ABOUT
IMPORT OF ANTI-DUMPING DUTIES ON IMPORTED CERAMIC PRODUCTS IN THE FORM
DINING DEVICES, KITCHEN DEVICES, OTHER HOUSEHOLD APPLIANCES,
AND THE TOILET EQUIPMENT, FROM THE PEOPLE ' S REPUBLIC OF CHINA

WITH THE GRACE OF THE ALMIGHTY GOD

FINANCE MINISTER OF THE REPUBLIC OF INDONESIA,

Weighing: a.that under the provisions of Article 2 paragraph (1) of the Government Regulation No. 34 of 2011 on Antidumping Act, the Act of Imbalan, and the Act of Trade Security, against imported goods other than to be subjected to Bea Entry may be subject to any of the following: Customs Anti Dumping, if the export price of goods imported is lower than its normal value and leads to domestic industry losses that produce similar goods;
B. that in accordance with the results of the Indonesian Anti Dumping Committee (KADI) there is evidence of the importation of ceramic products of eating devices, kitchen devices, other household appliances, and toilet equipment, dumping of the People's Republic of China. which leads to loss (injury) against domestic industry and causal links (causal link) between such dumping goods with losses experienced in the domestic industry;
c. that based on the results of the KADI investigation as such in letter b, the Minister of Commerce by Letter Number 127.1/M-DAG/SD/1/2012 dated January 25, 2012 and Number: 404M/DAG/SD/3/2012 dated 9 March 2012, address the Minister Financial proposals to wear the Anti Dumping Customs against the import of ceramic products from the People's Republic of China and the magnitude of the Anti Dumping Customs tariff and the term of the Anti-Dumping Customs Imposition;
D. that under consideration as referred to in the letter a, letter b, and the letter c, and in order to carry out the provisions of Article 23D paragraph (2) of the Law No. 10 Year of 1995 on Kepabeanan as amended by the Act Number 17 Years 2006, It Is Necessary To Establish A Financial Minister's Regulation On The Introduction Of Anti-dumping To Imports Of Ceramic Products, Kitchen Devices, Other Household Appliances, and Toilet Equipment, Of The People's Republic Of China;

Remembering: 1. Law No. 7 of 1994 on Unrest Agreement Establishing the World Trade Organization (Republic of Indonesia States of 1994 No. 57, Additional Gazette of the Republic of Indonesia Number 3564);
2. Act No. 10 of 1995 on Kepabeanan (Sheet of State of the Republic of Indonesia of 1995 Number 75, Additional Gazette of the Republic of Indonesia Number 3612) as amended by the 2006 Act Number 17 (Country Gazette) Republic of Indonesia Year 2006 Number 93, Additional Gazette Republic of Indonesia Number 4661);
3. Government Regulation No. 34 of 2011 on the Actions of Antidumping, the Act of Imbalan, and the Act of Securing Trade (sheet Of State Of The Republic Of Indonesia In 2011 Number 66, Additional Gazette Of The Republic Of Indonesia Number 5225);

Paying attention: 1. Letter of Minister of Commerce 404/M-DAG/SD/3/2012 dated March 9, 2012 on the Proposed Designation Of Anti-Dumping Duties On The Import Of Ceramic Products of the People's Republic of China;
3. Trade Minister Letter Number 127.1/M-DAG/SD/1/2012 dated January 25, 2012 on the Proposed introduction of the Anti-dumping of Dumping On Ceramic Products imports from the People's Republic of China; the Final Report of the Anti Dumping Committee of Indonesia on Anti-Dumping Investigation On Imports Of Feeding Devices of Ceramic (Ceramic Tableware) Tariff Posts No. 6911.10.00.00, 6911.90.00.00 and 6912.00.00.00 Which Originated from the People ' s Republic of China;

DECIDED:

SET: THE FINANCE MINISTER 'S REGULATION ON THE IMPOSITION OF ANTI-DUMPING DUTIES AGAINST THE IMPORT OF CERAMIC PRODUCTS IN THE FORM OF EATING DEVICES, KITCHEN DEVICES, OTHER HOUSEHOLD APPLIANCES, AND TOILET EQUIPMENT, FROM THE PEOPLE' S REPUBLIC OF CHINA.

Section 1
Against the import of ceramic products from the People ' s Republic of China:
a. dining devices and kitchen devices from porselin or Chinese clay included in the fare post 6911.10.00.00;
B. Other household supplies and toilet equipment from porselin or Chinese clay included in the fare post 6911.90.00.00; and
c. devices, kitchen devices, other household supplies and toilet equipment of ceramics, in addition to the porselin or Chinese clay included in the tariff post 6912.00.00.00,
levied Anti Dumping Customs by 87% (eighty-seven percent).

Section 2
(1) The introduction of the Anti Dumping Customs as referred to in Article 1 is the addition of duties levied on the basis of the Customs Preferences tariff scheme for exporters and/or producers on companies that originate from countries that are in the country. have trade cooperation with Indonesia.
(2) In the case of the Customs Precipitation Tariff scheme as referred to in paragraph (1) is not met, the Anti Dumping Customs as referred to in Section 1 is the addition of the Customs to be levied on the basis of the Umum/Most Favoured Nation (MFN).

Section 3
The Anti-dumping customs tariff as referred to in Article 1 applies entirely to imported goods which the customs notification document has obtained from the Customs Office where the port of admission is due since the expiration date. This Minister ' s Rule.

Section 4
1. This Minister ' s Regulation is valid for 5 (five) years of counting from the effective date of the Regulation of this Minister.
2. The rules of the Minister are starting to apply at the promulgable date.
