GOVERNMENT REGULATION OF THE REPUBLIC OF INDONESIA
Number 59 YEAR 2013
ABOUT
THE SECURITY OF THE PRESIDENT AND VICE PRESIDENT, FORMER PRESIDENT
AND FORMER VICE PRESIDENT AND HIS FAMILY AS WELL AS GUESTS
THE STATE OF THE COUNTRY ' S HEAD OF STATE/HEAD OF GOVERNMENT

WITH THE GRACE OF THE ALMIGHTY GOD

PRESIDENT OF THE REPUBLIC OF INDONESIA,

Weigh: a.  that the President and the Vice President and his family and the State Guest at the level of the Head of State/Head of Government are representative of the country that should be subjected to security treatment specifically;
B.   that after the President and Vice President's term is over, as one of the forms of appreciation for his contribution to the State of the Republic of Indonesia need to obtain security;
c. that the threat and the disruption can compromise the safety and security of the President and Vice President, Former President and Former Vice President and his family as well as the State's Head of State/Head of Government, as well as being able to drop honor, dignity, and the authority of the Government;
D.   that under consideration as intended in the letter a, the letter b, and the letter c, and to carry out the provisions of Article 7 of the paragraph (2) the letter b 7 and the number 11 of the Law No. 34 of 2004 concerning the Indonesian National Armed Forces, need establish a Government Regulation on the Security of the President and Vice President, Former President and Former Vice President and his family as well as the State Chief of State/Head of Government;
Remembering: 1.   Article 5 of the paragraph (2) of the Basic Law of the Republic of Indonesia in 1945;
2. Law Number 7 of 1978 on Financial Rights/Administration of the President and Vice President as well as the Former President and Vice President (State Sheet of the Republic of Indonesia in 1978 Number 52, Additional Sheet of State of Indonesia Number 3128);
3. Law Number 37 Year 1999 on Foreign Relations (Sheet State Republic Of Indonesia In 1999 Number 156, Additional Sheet Of State Republic Of Indonesia Number 3882);
4. Act No. 2 of 2002 on the State Police of the Republic of Indonesia (State of the Republic of Indonesia 2002 No. 2, Additional Gazette of the Republic of Indonesia Number 4168);
5. Act No. 3 Year 2002 on State Defense (State Sheet Indonesia 2002 Number 3, Additional Gazette Republic of Indonesia Number 4169);

DECIDED:
SET: GOVERNMENT REGULATION ON THE SECURITY OF THE PRESIDENT AND VICE PRESIDENT, FORMER PRESIDENT AND FORMER VICE PRESIDENT AND HIS FAMILY AND STATE GUESTS TO THE HEAD OF THE STATE OR HEAD OF GOVERNMENT.

