(3) The terms and regulations of the Technical Pertim-bangan issuance as referred to in paragraph (1) are further regulated by the General Director's Rules.

Section 6
(1) The provisioning of the Technical Perbalance Letter as referred to in Article 5 of the paragraph (2) is conducted based on the eligibility assessment by the Directorate of Industry Pembina.
(2) If the eligibility assessment is intended to be done through:
a. field check by the Industrial Pembina Directorate; or
B. verification by independent Surveyors that have a competency of verification in the industry.
(3) Verification as referred to in paragraph (2) huraf b includes administrative/legality aspects and technical aspects related to the type, conversion of the use of raw materials per unit of product, production capacity and/or natural the amount of raw material needs and import plans.
(4) The results of the verification as referred to in paragraph (3) are used as complementary documents in publishing the Technical Letter Letter as it is referred to in Article 4 of the paragraph (3).
(5) The verification charge as referred to in paragraph (3) is charged to the concerned Horticultural Product Industry Corporation.
(6) The charge of verification charges as referred to in paragraph (5) is set based on the azas of benefit.

Section 7
An independent Surveyor as referred to in Section 6 of the paragraph (2) of the letter b that performs the verification, is required to submit a report on the results of its verification to the Director of Industry Pemblors.

Section 8
(1) Directorate General Pembina Industry conducted monitoring of the Horticulture Products Industry Corporation which has obtained the Technical Perconsideration Letter and has conducted the import of horticultural products as the raw materials of the process Production.
(2) The monitoring results as referred to in paragraph (1) are used as the material in the coaching and control of the use of horticultural products derived from imports in the production process.
(3) The cost of monitoring the monitoring as referred to (1) is charged to the DIPA Ministry of Industry.

Section 9
A technical review letter that has been published before applicable this Ministerial Regulation is stated in accordance with the applicable terms specified in the Technical Considerations Letter in question.

Article 10
At the time of the Ordinance of this Minister, the Regulation Minister of Industry Number 01/M-IND/Per/1/2013 on the Granting Of Technical Considerations of Horticulture Products, was revoked and declared to be unapplicable.

Section 11
The Regulation of the Minister comes into effect on the date of the promulctest.

N THE GRANTING OF TECHNICAL CONSIDERATION OF HORTICULTURE PRODUCTS.

Article 1
In Regulation of this Minister referred to:
1. Horticulture is all things related to fruit, vegetables, vegetable ingredients, and floriculture, including in them mushrooms, mosses, and aquatic plants that serve as vegetables, vegetable ingredients, and/or aesthetic materials.
2. Horticultural products are all proceeds coming from fresh or processed horticulture plants.
3. The raw materials are raw materials, half-so-goods, or goods so that can be processed into half-so-or goods-so that has a higher economic value.
4. Horticultural Products Industry Company is a company that processes Horticulture Products.
5. Import of horticultural products is a series of activities incorporating horticultural products from abroad into the State of the Republic of Indonesia.
6. The next Import Horticultural Product Recommendation is called RIPH is a written statement given by the Minister of Agriculture or the Acting Officer appointed by him to the company that will import horticultural products into the region. Republic of Indonesia.

8. Industrial Permit is the permission granted to the industry/company to conduct industrial business activities issued by the authorized instance in accordance with the provisions of the laws.
9. Verification is an administrative and technical examination activity, related to the plans for the use of imported horticulture products as the raw material in the production process.
10.Surveyor is a survey company that gets authorization to perform verification.
11.Director General is the Director General of the Agro Industry, Ministry of Industry.
Twelve. Director Pembina Industry is Director of the Food, Marine and Fisheries Industry and Director of the Drink and Tobacco Industry in the environment of the Directorate General of Agro Industries.

Article 2
The Horticulture Products Industry Company may import horticulture products only as raw materials for the production process needs.

Article 3
The horticultural product which will be imported as a raw material for the production process needs as referred to in Article 2 should meet the provisions as follows:
a. have not been produced or produced within the country but do not meet the amount and/or requirements/specifications as per the production process needs;
B.   is a horticultural product associated with industrial activities according to the industry business permit owned; and
c. Not to be sold and/or scanned and used only for production processes by the industry companies in question.

Section 4
(1) The import agreement of the Horticulture Product as referred to in Section 3 is done under the Horticultural Product Import Recommendation (RIPH).
(2) The RIPH as referred to in paragraph (1) is published under the Technical Letter Letter.
(3) The granting of the Technical Consideration Letter as referred to in paragraph (2) is published by the Director General.
(4) Technical Licensing as referred to in paragraph (3) given for the longest duration of 6 (six) months.

Section 5
(1) Technical Consideration Letter Requests as referred to in Section 4 of the paragraph (2) are addressed to the Director General via the Public Service Unit (UP2) Center.
(2) The Director General publishes or rejects the request of the Technical Support Letter no later than 5 (5) business days since the request was received in full and correct by the Director of Indust
