ABOUT
APPOINTMENT OF THE FITNESS ASSESSMENT AGENCY IN ORDER
ENFORCING AND SUPERVISION OF THE NATIONAL STANDARD
INDONESIA (SNI) MANDATORY SINGLE INORGANIC FERTILIZER
WITH THE GRACE OF THE ALMIGHTY GOD
MINISTER OF INDUSTRIES OF THE REPUBLIC OF INDONESIA,
Weigh: a. that in order to exercise the implementation of the Indonesian National Standard Treatment and supervision (SNI) the Single Inorganic Fertilizer which is legally enforced with the Regulation Minister of Industry Number 19/M-IND/PER/2/2009 as it has been set up back with Regulation Minister Perindustrian Number 16/M-IND/PER/2/2012, in accordance with the provisions of the laws there has been an evaluation of the Institution of related Conformity, which is appointed by the Regulation of the Minister of Industry Number 80/M-IND/PER/7/2012;
B. that in accordance with the results of the evaluation, it is necessary to appoint and establish the Product Certification Institute and the Test Laboratory as set forth in this Regulation Attachment as the Institution for the Concurrent Assessment to perform the certification and Single Inorganic Fertilizer quality testing;
c. that under consideration as referred to in the letter a and the letter b, need to establish the Regulation of the Minister of Industry on the Appointment Of the Institution of Conformance in the Order of the Indonesian National Standard Monitoring and Oversight (SNI) Single Inorganic Fertilizer Obligatory;
Given: 1. Law No. 5 of 1984 on Industry (State Gazette of the Republic of Indonesia in 1984 No. 22, Additional Gazette of the Republic of Indonesia Number 3274);
2. Government Regulation No. 17 Year 1986 on Regulatory Authority, Coaching and Industrial Development (State Sheet of the Republic of Indonesia Year 1986 No. 23, Additional Gazette of the Republic of Indonesia No. 3330);
3. Government Regulation No. 102 Year 2000 on National Standardization (State Sheet of Indonesia 2000 Number 199, Additional Gazette Republic of Indonesia Number 4020);
4. Government Regulation Number 38 Year 2007 on the Partition of Government Affairs Between Government, Provincial Local Government and District/City Government (State Gazette of 2007 Indonesia Number 82, Extra State Sheet) Republic of Indonesia No. 4737);
5. Presidential Regulation No. 47 of 2009 on the Establishment and Organization of the Ministry of State as it has been several times amended last with the Presidential Regulation Number 91 of 2011;
6. Presidential Regulation No. 24 Year 2010 on Occupation, Duty and Functions of the Ministry of State as well as the Susunan Organization, Duty and Functions of the Ministry of State as it has been several times amended last with the Republic of the Republic Regulation Indonesia Number 92 Year 2011;
7. Decree of the President of the Republic of Indonesia Number 78 of 2001 on the National Accreditation Committee;
8. Presidential Decree No. 84 /P Year 2009 on the Establishment of the United Indonesia Cabinet United II Period 2009-2014 as it has been several times amended last by the Decree of the President of the Republic of Indonesia Number 5/P of 2013;
9. Regulation Minister Perindustrian Number 86 /M-IND/ PER/9/2009 about the Indonesian National Standard of Industrial Fields;
Ten. Regulations of the Ministry of Industry Number 105 /M-IND/ PER/10/2010 on the Organization and the Working Governance of the Ministry of Industry;
11. Regulation of the Minister of Industry Number 16 /M-IND/ PER/2/2012 on the Treatment of Indonesian National Standards (SNI) Single Inorganic Fertilizer (s);
DECIDED:
establish: MINISTRY OF MINISTRY ' S REGULATIONS ON THE APPOINTMENT OF THE INSTITUTION OF CONFORMITY ASSESSMENT IN ORDER OF THE IMPLEMENTATION AND SUPERVISION OF THE INDONESIAN NATIONAL STANDARD (SNI) COMPULSORY SINGLE INORGANIC FERTILIZER.
Article 1
Pointing:
a. The accredited Product Certification Institute (LSPro) as set forth at:
1. letter A in Appendix I of the Regulation of this Minister to perform the Single Inorganic Fertilizer SNI Certification with the type of fertilizer as listed in the letter A Appendix I referred to;
2. letter A in Annex II of the Regulation of this Minister to carry out the Single Inorganic Fertilizer SNI Certification with the type of Urea Pupuk;
b. The accredited Test Laboratory as set forth at:
1. letter B in Appendix I of this Minister Regulation to carry out Single Inorganic Fertilizer Testing with the type of fertilizer as listed in the letter B of Appendix I referred to;
2. letter B in Annex II of the Regulation of this Minister to carry out Single Inorganic Fertilizer Testing with the type of Urea Pupuk;
c. The unaccredited Product Certification Institute (LSPro) as listed on the letter C in Annex II of this Minister's Regulation to perform the Single Inorganic Fertilizer SNI Certification with the type of Urea Pupuk; and
d. The unaccredited Test Laboratory as listed on the letter D in Annex II of the Regulation of this Minister to carry out Single Inorganic Fertilizer Testing with the type of Urea Pupuk.