BAB I
UMUM CONDITIONS
Section 1
In this Government Regulation referred to by:
1. Security is any business, work, and action that is performed continuously or within a given term, to maintain the security of any threat and disruption that may interfere with or compromise the safety of the President and the United States. Vice President, Former President and Former Vice President and his family and the State Guest at the level of Head of Government.
2. Threats are any endeavour, work, activities, and actions from within the country and abroad, which are assessed and/or proven to endanger the safety of the President and Vice President, Former President and Former Vice President and the His family and the State Guest at the level of the Head of Government.
3. Disruption is any activity performed by certain parties that may inhibit, interfere with or derail the security of the President and Vice President, Former President and Former Vice President and his family as well as the Guest of the State Head of State/Head of Government.
4. The prefix is an activity/security operation in order to protect the President and the Vice President and his family and the State Guest at the level of the Head of State/Head of Government, emphasized in the aspect of the protokoler of statehood continuously Or in a certain period of time.
5. Rescue is a process, way, and action in the security measures undertaken based on a planning and a superior order that acts in order to save the soul of the President and Vice President, Former President and Former Vice President As well as his family and the State Guest, the State's Head of State/Head of the Government of the factual/emergency threat is taking place.
6. State guests are leaders of foreign countries visiting statistically, official, working, or private to the country of Indonesia.
7. The next Indonesian National Army (Indonesian National Armed Forces) is composed of the Army, Navy, and Air Force, is a tool of the state responsible for maintaining, protecting, and maintaining the integrity and sovereignty of the state.
8. The next Indonesian National Police is a tool of the state responsible for maintaining security and public order, enforcing the law, and providing protection, screening, and service to the community. In order to keep it safe in the country.
9. Commander of the Indonesian Armed Forces is a high-ranking military officer who leads the TNI.
10.Chief of the Indonesian National Police (Indonesian: Kapolri) is the head of the Indonesian National Police and the responsible for the functioning of the police force. The President's next Security Forces (Paspampres) are the forces responsible for carrying out direct physical security at any time to the President and Vice President, the former President and Former Vice President and the Vice President. His family and the State Guest-level Head of State/Head of Government as well as the task of a state protocol in order to support the main task of the TNI.
12.Units of the Regional Command is a unit of title of the Indonesian Armed Forces, which includes the Army, Navy, and Air Force, which has a principal task as the Main Command of the Operations and the Main Command of Operations.
13.; the Operations Command Unit is a Unit Unit of the Indonesian Army formed from the Regional Command Unit to carry out security operations in the area.
14.Representatives of the Republic of Indonesia abroad are the Embassy of the Republic of Indonesia, Permanent Envoy of the Republic of Indonesia, the Consulate General of the Republic of Indonesia, and the Consulate of the Republic of Indonesia.

The scope of this Government Regulation is set about:
a.   The security of the President and Vice President and his family;
B.   The Security of the Former President and Former Vice President and his family; and
C.   State of State Guest Security at the level of Head of State/Head of Government.


BAB II
THE PRESIDENT ' S SECURITY AND VICE PRESIDENT
AND HIS FAMILY
The Kesatu section
General
Section 3
(1) The President and Vice President and his family get the Security Guard.
(2) The security as referred to in verse (1) is given during its time in the country and abroad.
(3) The President ' s family and the Vice President as referred to in paragraph (1) include:
a.   wife or husband President and Vice President;
B.   President's son or Vice President; and
c. son-in-law of the President or Vice President.
(4) The Presidential Guard and the Vice President and his wife or husband include:
a.   Personal Security;
B.   Installation security;
C.   Activities security;
D.   Rescue security;
e.   Food security;
f.   Medical Security;
G.   News security; and
h.   Escort.
(5) The child safekeeping and son-in-law of the President and Vice President include:
a.   Personal Security;
B.   Activities security; and
C.   Escort.


The Second Part
Security of the President and Vice President Beserta ' s Wife or Husband
Paragraph 1
Security in the Interior
Section 4
(1) The Security of the President and the Vice President and his wife or husband in the country, organised by the Commander of the Armed Forces, coordinated with the Minister of State Secretaries, Kapolri, Head of the State Intelligence Agency, and the leadership of the respective agencies in accordance with the His authority.
(2) The coordinated thing as referred to in paragraph (1) includes:
a.   Security Organization;
B.   Security Area;
c. Security objectives;
D.   force strength;
e.   Startup activities;
f.   Security execution time;
G.   administration and logistics; and
h.   Command and control.

