THE REGULATION OF THE REPUBLIC OF INDONESIA ' S MINISTRY OF INDUSTRY

NUMBER: 69/M-IND/PER/7/2009 ABOUT

THE ENFORCING INDONESIAN NATIONAL STANDARD (SNI) DRINKING WATER IN PACKAGING (AMDK) IS OBLIGATORY

WITH THE GRACE OF THE LORD MAHA ESA MINISTER OF THE REPUBLIC OF INDONESIA,

DRAWS: A. that in order to encourage increased competability, create healthy business competition, guarantee health, safety, consumer safety and preserve the functioning of the environment, need to reset the provisions of the Standard Treatment arrangement National Indonesia (SNI) Water Drinking In Packaging (AMDK) Is Obligatory;

DECIDED:

Establishing: MINISTRY OF MINISTRY ' S REGULATIONS ON THE IMPLEMENTATION OF THE NATIONAL STANDARDS OF INDONESIA (SNI) THE DRINKING WATER IN PACKAGING (AMDK) IS OBLIGATORY.

Article 1

In Regulation of this Minister referred to: 1. Water Drinking In Kemasan, abbreviated AMDK is

The default water that has been processed, packaged and safely drunk. 2. The National Standard Sign Use Product Certificate

Indonesia which is abbreviated as SPPT-SNI is the Certificate granted to the manufacturer capable of generating goods and or services in accordance with the SNI requirements.

3. The abbreviated National Accreditation Committee is the non-structural institution that is below and is responsible to the President and the authorities for

Accreditation agency/laboratory for performing certification activities.

4. The LSPro (LSI) is an agency that performs the SNI Use product certification activities.

5. Director General Pembina Industry is Director General of Industrial Agro and Chemistry, Department of Industry.

6. The Supervising Officer of the Standard Goods and Services in the Factory (PPSP) is a civil servant in the center or area designated by an industry clerk's letter to conduct surveillance of goods and services in a factory. It's a mandatory service.

7. The head of the BPPI is the Head of the Industrial Research and Development Agency, the Department of Industry.

8. The head of the Provincial Service is the Head of the Provincial Service which carries out the duties of government affairs in the industrial field.

9. The head of the District/City Service is the Head of the District/City Service which carries out the duties of government affairs in the industrial field.

Article 2 (1) Memberdo National Standards of Indonesia, SNI 01-

3553-2006 AMDK or its revisions mandatory, which includes: a. Mineral Water (HS Ex 2201.10.00.00); and or b. Demineral Water (HS Code Ex 2201.90.90.00).

(2) Mineral Water as referred to in paragraph (1) letter a is drinking water in a particular quantity of minerals without adding a mineral.

(3) Demineral Water as referred to in paragraph (1) The letter b is a drinking water in the packaging obtained through the purification process of deionization, deionization, reverse osmosis or equivalent process.

Section 3 The company that produces AMDK as referred to in Article 2 is mandatory:

a. implement SNI and have SPPT-SNI in accordance with the provisions of SNI AMDK;

b. create an SNI AMDK sign on each packaging product and or label; and

c. install "Air Mineral" or "Demineral Water" written on each packaging and or label.

Article 4

Any AMDK as referred to in Section 2 is being trafficked in a country derived from the results of domestic production or import is required to meet the provisions of the SNI as referred to in Article 3.

Article 5 (1) The SPPT-SNI Publishing as referred to in Article

3 letters a, performed by the LSPro which has been accredited by KAN or who is appointed by the Minister Industrial.

(2) The SPPT-SNI publishing as referred to in paragraph (1) is done through:

a. product quality fitness testing matches SNI 01-3553-2006 or its revisions; and

b. audit the application of the SNI quality management system 19-9001-2001 /ISO 9001:2000 or its revision or other quality management system recognized.

(3) Testing as referred to in paragraph (2) the letter a may be subcontracted to the laboratory The examiner who has been accredited by the KAN/was appointed Minister of Industry or subcontracted to the tester lab abroad, as long as it has been.

Section 6 (1) LSPro as referred to in Section 5 of the paragraph (1)

(2) LSPro as referred to in paragraph (1) performs the supervision of the use of the SNI AMDK sign over the SPPT-SNI which it has published.

Article 7

(1) AMDK as referred to in Article 2 which derived from the import, which entered the Indonesian Customs region required to comply with the SNI provisions as referred to in Section 3.

(2) the import AMDK which does not meet the provisions as referred to in paragraph (1) is prohibited from entering into the Indonesian Pabean region and must be re-exported or destroyed.

Section 8

(1) The coaching and supervision of the implementation of the application of SNI AMDK as referred to in Section 2 is done by the Director General of Industry Pembina which

executed by PPSP at least 1 (one) times in a year.

(2) In conducting the supervision as referred to in paragraph (1), Director General Pembina Industries can coordinate with the Head Provincial Service and/or Head of the District/City Service.

(3) The Head of the BPPI carries out coaching on the Institution of Conformity in order to implement the SNI AMDK conscription as referred to in Article 2.

Article 9 of the Director General of Industry Pembina sets a technical directive implementation of the Regulation of this Minister.

Article 10 of the perpetrators committing violations to the provisions in the Regulation of this Minister are subject to sanction in accordance with the provisions of the laws.

Section 11 of the effort that has had the SPPT-SNI AMDK prior to applicable this Minister Regulation, must adjust the production and SPPT-SNT under the terms of this Minister's Regulation no later than 12 (twelve) months from date set the Regulation of this Minister.

Article 12 Under the effect of this Minister Regulation, the Decree of the Minister of Industry Number 120/M/SK/10/1990 on the Implementation of the Standard Industry of Indonesia (SII) and the Compulsory Use Of The SII Sign For Water Drink In The Pack (SII. 2040-90), revoked and declared not in effect.

Article 13 of the Minister ' s Regulation shall begin in effect 6 (six) months from the date set.
