as Areal Use Other Use (APL) or Non-Forest Cultivation Area

8. An Industrial Business permit (IUI) is permission to process round wood and or small round wood and/or forest produce instead of wood into half-or-half goods or so.

9. A production permit capacity is the maximum production volume each year that is permitted, based on the industrial business permit of the authorized officer.

10. The next RPBBI-based primary industrial fulfillment plan (RPBBI) is a plan that includes the need for raw materials and supplies of raw materials derived from legitimate sources according to the primary industrial clearance capacity of the forest results and the the availability of the raw materials supply guarantee for a term of 1 (one) year that is the raw materials supply control system.

11. The delivery of RPBBI or RPBBI change report or monthly report of the realization of RPBBI electronically is the delivery of RPBBI or RPBBI changes or RPBBI changes or monthly report of the realization of RPBBI which is done electronically through an application based on web.

12. Delivery of RPBBI or RPBBI change report or monthly report realization of RPBBI manual is the delivery of RPBBI or RPBBI report or RPBBI change report or monthly report of RPBBI realization conducted with ordinary mail or non- electronic which is equipped with supporting documents the default material is required.

13. Publishing receipt of RPBBI delivery or electronic RPBBI change report is the issuance of the RPBBI delivery receipt or RPBBI change report which is done electronically through the process automation of the application system web.

14. The RPBBI-delivery receipt or manual change report is the issuer of the RPBBI delivery receipt or RPBBI changes performed with regular mail not through a web-based application.

15. The RPBBI application is a component of the information system used to execute functions, processes and work mechanisms that support the delivery of RPBBI or RPBBI change reports or an electronically realized monthly report of RPBBI.

16. Login is the process of accessing a computer by inserting a User ID and Password to gain access rights using the application.

17. User ID is a unique name or identifier as a self-identity used to operate in the application.

18. Password is a collection of characters or strings used by network users or a multiuser operating system (many users) to verify user ID to the network owned by the network or The system.

19. The year running was the year of the RPBBI's work from 1 January to 31 December.

20. The year before that was the year before the RPBBI was compiled.

21. The Director General is the Director General of the Board of Directors and responsibility in the field of Forestry Production Bina.

22. The Director is the Director that rinse the processing and marketing of forest results.

23. The Provincial Service is the Service which is the duty and responsibility of the forestry in the province region.

24. County/City Services are the Services that are the duty and responsibility in the field of forestry in the District/City area.

25. The Hall is the Production Forest Utilization Monitoring Hall in the local area.

2. The provisions of Section 5 are amended, so that it reads as follows:

Section 5

(1) The Plan of Fulfilment Of The Primary Industry Raw Materials using the source of the raw materials as referred to in Article 3 consists of:

a. Use Of Wood Forest Yield Utilization Efforts in Natural Forest and or Ecosystem Restoration in the Natural Forest and/or IUPHHK On HTI and or HTR and or HTHR in the forest

plants must be lamped or fitted with a supply/supply contract agreement letter and copy of the Annual Work Action Plan for the Results of Wood Forest Results (SK. RKT-UPHHK) the year runs if the raw materials are a walking year or a Rounded Wood Mutation Report (LM-KB/LM-KBK) source of the raw materials last month prior to the preparation of the RPBBI and copy of SK. Previous year ' s RKT-UPHHK if the raw material was a result of the previous year's stub;

b. Use of timber forest products in the village forest and/or the Correctional Forest must be attached or equipped with a contract of supply and supply contract agreements and a copy of the plan of wood flying under the laws of the laws of the laws of the forest. which applies if the default material is a running year or the LM-KB/LM-KBK source material last month prior to the preparation of the RPBBI and a copy of the timber flying plan of the year prior to the applicable laws. if the raw material was a result of the previous year's stub;

with a supply/supply contract agreement letter with the owners of the people ' s forest or Wood-gatherer wood-gatherer of the people or people given by the owners of the people's forest, or;

2) has been designated using the Letter of Origin (SKAU), not attached or equipped with a cooperation contract agreement. The supply/supply.