Section 5
(1) Personal security as referred to in Article 3 of the paragraph (4) of the letter a performed by the Paspampres is attached and continuously wherever it is.
(2) The installation security as referred to in Article 3 of the paragraph (4) of the letter b is exercised by the Paspampres, coordinated with the Polri and the associated agencies according to its authority on:
a.   the palace of the President and the Vice President;
B.   the residence of the President and Vice President of the President;
c. Private residence of the President and Vice President;
D.   site of activities, events, and other installations attended by the President and Vice President;
e.   The material used during the activities.
(3) The security of the activities as referred to in Article 3 of the paragraph (4) of the letter c is carried out by the Paspampres and the Operations Command Unit is coordinated with the Polri, the State Intelligence Agency in the Region, and the associated agencies according to its authority. on:
a.   activities or events attended by the President and Vice President;
B.   The President and Vice President's route passed.
(4) The rescue security as referred to in Article 3 of the paragraph (4) of the d is exercised by the Paspampres and the Operations Command Unit is coordinated with the Polri and the related agencies according to its authority.
(5) The food security as referred to in Article 3 of the paragraph (4) of the letter e executed by the Paspampres is coordinated with the associated agencies according to its authority.
(6) The medical security as referred to in Article 3 of the paragraph (4) of the letter f executed by the Paspampres is coordinated with the Presidential Doctor Team and the associated agencies according to its authority.
(7) The news security as referred to in Article 3 of the paragraph (4) of the letter g relating to the Security Activities is exercised by all the functions of the Security Unit and the associated agencies according to its authority.
(8) The prefix as referred to in Article 3 of the paragraph (4) of the letter h is exercised by the Paspampres and the Operations Command Unit is coordinated with the Polri as well as the associated agencies according to its authority.

Section 6
The further provisions of the Presidential Guard and the Vice President and his wife or husband within the country are set by the Commander of the TNI.

Paragraph 2
Overseas Security
Section 7
(1) The Security of the President and the Vice President and his wife or husband abroad, organised by the Commander of the Armed Forces, coordinated with the Minister of Foreign Affairs, the Secretary of State, the Head of the State Intelligence Agency, and the Kapolri in accordance with the His authority.
(2) The coordinated thing as referred to in paragraph (1) includes:
a.   State of the country visited;
B.   Security objectives;
c. activities plan;
D.   time plan;
e.   the strength of the troops and the means of infrastructure; and
f.   The strength of the local security forces.
(3) In terms of Security as referred to in paragraph (1), the Chief Representative of the Republic of Indonesia is coordinating with the Paspampres and the local state security forces.

Section 8
(1) Personal security as referred to in Article 3 of the paragraph (4) of the letter a performed by the Paspampres is attached and continuously wherever it is.
(2) The safeguard as referred to in Article 3 of the paragraph (4) of the letter b until the letter h is exercised by the Paspampres, coordinated with the local state security forces.

Section 9
The further provisions of the Presidential Guard and the Vice President and his wife or husband abroad are set forth by the Commander of the TNI.

The Third Part
Child Security and Son-in-law
Section 10
(1) The safekeeping of children and in-law in and out of the country is organised by the Commander of the Armed Forces.
(2) The security in the country as referred to in Article 3 of the paragraph (5) is exercised by the Paspampres and the Regional Command Unit is coordinated with the Polri.
(3) Foreign security as referred to in Article 3 of the paragraph (5) exercised by the Paspampres is coordinated with the local Representative of the Republic of Indonesia.

Section 11
Further provisions on the Child Security and the son-in-law of the President and the Vice President in the country and abroad are set by the Commander of the TNI.

The Fourth Part
Security Term
Section 12
The President and Vice President and his family have been given the Security Guard, since it is designated as President and Vice President-elect by the Electoral Commission, to the end of the term of President and Vice President.

BAB III
THE SECURITY OF THE FORMER PRESIDENT AND FORMER VICE PRESIDENT
AND HIS FAMILY
The Kesatu section
General
Section 13
(1) The former President and Former Vice President and his family are entitled to secure security with the facilities in a limited way.
(2) The security as referred to in verse (1) is given during both domestic and foreign affairs.
(3) Family as referred to in verse (1) includes a wife or husband.
(4) The security as referred to in paragraph (1) and paragraph (2) includes:
a.   Personal Security;
B.   Installation security;
C.   Activities security; and
D.   Rescue security.

