TOURISM MINISTER ' S REGULATION AND CREATIVE ECONOMY

ABOUT
THE GUIDING GUIDELINES OF THE SYARIAH HOTEL
WITH THE GRACE OF THE ALMIGHTY GOD
MINISTER OF TOURISM AND CREATIVE ECONOMY OF THE REPUBLIC OF INDONESIA,
Weigh: a. that in order to increase the power of tourism destinations in Indonesia which has the natural beauty, cultural diversity and the largest Muslim population in the world as well as making the tourist attraction of sharia in Indonesia as the main destination for World travelers;
B. that the stakeholders of the tourism industry, both the Government, the Indonesian Ulama Assembly, private and all elements of society, are working together to develop a sharia tourism effort;
c. that sharia tourism efforts are a concept that integrates sharia values into tourism activities by providing facilities and services that conform to the provisions of sharia;
D. that with the Memorandum of Understanding between the Ministry of Tourism and Creative Economy with the Indonesian Ulemency Council of Indonesia (DSN-MUI) Number NK.11/KS.001/W. PEK/2012, and B-459/DSN-MUI/XII/2012 on Development and Socialization Sharia tourism, the need to do arrangements regarding the hosting of the Syariah Hotel;
e. that under consideration as intended in the letter a, the letter b, the letter c and the letter d, need to establish the Minister of Tourism and Creative Economy about the Sponsorship Guidelines of the Syariah Hotel;
Remembering: 1. Law Number 10 of the Year 2009 on Severity (Sheet State Of The Republic Of Indonesia 2009 Number 11, Additional Leaf Of State Republic Of Indonesia Number 4966);
2. Government Regulation No. 50 of 2011 on the National Severity Development Master Plan (sheet Of State Of The Republic Of Indonesia In 2011 Number 125, Additional Gazette Republic Of Indonesia Number 5262);
3. Government Regulation No. 52 Year 2012 on Competency Certification and Certification Efforts in Tourism (Sheet Country Republic Indonesia Year 2012 Number 105, Additional Sheet Of State Republic Of Indonesia No. 5311);
4. Presidential Regulation No. 47 of 2009 on the Establishment and Organization of the Ministry of State as amended last with the Presidential Regulation Number 55 of 2013 on the Fourth Amendment to the Presidential Regulation No. 47 of 2009 about the Establishment and Organization of the State Ministry;
5. Tourism Minister ' s Regulation and Creative Economy Number PM.07/HK.001/MPEK/2012 on the Organization and the Working Governance of the Ministry of Tourism and Creative Economy;
6. Tourism Minister ' s Regulation and Creative Economy Number PM.53/HM.001/MPEK/2013 on the Standards of Hotel Effort;
7. Regulation of the Minister of Tourism and Creative Economy Number 1 Year 2014 on the Hosting Of Tourism Venture Certification;
DECIDED:
Establish: MINISTER REGULATION OF TOURISM AND CREATIVE ECONOMY ON THE GUIDELINES OF HOSTING THE SHARIA HOTEL.
Section 1
In Regulation of the Minister this is referred to:
1. Hotel effort is the provision of accommodations in a building in a building that can be equipped with service and drinking, entertainment activities and other facilities daily with the aim of acquiring an advantage.
2. Sharia is the principles of Islamic law as governed by the fatwa and/or have been approved by the Indonesian Ulama Assembly.
3. Syariah Hotel efforts are the hotel businesses whose organizers must meet the criteria of the Syariah Hotel as referred to in the Regulation of this Minister.
4. Criteria Effort Hotel Syariah is a formulation of qualification and/or classification that includes aspects of products, services, and management.
5. Hotel Syariah Hilal-1 is a group for sharia hotel efforts which are assessed to meet the entire criteria of the Syariah Hotel Necessary to serve the minimum needs of Muslim tourists.
6. Hotel Syariah Hilal-2 is a group for the Syariah Hotel effort which is judged to meet the entire Criteria of the Syariah Hotel necessary to serve the moderate needs of Muslim travellers.
7. Absolute Criteria is the provision and minimum requirement of a product, service, and management that is required to be met and implemented by the Hotel Employers so that it can be recognized as a Syariah Hotel Effort and acquire a Hotel Business Certificate Sharia.
8. Indecisive criteria are provisions and requirements on products, services, and management that can be implemented by the Syariah Hotel Employers, in order to meet the specific needs of muslim travellers.
9. Certification of the Syariah Hotel is the process of granting certificates on hotel efforts through audits to assess the suitability of products, services and management of hotel businesses with the criteria of the Syariah Hotel.
10.Certificate of the Syariah Hotel is a written proof given by the DSN-MUI of the hotel business which has met the suitability assessment of the Syariah Hotel Enterprises criteria.
The Indonesian Clerical Assembly, later called the MUI, is a platform or assembly that organizes Indonesian scholars, the zuama and Indonesian Muslim scholars to unite the movements and steps of Indonesian Muslims in the realization of mutual ideals.
12.Dewan Sharia National Assembly of Indonesian Clerics, later called DSN-MUI is part of the institutional structure of MUI acting as a Certification Institution in the field of Syariah Tourism.
13.m Minister is Minister of Tourism and Creative Economy.
14.The Ministry is the Ministry of Tourism and Creative Economy.
Section 2
The Minister ' s regulation aims to provide:
a. guidelines and understanding of the hosting of the Syariah Hotel; and
B. guidelines in the implementation of the Syariah Hotel Business certification.
Section 3
The scope of the Minister ' s Regulation includes:
a. Sharia Hotel Business Group;
B. assessment in order of certification of the Syariah Hotel Effort;
c. implementation of the Syariah Hotel Business certification; and
D. coaching and surveillance.
Section 4
Hotel employers who have acquired a Hotel Effort Award issued by LSU Tourism Fields, can host the Syariah Hotel Effort based on the provisions and requirements set out in this Ministerial Regulation.