e. Estates, which may consist of: 1) National Private Plantation of national or state estates,

f. Wood imports must be lamped or equipped with imported documents or import plan documents;

g. Proceeds of the auction that are derived from spoils, sitings and/or findings should be lamped or equipped with a copy of the wooden auction treatises from the Office of Debt Affairs and the local State Lelang;

h. The owner or merchant of the forest results of the legitimate origin as referred to in Article 3 of the paragraph (2) of the letter c: 1) If the wood has been owned by the merchant and is

an ex of natural forest flying, must be lamped or equipped with a supply/supply contract agreement letter and LM-KB/LM-KBK contract and proof of wood's validity to the merchant in accordance with the the applicable law, or;

2) If the wood is not yet owned but is still in the process of being held by the merchant of the original owner or the Licensee's authorized use of the wood forest results and the ILS of the wood or IPK as a result referred to in Article 3 of the paragraph (1) letter a, letter b, letter c, letter d, letter e, letter f, letter g, letter h and letter i, must be lamped or equipped with a supply/supply cooperation contract agreement between IPHHK and merchants, and a signed agreement cooperation agreement letter between merchants and early owners or permit holders.

i. The Primary Industry (IPHHK) is a form of round wood, half-breed or half-processed wood.

(2) In terms of IPHHK using IUPHHK raw materials sources on the Natural Forest, IUPHHK Restoration Ecosystem in Natural Forest, IUPHHK On HTI, IUPHHK On HTR, IUPHHK On HTHR, IUPHHK In Village Forest, IUPHHK On the Forest of Corrections or ILS results The wood forest itself is either lamped or equipped with a copy of SK. RKT-UPHHK/Wood bangan plan as per the provisions of laws or SK. Wood forest results without a suplai/supply contract agreement.

(3) In terms of IPHHK using the raw materials source derived from Perum Perhutani are attached or equipped with a supply/supply contract agreement letter or a letter from Perum Perhutani Local unit that specifies the IPHHK as a user or round woodwork processor Perum Perhutani.

(4) The contract of supply cooperation/supply of raw materials as referred to in paragraph (1) letter a, letter b and letter c may be performed with the authorities authorized by IUPHHK/ILS holders. Or the IPK with a good copy of SK. RKT-UPHHK or wood flying plan as per the applicable laws/SK ILS or IPK and LMKB/LMKBK laws.

(5) In terms of IPHHK using raw materials is derived from: a. Estimated final inventory/estimated stock in the IPHHK on

date 31 December of the previous year dilampiri or equipped with LM-KB/LMKBK last month prior to the drafting of the RPBBI, for which compiling and delivering RPBBI before the 1st January year running;

b. The final inventory/stock in the IPHHK on December 31 of the previous year was lamped or fitted with the previous December LM-KB/LM-KBK LM, for the compiling and delivering the RPBBI after 31 December of the previous year.

3. The provisions of Article 7 are amended, so it reads as follows:

Section 7

(1) The Timber Fulfillment Plan of the Primary Industry Default Materials as referred to in Section 4 and Section 5 is delivered with an introductory letter from the administrator of the IU-IPHHK to the official Authorities no later than 31 January.

(2) The authorized officials as referred to the verse (1) are: a. The head of the county/city Service for IPHHK with permit capacity

production up to 2,000 (two thousand) cubic meters per year; b. Provincial Service Head for IPHHK with permit capacity

production above 2,000 (two thousand) cubic meters per year up to 6,000 (six thousand) cubic meters per year;

c. Director General for IPHHK with production permit capacity above 6,000 (six thousand) cubic meters per year.

(3) Delivery of RPBBI to authorized officials as referred to in paragraph (1) and paragraph (2) is performed:

a. manual by IU-IPHHK holders with production capacity up to 2,000 (two thousand) cubic meters per year, as a monitoring and evaluation material by the Chief Service Officer/Kota;

b. manually by IU-IPHHK holders with production capacity above 2,000 (two thousand) cubic meters per year up to 6,000 (six thousand) cubic meters per year, as a monitoring and evaluation material by the Provincial Service Chief;

c. Electronically by IU-IPHHK holders with a production capacity above 6,000 (six thousand) cubic meters per year, as a monitoring and evaluation material by the Director General, or manual if the RPBBI application is impaired or operation failed.

(4) If the RPBBI application has been uninterrupted or has been reworked then the RPBBI is delivered manually must be made in the input and delivery of the data electronically by the holder IU-IPHHK.