The Second Part
The Security of the Former President and Former Vice President
As with the Wife or Husband
Paragraph 1
Security in the Interior
Section 14
(1) The Security of the Former President and Former Vice President and his wife or husband in the country, organized by the Commander of the Armed Forces is coordinated with the Kapolri.
(2) The coordinated thing as referred to in paragraph (1) includes:
a.   Security objectives;
B.   Startup activities;
c. time of execution of the Security;
D.   administration and logistics; and
e.   Command and control.

Section 15
(1) Personal security as referred to in Article 13 of the paragraph (4) of the letter a performed by the Paspampres is attached and continuous.
(2) The installation security as referred to in Article 13 of the paragraph (4) of the letter b executed by the Paspampres is coordinated with Polri at:
a.   used residence and lodging;
B.   Activities, events, and other installations attended;
c. materiel used during activities.
(3) The security of the activities as referred to in Article 13 of the paragraph (4) of the letter c executed by the Paspampres is coordinated with the Regional Command Unit and Polri at:
a.   activities or events attended by the Former President and Former Vice President;
B.   The travel route is being passed by the former President and former Vice President.
(4) The rescue security as referred to in Article 13 of the paragraph (4) of the letter d was carried out by the Paspampres coordinated with the Polri.

Section 16
A further provision of the Former President and Former Vice President and his wife or husband within the country is set forth by the Commander of the TNI.

Paragraph 2
Overseas Security
Section 17
(1) The Security of the Former President and Former Vice President and his wife or husband abroad, organized by the Commander of the Armed Forces is coordinated with the Minister of Foreign Affairs and the Kapolri.
(2) The Coordination as referred to in paragraph (1) includes:
a.   State of the country visited;
B.   Security objectives;
c. activities plan;
D.   time plan;
e.   personal Safety personnel; and
f.   It's a means of infrastructure.

Section 18
(1) Personal security as referred to in Article 13 of the paragraph (4) of the letter a performed by the Paspampres is attached and continuous.
(2) The security as referred to in Article 13 of the paragraph (4) of the letter b, the letter c, and the letter d executed by the Paspampres are coordinated with the local Representative of the Republic of Indonesia.

Section 19
Further provisions on the Security of the Former President and Former Vice President as well as his wife or husband abroad are set forth by the Commander of the TNI.

The Third Part
Security Term
Section 20
The former President and Former Vice President and his family are entitled to a lifetime of security, since the end of the term as President and Vice President.

The Fourth Part
The Right Refuses
Section 21
(1) The former President or Former Vice President and his family have the right to refuse to receive the Security Guard.
(2) In terms of the Former President or Former Vice President refusing as referred to in paragraph (1), the rejection is delivered to the President through the Commander of the TNI.

BAB IV
STATE GUEST SECURITY SEEXTENT
HEAD OF STATE A/HEAD OF GOVERNMENT
The Kesatu section
General
Section 22
(1) Guest Users of the State/Head of the Government are entitled to receive the Security Guard during the period of the country.
(2) The Custotry as referred to in paragraph (1) includes:
a.   Personal Security;
B.   Installation security;
C.   Activities security;
D.   Rescue security;
e.   Food security;
f.   Medical Security;
G.   News security; and
h.   Escort.

The Second Part
Country Guest Security
Section 23
(1) Guest Safety of the State of the Head of State/Head of Government, organised by the Commander of the Armed Forces, is coordinated with the Minister of Foreign Affairs, the Ambassador and/or the Chief Representative of the State concerned, the Head of the State Intelligence Agency, Kapolri, as well as the leadership of the agencies are related to his authority.
(2) The coordinated thing as referred to in paragraph (1) includes:
a.   Security Organization;
B.   Security Area;
c. Security objectives;
D.   force strength;
e.   Startup activities;
f.   Security execution time;
G.   administration and logistics; and
h.   Command and control.

