Back COUNTRY SHEET REPUBLIC of INDONESIA No. 13, 2013 REGULATION PRESIDENT REPUBLIC of INDONESIA number 5 2013 FINANCIAL RIGHTS and FACILITIES of a JUDGE AD HOC by the GRACE of GOD ALMIGHTY the PRESIDENT of the Republic of INDONESIA, Considering: a. that the judge Ad Hoc is the officials who carry out an independent judicial authority to enforce the law and justice based on Pancasila and the Constitution of the Republic of Indonesia in 1945;
b. that the financial rights of judges Ad Hoc as the officials who carry out the powers of the judiciary needs to be specifically in the legislation;
c. that based on considerations as referred to in letter a and letter b, need to establish the presidential regulation on rights of finance and Facilities of judge Ad Hoc;
Remember: 1. Article 4 paragraph (1) of the Constitution of the Republic of Indonesia in 1945;

Decide: define: PRESIDENTIAL REGULATION of FINANCE and FACILITIES of a JUDGE AD HOC.

CHAPTER I GENERAL PROVISIONS article 1 In this regulation of the President is: 1. An Ad Hoc Judge is a judge who has expertise and experience in a specific area to inspect, judge, and disconnect a matter which was appointed for a specified period and his appointment is set out in the Act.
2. the Court is the first court, Court of appeal, and the Court of Cassation level in special judicial environment.
CHAPTER II RIGHTS of FINANCE and FACILITIES article 2 Ad Hoc Judges have the right financial and facilities as follows: a. allowances;

b. home country;

c. transportation facilities;

d. health coverage;

e. security guarantees in the exercise of his duties;

f. travel costs; and g. the award money.

Article 3 (1) to the Ad Hoc Judges given allowance each month.
(2) the Quantity allowances of judges Ad Hoc on each Court are listed in the annex which is the part that is an integral part of this Regulation of the President. (3) the magnitude of Ad Hoc Judges allowance already included the income tax.
(4) the judge Ad Hoc stemming from civil servants and receive the allowance referred to in subsection (1), is not entitled to the allowance position of structural or functional from institutions where such Ad Hoc Judges came from.
Article 4 (1) Ad Hoc Judges given the right to occupy the home country and use transportation facilities during its work on the assignment.
(2) in the case of home State and transportation facilities referred to in subsection (1) is not yet available, the Ad Hoc Judge may be given a housing allowance and transportation according to the country's financial capability.
Article 5 Ad Hoc Judges in carrying out tasks given guarantees of security in accordance with the provisions of the legislation.

Article 6 Ad Hoc Judges who carry out the trip given the cost of transportation and accommodation in accordance with the applicable for civil servants of Group IV.

Article 7 (1) a judge Ad Hoc was given the award at the end of the term.

(2) the award is awarded in the amount of 2 (two) times the quantity allowances.
(3) in case of Ad Hoc Judges could not complete his term, the granting of the award money is done based on the calculation of the period of work of the Office.
(4) the calculation of the period of Office of employment referred to in subsection (3) are as follows: a. up to 1 year: 0.2 x prize money;

b. over 1 year up to 2 years: 0.4 x prize money;

c. more than 2 years up to 3 years: 0.6 x prize money;

d. more than 3 years up to 4 years: 0.8 x prize money; and e. over 4 years to less than 5 years: 1 x prize money.
(5) the award is not given to a judge Ad Hoc was ever exposed to heavy administrative sanctions and/or criminal sanctions that are threatened with a punishment of at least 5 (five) years in prison.
Article 8 (1) of the financial Rights and facilities for Ad Hoc Judges given since concerned is appointed Ad Hoc Judge on the Court.
(2) to the Ad Hoc Judges appointed before this presidential Regulation took effect the financial rights and facilities provided for in this regulation of the President is given as of the enactment of the regulation since it started this President.
Article 9 further Provisions necessary for the implementation of this regulation of the President, established by the Minister of finance, Secretary of the Supreme Court, and the head of Bkn, either collectively or individually in accordance with their respective field of duty.

CHAPTER III TRANSITIONAL PROVISIONS article 10 by the time the presidential regulation is valid, then: 1. Presidential regulation Number 49 in 2005 about money honor for a judge At the Court of the crime of corruption as amended Presidential regulation Number 86 in 2010;
2. Presidential regulation Number 96 in 2006 about allowances and Other rights For Ad Hoc Judges On the Court of Industrial relations as amended Presidential regulation Number 20 in 2011; and 3. Presidential regulation Number 11 Year 2008 about money and Other rights For Ad Hoc Judges On the Court of fisheries in the District Court as amended Presidential regulation Number 87 in 2010;

revoked and declared inapplicable.
CHAPTER IV CLOSING PROVISIONS article 11 Any legislation contrary to the President's Rule was declared no longer valid.

Article 12 of the regulation this President comes into force on the date of promulgation.

In order to make everyone aware of it, ordered the enactment of this Regulation of the President of the Republic of Indonesia in the piece.