(5) If not made electronically by IU-IPHHK data holder as referred to in paragraph (4), the permit holder is declared not to compose and deliver RPBBI.

(6) For IU-IPHHK holders with a production capacity above 6,000 (six thousand) cubic meters per year that will deliver RPBBI electronically use the source of the standard materials ILS or IPK as referred to in Section 3 of the paragraph (1) letter h, but the name of the default source company is not yet available on data base the application system is required to deliver a copy of SK. ILS or IPK supplemented letters using the format as set forth in Appendix 1 of this Regulation.

(7) If ILS or IPK as referred to in paragraph (6) have expired but still have a round and/or wood stock small round, then the SK.ILS or IPK copy delivery must be supplemented by a copy of the Stock Event News Opname at the end of the licensing and copy of the LMKB and/or LMKBK since the termination of the permissions.

(8) The RPBBI Delivery is evidenced by the letter Published receipts:

1. Provincial Service Chief;

1. Head of the District Service/Kota;

2. Head of the Hall.

c. Electronically by the Director in the name of the Director General, for IPHHK with a production permit capacity above 6,000 (six thousand) cubic meters per year, which can be printed on its own by the IU-IPHHK Pemegamg and applies as valid evidence tools accordingly Applicable law provisions, or manuers against the delivery of the RPBBI by manual if the RPBBI application is impaired or failed to operate.

(9) The receipt of RPBBI's delivery of the RPBBI as a result of referred to in paragraph (8) the letter a, the letter b and the letter c are made using the format as listed in Appendix 2 of this Regulation.

(10) The delivery of the RPBBI and the issuance of the RPBBI delivery letter electronically as referred to in paragraph (3) the letter c and paragraph (8) of the letter c may be monitored by the Chief of the Service. Provinces and by the Head of the Hall via login respectively.

(11) The RPBBI delivery letter as referred to in paragraph (1) of its release is delivered manual to:

a. Head of the Provincial Service and Head of the Hall, for IPHHK with a production permit capacity up to 2,000 (two thousand) cubic meters per year;

b. Head of the County/City Service and Head of the Hall, for IPHHK with a production permit capacity above 2,000 (two thousand) cubic meters per year up to 6,000 (six thousand) cubic meters per year;

c. County/City Service Head, for IPHHK with production permit capacity above 6,000 (six thousand) cubic meters per year.

(12) The delivery of the RPBBI mail delivery letter as referred to in paragraph (11) is sufficient only accompanied or accompanied by a single IBM Cognos Business Intelligence Service. with RPBBI resumes compiled using the format as set forth in Annex II of the Forest Minister Regulation Number P. 16/Menhut-II/2007, not attached to the RPBBI book and the supporting documents of the raw materials.

5. The provisions of Article 8 are amended, so it reads as follows:

Section 8

Section 9

(3) The list of IU-IPHHK holders names as referred to in paragraph (1) lists the recapitulation of the volume of raw materials based on the source group compiled using the format as set forth in Annex III.c of the Minister of Forestry Regulation Number P. 16/Menhut-II/2007.

7. The provisions of Article 11 are amended, so it reads as follows:

Article 11

(1) The RPBBI Changes as referred to in Article 10 are delivered in accordance with the provisions of Article 7 of the paragraph (2), paragraph (3), paragraph (4), paragraph (5), paragraph (6) and paragraph (7).

(2) The delivery of a RPBBI change report as referred to in paragraph (1) is received by authorized officials before the supply of raw materials is met or before the raw materials are received at IPHHK.

(3) If the RPBBI change report delivered by the IU-IPHHK holder is received by authorized officials after the fulfillment of the raw material is redeemed, the permit holder is declared not to compose and deliver the RPBBI.

(4) The delivery of a RPBBI change report is evidenced by a receipt letter published in accordance with the provisions of Article 7 of the paragraph (8) letter a, letter b and letter c, paragraph (9) and paragraph (10).

(5) In the event of a RPBBI change capacity production permit up to 6,000 (six thousand) cubic meters per year delivered does not meet the provisions as referred to in Article 10 of the paragraph (2),

paragraph (3) and paragraph (4), no receipt of the receipt and the holder of the license is declared not to compile and deliver RPBBI.

