NUMBER 87 /PMK.011/ 2011
ABOUT
CUSTOMS IMPOSITION OF SECURITY MEASURES AGAINST THE IMPORT OF COTTON YARN PRODUCTS OTHER THAN SEWING THREADS
(COTTON YARN OTHER THAN SEWING THREAD)

WITH THE GRACE OF THE ALMIGHTY GOD

THE FINANCE MINISTER OF THE REPUBLIC OF INDONESIA,

Weigh: a. that based on the results of the Indonesian Trade Security Committee's investigation prove there has been a surge in the volume of imported cotton thread products other than sewing threads (cotton yarn other than sewing threads) thus causing serious harm to the industry in the country;
B. that in order to follow up the results of such an investigation letter a, Minister of Commerce through Letter Number: 54/M-DAG/SD/1/2011 dated January 17, 2011 and Number: 499/M-DAG/SD/3/2011 dated March 30, 2011, delivered the Director's suggestion of the Customs Security measures against the import of cotton yarn products other than sewing threads (cotton yarn other than sewing threads);
c. that under the provisions of Article 21 of the Presidential Decree No. 84 of 2002 on the Internal Industrial Safety Act of the Aftermath Of The Import, a fixed security measure may be established in the form of Bea entered by the Minister of Finance;

Paying attention: 1. Minister of Trade No. 54/M-DAG/SD/1/2011 dated January 17, 2011 on the Proposed introduction of the Customs Enforcement Act of Safekeeping To Cotton Thread Products Other Than Sewing Threads (Cotton Yarn Other Than Sewing Thread);
2. Trade Minister ' s Letter Number: 499/M-DAG/SD/3/2011 dated March 30, 2011 on Confirmation Of A Post-tariff Tariff On Cotton Yarn Other Than Sewing Thread (Cotton Yarn Other Than Sewing Thread) Proposed To Be Subject-to-action Security (BMTP);
3. The Report of the Indonesian Trade Safeguards Committee On The Outcome Of The Investigation For The Safeguard Measures (Safeguard Measures) Over The Import Of Cotton Yarn Products Other Than Sewing Threads;

DECIDED:

SET: THE FINANCE MINISTER ' S REGULATION ON THE IMPOSITION OF THE CUSTOMS ENTRY AGAINST THE IMPORT OF COTTON YARN PRODUCTS OTHER THAN THE SEWING THREAD (COTTON YARN OTHER THAN SEWING THREAD).

Section 1
(1) Against the import of cotton yarn products other than sewing thread (cotton yarn other than sewing thread), it is subjected to the Maintenance Act of Security.
(2) The import product of a cotton thread in addition to the sewing thread (cotton yarn other than sewing thread) which the Customs Act imposed on the paragraph (1) is as set forth in Annex I of the Regulation This Finance Minister, which is an inseparable part of the Regulation of this Financial Minister.

Section 2
The Duties Of The Security Measures as referred to in Section 1, are imposed for 3 (three) years with the following provisions:

Import Duties
1 Year I, with a period of 1 (one) of the year counting the date of the promultable of the Minister of Finance. Rp 40.687/kg
2 Year II, with a period of 1 (one) year counting from the expiration date of the Year I. Rp 38.144/kg
3 Year III, with a period of 1 (one) year after the end date period of Year II. Rp 35.601/kg

Section 3
Bea entered the Security Act as referred to in Article 1, imposed against the importation of all countries, except for cotton yarn products other than sewing threads (cotton yarn other than sewing thread) produced from countries as defined in Annex II of this Financial Minister Regulation, which is an inseparable part of the Regulation of this Financial Minister.

Section 4
(1) The introduction of the Security Measures as referred to in Article 1 is:
a. additional common import duties (Most Favored Nation); or
B. additional customs entry preferences based on the international goods trade agreement schemes in effect in terms of imports made from countries included in the international goods trade agreement scheme and meet the provisions in the international goods trade agreement scheme.
(2) In terms of the provisions in the scheme of international goods trade agreements are not met, the imposition of the Customs Enforcement of the importation of the countries included in the international goods trade agreement scheme As referred to in paragraph (1) letter b, it is the most favorable import (Most Favored Nation) as referred to in paragraph (1) the letter a.

Section 5
Against the import of cotton yarn products other than sewing threads (cotton yarn other than sewing threads) derived from countries excluded from the Admitation of Security Measures as referred to in Article 3 and countries who has international goods trade cooperation with Indonesia as referred to in Article 4 of the paragraph (1) letter b, the importer shall submit the Letter of Origin Letter (Certificate of Origin).

Section 6
The provisions regarding the imposition of the Customs Action tariff are referred to in Article 2, fully applicable to the import of goods that import customs notice documents meant to receive registration numbers from the Port Customs Office. income since the effective date of this Financial Minister Regulation.

Section 7
1. The Regulation of the Minister of Finance is valid for 3 (three) years from the date of the promultable of the Regulation of the Minister of Finance.
2. This Finance Minister ' s Regulation is beginning to apply at the promulgable date.