Article 2
(1) LSPro and Test Lab as referred to in Section 1 of the letter c and the letter d must meet the requirements as a Product Certification Institution and Test Laboratory accrued by the National Accreditation Committee (KAN) No, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no, no.
(2) If in time as referred to in paragraph (1) the LSPro and the Testation Laboratory is not yet accredited, its appointment is declared over.
Article 3
(1) The Test Laboratory as referred to in Article 1 of the letter b and the letter d is required to test the entire LSPro request as referred to in Article 1 of the letter a and the letter c and/or the technical instance with the treatment It's the same as between LSPro and the technical agencies.
(2) The testing obligation as referred to in paragraph (1) applies to testing for:
a. publishing SPPT-SNI Single Inorganic Fertilizer; dan/or
B. The supervision of the implementation of the application of the SNI Inorganic Fertilizer is mandatory.
Section 4
(1) If the appointment of LSPro as referred to in Section 1 of the letter c ends in accordance with the provisions referred to in Section 2, the LSPro in question must divert the SNI User Certificate of Use Product Certificate (SPPT-SNI) The Single Inorganic Fertilizer has been published to the LSPro which is accredited and appointed by the Regulation of this Minister.
(2) Head of the Policy Research, Climate, and Mutu Industries conduct coordination of the Inorganic Fertilizer (SPPT-SNI) Single Inorganic Fertilizer (SPPT-SNI)) as referred to in paragraph (1) in no time at least one (1) of the following: 6 (6) months.
(3) The Single Inorganic Fertilizer (sPPT-SNI) product certificate which has been diverted as referred to in paragraph (1) and (2) is stated in effect until the corresponding SPPT-SNI is terminated.
Section 5
(1) LSPro and Test Lab as referred to in Section 1 must report the results of the certification performance and testing to the Director General of the Manufacturing Industry Base and the Head of the Policy, Climate, and Mutu Review Board Industry.
(2) The report of the Erja Result as referred to in paragraph (1) consists of:
a. LSPro obligations to deliver:
1. publishing SPPT-SNI, periodic supervision of SPPT-SNI and the revocation of SPPT-SNI Single Inorganic Fertilizer, which must be struck at least 7 (seven) business days since publication;
2. Recapitulation of SPPT-SNI, periodic supervision of SPPT-SNI and the revocation of the Single Inorganic Fertilizer in a period of 1 (one) year, which must be delivered no later than 5 January of the following year;
3. LSPro; and LSPro; and the IBM Business Process Management
B. Test Lab's obligation to deliver:
1. Single Test Results Certificate (SHU) or test result of a single Inorganic Fertilizer Test which has been performed within 1 (1) month, which must be delivered at least the next 5 months;
2. The recapitulation of the Test Results Certificate (SHU) or test results of the Single Inorganic Fertilizer Test which has been performed within 1 (1) year, which must be delivered in the next 5 January of the following year;
3. The development of the competency, organization and accreditation of the Test Laboratory.
Section 6
Head of the Policy Review Board, Climate and Mutu Industries conducting the monitoring and evaluation of the implementation of the provisions as referred to in Section 2 and Section 3 as well as evaluation of the performance of the LSPro and the designated Test Testing Laboratory as referred to in Article 1.
Section 7
(1) LSPro and the Test Testing Laboratory in violation of the provisions as referred to in Article 3 and Section 5 revoked its appointment.
(2) The judgment of truth over the breach of the provisions as referred to in paragraph (1) is conducted in the assessment meeting of the Institution of Conformity of the Agreement.
Section 8
(1) LSPro which has published the SPPT-SNI Inorganic Fertilizer Sole and not appointed by this Ministerial Regulation, must divert the surveilen Pupuk in accordance with SPPT-SNI that has been published on one of the LSPro which is appointed by the rules of this Minister.
(2) BPKIMI Head must have coordinated the implementation of the SPPT-SNI Single Inorganic Fertilizer as referred to in paragraph (1) in no time at least 6 (six) months since the date of the Ordinance of this Minister is promulred.
(3) The Single Inorganic Fertilizer SPPT-SNI as referred to in paragraph (1) is stated in effect until the corresponding SPPT-SNI is terminated.
Section 9
At the time the Ordinance of the Minister is promulred, the Regulation of the Minister of Industry Number 80/M-IND/PER/7/2012 on the Appointment Of The Institution Of Suitability In Order To Perform And Supervision Of The Indonesian National Standards (SNI) Inorganic Fertilizer Single Is Mandatory, revoked and declared not in effect.
Article 10
The rules of the Minister are in effect on the date of promulgations.