Section 5
The Syariah Hotel effort is classed as 2 (two), that is:
a. Sharia Hilal-1 Hotel; and
B. Sharia Hilal-2 hotel.
Section 6
Classification of the Syariah Hotel as referred to in Article 5, specified by the certification of the Syariah Hotel, based on the results of the assessment of the fulfilment of the Absolute criteria applicable to the Syariah Hotel Effort, which includes the product aspect, Service aspects and management aspects.
Section 7
(1) For the purposes of certification and issuer of the Syariah Hotel Effort, must be done assessment of:
a. fulfillment of basic requirements; and
B. The fulfillment and implementation of the Absolute criteria of the Syariah Hotel, as arranged in this Minister's Ordinance.
(2) The basic requirements as referred to in paragraph (1) of the letter a, are the Hotel Enterprises certificate issued by LSU Field Tourism as referred to in Article 4.
(3) The absolute criteria applicable to the Hilal-1 Syariah Hotel Effort, and against it must be assessed, including:
a. product aspect consisting of 8 (eight) elements and 27 (twenty-seven) subelements;
B. Aspect of service consisting of 6 (six) elements and 20 (twenty) subelements; and
c. The management aspect consisting of 2 (two) elements and 2 (two) subelements.
(4) The absolute criteria applicable to the Hilal-2 Syariah Hotel Effort, and against it must be assessed, including:
a. product aspect consisting of 11 (eleven) elements and 40 (forty) subelements;
B. Aspects of services consisting of 10 (ten) elements and 28 (twenty-eight) subelements; and
c. aspects of management consisting of 3 (three) elements and 6 (six) subelements.
(5) The Unconditional Criteria applicable to the Syariah Hotel Effort, do not affect assessment in the process of Certification of the Syariah Hotel Effort and have no impact in the Syariah Hotel Business classification.
(6) The Absolute Criteria and Indecisive criteria applicable to the Syariah Hotel Effort, both for the Hilal-1 and Hilal-2, are as set forth in the Attachment which is an inseparable part of the Regulation of this Minister.
Section 8
(1) The Hotel Business that does not meet the Absolute Criterion as referred to in section 7 paragraph (3), is not yet to be classified and cannot postulate as the Hilal-1 Syariah Hotel Effort.
(2) The Hotel Business that does not meet the Absolute Criterion as referred to in section 7 paragraph (4), is not yet to be classified and cannot postulate as the Hilal-2 Syariah Hotel Effort.
(3) The Hotel Business that does not meet the Absolute Criterion as referred to in Article 7 of the paragraph (3) and verse (4), is not yet to be classified and cannot postulate itself as a Syariah Hotel Effort.
Section 9
In the event of the Hotel Business no longer meets the Absolute Criterion applicable to the Syariah Hilal-2 Hotel Effort as referred to in section 8 of the paragraph (2), but meets all the Absolute criteria applicable to the Hilal-1 Hotel, then the hotel's efforts can be classed and can be self-postulate as the Syariah Hotel Hilal 1 Business.
Section 10
Assessment of the fulfilment of the Absolute criteria applicable to the Syariah Hotel Effort in the framework of Certification and the issuer of the Syariah Hotel Effort, organized by DSN-MUI.
Section 11
(1) The Hotel Employers who have fulfilled the provisions as referred to in Article 7, and have obtained the Syariah Hotel Business Certificate issued by DSN-MUI, authorized to host and be able to self-postulate as a Hotel Effort Sharia, according to the prevailing class.
(2) In the case of the Syariah Hotel as it is referred to in paragraph (1) no longer meets and performs the applicable Syariah Hotel Business Criteria based on the Certificate of Sharia Business at its disposal, then the Syariah Hotel Employers. It is required to meet and/or correct the shortcomings that exist in the longer term of 6 (six) months, which have since been discovered for the first time the facts about the lack of contemplated.
(3) If after six (six) months as referred to in the paragraph (2) The Syariah Hotel Businessman Is not able to meet and/or repair the shortcomings, then the Hotel's concerned businessman is prohibited. Sharia Hotel effort, both based on the prevailing and overall class.
(4) In the event referred to in verse (3), then the Syariah Hotel Certification owned by the Businessman Hotel becomes unapplicable and the concerned are prohibited from the self-postulate as the Syariah Hotel Effort.
Section 12
(1) The Indonesian Ministry and Assembly of Ulama jointly undertook the coaching and supervision of the implementation of the Syariah Hotel.
(2) Coaching as referred to in paragraph (1) is conducted through the activities of socialization and advocacy on the policies and programs concerning the Effort of the Syariah Hotel.
(3) The supervision as referred to in paragraph (1) is conducted through the evaluation activities of the implementation of the Syariah Hotel, both periodically and at any time.
Section 13
The DSN-MUI delivers a report on the certification of the Syariah Hotel Effort, to the Minister periodically every 6 (six) months in a year.
Section 14
Hotel employers who have acquired the Syariah Hotel Business Certificate issued by DSN-MUI before the enactment of this Minister Regulation, can still use the Syariah Hotel Business Certificate in question to host the Syariah Hotel Effort By the expiration date, but no longer than two (two) years from the rule of this Minister, and its enlarging or penance are exercised under the Order of the Minister.
Section 15
Hotel employers who have not obtained the Syariah Hotel's Certificate of Business issued by the DSN-MUI, but have organized and/or postulate as a sharia hotel effort upon the enactment of the Minister's Ordinance, mandatory readywork with the Regulation of this Minister in the term 1 (one) year counts since the enactment of this Minister ' s Regulation.
Section 16
The Minister ' s rules are beginning to apply at the date of the invitation.