8. Between Section 11 and Section 12 of the two new sections, Section 11a and Section 11b, which reads as follows:

Section 11a

Section 11b

(1) Based on the delivery of RPBBI Changes from IU-IPHHK holders with production permit capacity up to 2,000 (two thousand) cubic meters per year and the issuer issuer of RPBBI changes to the RPBBI of the Head of the District/City Service, the Head of the Hall every month no later than the 20th to deliver its data electronically through the RPBBI application to the Director General.

(2) The monthly report of the realization of the IPHHK RPBBI as referred to in paragraph (1) is delivered to:

Section 12b

11. The provisions of Article 15 are amended to read as follows:

(1) Delivery of RPBBI by IU-IPHHK holders received by authorized officials after 31 January year running is categorized as RPBBI delivered late.

Section 15a

(1) The Realization of the fulfilment of the raw materials is not compatible with RPBBI, if the use of raw materials exceeds the amount of time in which the standard material is used. RPBBI and/or the volume of the fulfilment of raw materials exceeding RPBBI and/or the source of the raw materials does not correspond to the applicable RPBBI.

(2) Realization of processed wood production does not correspond to RPBBI if the production of processed wood does not correspond to RPBBI compiled based on the permitted production capacity.

(3) If there is no The RPBBI agrees with its realistic report, then the IU-IPHHK holder is given a written reprimand in writing.

Article 15b

13. The provisions of Article 16 are amended so that it reads as follows:

Article 16

(1) The overdue IPHHK Effort delivers a monthly report of the realization of RPBBI and the RPBBI change report is subject to a written reprimand.

(2) The reprimand as referred to in verse (1) or the delay of the monthly report of the realization of RPBBI and the delay in doing the RPBBI change is made the basis of the evaluation of IPHHK.

(3) The violation of the provisions as referred to in Section 2, and Section 7, to the IPHHK Business Permit Holder may be subject to the applicable laws and regulations until the IU-IPHHK holders meet its obligations as set out in this Regulation.

(4) The IU-IPHHK holders are subject to administrative sanction of a temporary termination of service provision under the provisions of Article 137 of Government Regulation No. 6 of 2007 jo. Government Regulation No. 3 of 2008, if:

a. Not composing and delivering RPBBI;

b. Not drafting and delivering a monthly report of the realization of RPBBI.

(5) The administrative sanction as referred to in paragraph (4) is imposed until the IU-IPHHK holder may fulfill its obligations.

(6) The IU-IPHHK Holder is declared not to compose and deliver RPBBI, if :

a. Until 31 January the year the running of the authorized official has not received the delivery of the year RPBBI running from the permit holder;

b. It does not comply with the terms referred to in Article 7 of the paragraph (5) or paragraph (15) or paragraph (17), or Article 11 of the paragraph (3) or paragraph (5), or Article 11a paragraph (2).

(7) IU-IPHHK is declared not to compose and deliver the monthly Realization RPBBI report, if:

a. Up to the next 10 months authorized officials have not received a monthly report realization of RPBBI from a permit holder, or;

b. It does not comply with the provisions as referred to in Article 12 of the paragraph (8).

14. Between Section 16 and Section 17 of Section 17, Section 16a reads as follows:

Article 16a

(1) Under the imposition of the sanctions as referred to in Article 16 of the section 16 paragraph (4) of the Provincial Service Chief:

a. Do not provide the application designation of the blanko FA-KO series number submitted by IU-IPHHK;

b. It does not provide services to the application of the Issuer Of Processed Wood Transport (FA-KO) submitted by IU-IPHHK;

c. Do not provide services to a serial number of Blank Wood Transport Invoices (FA-KB) submitted by IU-IPHHK;

d. Freeze the appointment of a FA-KO publisher.

(2) Based on the imposition of the sanctions as referred to in Article 16 of the paragraph (4) of the Head of the Hall:

a. Do not provide service for the FA-KO Publisher Register Number designation submitted by the IU-IPHHK holder;

b. Do not provide the service for the FA-KB Publisher Register number submitted by the IU-IPHHK holder;

c. Freezing the appointment of FA-KB Publishers in the IU-IPHHK holding company.

(3) More provisions on the imposition of administrative sanctions such as cessation of interim service as referred to in paragraph (1) and paragraph (2) follow the Regulation of the Minister that governs the sanction.

15. The provisions of Article 17 are deleted. PASAL II
