referred to in paragraph (1) letter b applies to: a. Acute toxicity; b. coroocy/skin irritation; c. damage/serious irritation to the eye; d. The sensitization of the skin or the skin; e. mutagenicity of stem cells; f. Carcinogenicity; g. toxic to reproduction; h. systemic toxicity in specific target organs after

single exposure; i. systemic toxicity in specific target organs after

recurring exposure; and j. Aspiration hazards.

Article 5 (1) The chemicals as referred to in Section 2 of the paragraph (1)

and the paragraph (2) are required to be labeled. (2) The Label as referred to in paragraph (1) consists of an element:

a. Product Markers; b. Pictogram Danger; c. Word Signal; d. Statement of Danger; and e. Manufacturer's identification.

(3) In addition to the element as referred to in paragraph (2), it may be added to a Statement of caution.

(4) The Label as referred to in paragraph (2) and paragraph (3) must:

a. Easy to read; b. clearly visible; c. not easily damaged; d. It's not easy to escape its packaging; and e. it is not easy to wear off due to the effect of light, air or

others. Section 6

(1) The Limitation Obligations of the Product as referred to in Section 5 of the paragraph (2) of the letter a may be excluded along for the benefit of the privacy protection of the company with the following conditions: a. not violating aspects of health, safety, safety

and the environment; and b. not jeopardive the company's survival.

(2) The exception of the product marker caning as referred to in paragraph (1) includes: a. the name of the chemical; b. concentrate/cadar; and c. other information that is deemed necessary.

(3) The industry is required to open the company's confidential information as referred to in paragraph (1) to the authorities, at the request of the Director General of the Industrial Pembina and or in the state of emergency, by guaranking the protection of information secrecy.

Article 7 (1) Piktogram The GHS Danger as referred to in Article

5 paragraph (2) of the letter b as set forth in Annex I of this Minister Rule.

(2) The size of and the GHS hazard pictogram layout as referred to in paragraph (1) is adjusted to product packaging size and must be clearly visible.

Article 8 (1) The Danger Statement as referred to in Article 5

paragraph (2) of the letter d is ordered in order based on the level of danger.

(2) The Statement of Danger as referred to in paragraph (1) is listed under the Piktogram Danger GHS and must be clearly read.

Article 9 of the chemicals as referred to in Article 2 are required to have an LDKB, with the format referred to in Appendix II of this Minister Rule.

Article 10 (1) The labeling of the label and LDKB as referred to in Article

5 verses (1) and Section 9 are required to use Indonesian language. (2) The use of the Indonesian language as referred to in

paragraph (1) may be accompanied by an international language used as an official language in the United Nations.

CHAPTER III OBLIGATIONS

Article 11 (1) Each offender efforts that produce chemicals and or

its products are mandatory: a. define the hazards classification of chemicals and or

products that are produced in accordance with the provisions as referred to in Section 4;

b. listed the label as referred to in Section 5 of the chemical and or product packaging;

c. makes LDKB as referred to in Section 9 of any chemical; and

d. Perform a review of the label at least every 2 (two) years after the need.

(2) Any attempted perpetrator who performs a repackaging of the chemical is mandatory: a. listed the label as referred to in Section

5, on the chemical packaging; and b. including LDKB as referred to in Section 9

for any chemicals.

(3) Each offender who has committed an obligation as referred to in paragraph (1) and (2) is required to submit a report in writing to the Director General of Industry Pembina for any of its products.

(4) The form of the report as referred to in paragraph (3) as set forth in Appendix III of this Minister's Regulation.

CHAPTER IV PROHIBITION

Section 12 (1) Any attempted offender is prohibited from providing information that

is not appropriate/misleading at label and LDKB of the chemicals produced.

(2) Any attempted perpetrator is prohibited producing chemicals without listing the labels as referred to in Section 5.

(3) Any attempted perpetrator is prohibited from producing chemicals without being accompanied by LDKB as referred to in Article 9.

CHAPTER V COACHING AND SUPERVISION

Article 13 Director General Pembina Industries is required to conduct coaching on the implementation of this Ministerial Regulation.

Article 14 of the coaching as referred to in Article 13 is: a. socialization to chemical producers, society and

stakeholders regarding the use of chemicals as well as related matters; and

b. training for the chemical producers and government apparatus that handles chemicals.

Article 15 Oversight to the means of manufacturers and perpetrators is conducted by Director General Pembina Industries.

Article 16 of the perpetrators committing violations to the provisions in the Regulation of the Minister are subject to sanction in accordance with the provisions of the laws.

CHAPTER VI OF THE PROVISIONS

Article 17 of the Regulation of the Minister begins to apply 6 (six) months from the date set. In order for everyone to know, the Minister's Regulation is promulred by its placement in the News of the Republic of Indonesia.