Section 24
(1) Personal security as referred to in Article 22 paragraph (2) the letter a may be exercised by the Paspampres attached and continuous in the Indonesian legal region.
(2) The installation of the installation as referred to in Section 22 of the paragraph (2) of the letter b executed by the Paspampres is coordinated with the Polri and the associated agencies according to its authority on:
a.   used lodgings;
B.   Activities, events, and other installations attended; or
c. materiel used during activities.
(3) The security of the activities as referred to in Article 22 of the paragraph (2) of the letter c is exercised by the Paspampres and the Operations Command Unit is coordinated with the Polri, the State Intelligence Agency in the Region, and the related agencies correspond to the authority on:
a.   activities or events attended by the State Chief of State/Head of the Government; and
B.   The travel routes are bypassed by the State's Guest-level as the Head of State/Head of Government.
(4) The rescue security as referred to in Article 22 of the paragraph (2) of the d is exercised by the Paspampres and the Operations Command Unit is coordinated with the Polri and the associated agencies according to its authority.
(5) The food security as referred to in Article 22 of the paragraph (2) of the letter e is exercised by the Paspampres with the corresponding instance according to its authority.
(6) The medical security as referred to in Article 22 of the paragraph (2) of the letter f executed by the Paspampres is coordinated with the Presidential Doctor Team and the associated agencies according to its authority.
(7) The news security as referred to in Article 22 of the paragraph (2) of the letter g relating to activities is exercised by all the functions of the Security Unit involved and the corresponding instance corresponds to its authority.
(8) The prefixes as referred to in Article 22 of the paragraph (2) of the letter h are exercised by the Paspampres and the Operations Command Unit, coordinated with the Polri, and the associated agencies according to its authority.

Section 25
Further provisions of State Guest Safety as the Head of State/Head of the Government in the country are assigned by the Commander of the TNI.

The Third Part
Security Term
Section 26
Guests of State-level Head of State/Head of Government get a Security Guard during their stay in the country.

BAB V
THE TASK, AUTHORITY, AND RESPONSIBILITY
Section 27
(1) Commander-in-Chief of the Indonesian Armed Forces and responsible for the Security of the President and Vice President, Former President and Former Vice President and his family as well as the State Guest at the level of the Head of State/Head of Government.
(2) In carrying out the duties and responsibilities as referred to in paragraph (1) the Commander of the Armed Forces is authorized to establish the technical policy of the Security Guard.

Section 28
(1) The Minister of Defense is authorized to formulate the policy of the Presidential Guard and the Vice President, Former President and Former Vice President and his family as well as the State Guest at the level of the Head of State/Head of Government.
(2) The Minister, Kapolri, and the head of the agency as well as the leadership of the relevant agencies in accordance with his authority, are responsible for providing the support of the administration of the Presidential Guard and the Vice President, Former President and Former Vice President And his family and the State Guest at the level of the Head of State.

(4) Further provisions of support for the administration of the President and Vice President, Former President and Former Vice President and his family as well as State Heads of State/Head of Government As referred to in a paragraph (2) governed by the minister, the Kapolri and the head of the agency and the leadership of the agency are related to its authority.

BAB VI
FUNDING
Section 29
(1) Any funding of the President and Vice President, Former President and Former Vice President and his family as well as the State Chief of State/Head of Government charged to the State Budget and Shopping Budget.
(2) The Financing of Safety as referred to in paragraph (1) is allocated through the Ministry/Institution budget responsible in accordance with the tasks and functions of the Cloud Service.

BAB VII
CLOSING PROVISIONS
Section 30
Against the former President and former Vice President and his family before this Government Regulation is in effect, granted a lifetime of Care under this Government Regulation.

Section 31
At the time this Government Regulation applies, all implementation regulations relating to the Presidential Guard and Vice President, Former President and Former Vice President and his family as well as the State Chief of State/Head The government is declared to remain in force as long as it does not contradictory or not be replaced with this Government Regulation.
Section 32
This Government Regulation shall come into effect on the date of the promulctest.
