NUMBER 25 /PERMEN-KP/2014

ABOUT THE NEW TYPE OF FISH TO BE CULTIVATED

WITH THE GRACE OF GOD ALMIGHTY

THE SECRETARY OF MARINE AND FISHERY REPUBLIC OF INDONESIA,

TO DRAW: a. that to implement the provisions of Article 7 of the paragraph (1)

letter l Act No. 31 of 2004 on Fisheries, as amended by Invite-Invite Number 45 Year 2009, need to set up a new type of fish to be cultivated;

b. that the Regulation of the Minister of Oceans and Fisheries Number PER.24/MEN/2008 on the Type of New Fish that will be cultivated, is no longer compatible with the development of fish cultivation technology and the preservation of its fish resources and its environment;

c. that based on consideration as intended in letters a and letter b, it is necessary to establish the Minister of the Marine and Fisheries Regulations on the New Fish Type that will be cultivated;

Given: 1. Law No. 31 Year 2004 on Fisheries (State of the Republic of Indonesia 2004 number 118, Additional Gazette Republic of Indonesia No. 4433), as amended by Law Number 45 of the Year of 2009

2. The Presidential Decree No. 47 of 2009 on the Establishment and Organization of the Ministry of State as amended last with the Presidential Regulation Number 55 of 2013 (State Sheet of the Republic of Indonesia 2013 Number 125);

3. Presidential Decree No. 24 of 2010 on Occupation, Duty, and Functions of the Ministry of State as well as the Organizational Functions, Duty, and Functions of the Ministry of State as amended last with the Presidential Regulation No. 56 of 2013 (State of the Republic of Indonesia in 2013 No. 126);

4. Presidential Decree No. 84 /P of the Year 2009, as amended last by Presidential Decree No. 41/P of 2014;

5. Marine Minister and Fisheries Regulation Number PER.15/MEN/2010 on the Organization and Works of the Ministry of Marine and Fisheries;

DECIDED:

SET: THE REGULATION OF MARINE AND FISHERY MINISTERS ABOUT THE NEW FISH TYPE. CULTIVATED.

CHAPTER I OF THE GENERAL PROVISION

Article 1 In this Ministerial Regulation is referred to:

1. A fish is any kind of organism that is all over or part of its life cycle in a waterway environment.

2. The new fish that will be cultivated are fish derived from domestication, introductions, breeding, and genetic engineering products.

3. Domesticated fish is a type of wild fish that has adapted to the cultivation environment and can reproduce, at a minimum in two (two) generations.

4. Introduced fish are fish that are not native and/or not from the recognizable Indonesian land and sea nature of the sea and/or

is known to be incorporated into the State fisheries management area of the Republic of Indonesia.

5. A breeding fish is a fish that is produced from a series of activities to maintain purity, producing existing varieties or varieties of fish and/or to produce a new type or variety that is superior.

6. Genetic engineering products are fish resources and other aquatic species of aquatic species that most or all of their life cycles are in the water produced by the application of genetic engineering.

7. Fish cultivation is an activity for nurturing, raising, and/or breeding the fish and harvesting its results in a controlled environment, including activities that use ships to load, transport, store, cool, handle, Process, and/or preserve it.

8. Fish seeds are fish in a particular age, shape, and size that are immature, including eggs, larvae, and pure algae.

9. The seed is a certain immature fish, shape, and size, including eggs, larvae, and a pure algae that is cultivated for the purpose of extermination and not being used as a parent.

10. Seed bina is a certain immature fish, shape, and size, including eggs, larvae, and the pure algae that is cultivated to be the parent.

11. The parent candidate is a selection fish prepared to be a parent.

12. Fish is a species of fish at a certain age and size that has grown and is used to produce fish seeds.

13. The parent and/or parent-type candidate is the parent and/or parent of the breeding results under the supervision and mastery of the glorification of the breeding.

14. The parent and/or base parent is the parent candidate and/or parent of the first offspring of a parent-type parent to meet the basic master class quality standard.

15. The parent and/or principal parent is the parent and/or parent of the first offspring of a primary parent or parent-type parent who meets the principal parent-class standard and is supervised by the government after the release of the type and/or variety fish.

16. Each person is an individual or a corporation.

17. Corporations are a collection of people and/or wealth that is organized as both a legal entity and not a legal entity.

18. The Minister is the minister who organizes government affairs in the field of fisheries.

19. The Director General is the director general carrying out technical duties in the field of cultivation fisheries.

20. Head of the Agency is the head of the body carrying out technical duties in the field of marine research and development and fisheries.

Article 2

(1) The Regulation of the Minister is intended as a reference to the setting of new types of fish to be cultivated.

(2) The Regulation of the Minister is set with the aim of adding to the diversity of cultivated fish types, increasing the income and well-being of fish fertilization based on the principle of the management of fish resources, protection Germ plasma, and certainty in doing business.

Article 3 of the scope The rules of this Minister include:

a. Origin; b. testing; c. release; and d. monitoring and evaluation.

BAB II

ASAL Article 4

(1) The type of new fish to be cultivated is derived from: a. fish outcomes domestication;

b. The fish results are introduced;

c. fish the breeding result; and d. fish genetically engineered products.

(2) The type of new fish that will be cultivated as referred to in paragraph (1), can be:

a. seed; and b. parent and/or fish parent.

(3) A new type of fish to be cultivated which is a seed as referred to in paragraph (2) the letter a consists of:

a. the seed of a bar; and b. Bina seed.

(4) The type of new fish that will be cultivated that is the parent and/or fish parent as referred to in paragraph (2) the letter b consists of:

a. parent and/or parent-type candidate; b. parent and/or basic parent/or parent candidate; and/or

c. prospective parent and/or principal parent.

Article 5 of the Terms of the new fish to be cultivated derived from a genetically modified product fish as referred to in Section 4 of the paragraph (1) the letter d is governed by the Minister Rule.

CHAPTER III TESTING

Article 6

(1) Any person or government agency that will hold a new fish type shall be cultivated must do the testing.

(2) Testing as set forth in the (1) section of the (1) above: physical testing; b. physiology test; c. genetic test; and d. disease resistance test.

Article 7 (1) Physical test as referred to in Section 6 of the paragraph (2) letter a includes

total length, total weight, length of body circumference, long-term comparison of the head with length, headless weight, and color.

(2) The physiology test as referred to in Article 6 of the paragraph (2) letter b includes the characteristic growth, environmental toleration, and proximal analysis or meat quality.

(3) The genetic test as referred to in Article 6 verse (2) of the letter c includes the characteristic DNA following the standard method with the diversity parameter genetics and heterosigosity.

(4) The test of disease resistance as referred to in Article 6 of the letter d includes resistance to diseases caused by fungi, parasites, bacteria, and viruses.

(5) Further provisions concerning the the layout of the test method as referred to in Section 6 of the paragraph (1) is governed by the Rule of the Head of the Agency.

BAB IV

RELEASE Article 8

(1) Any new fish which shall be cultivated should obtain the assignment of the release of the Minister.

(2) To obtain the designation as referred to in paragraph (1), any person or Government agencies must submit a request in writing to the Head of the Agency accompanied by the requirement: a. Academic script; b. proposal of a new fish type name to be cultivated; and c. A new type of fish photo that will be cultivated with size 5

(five) R.

(3) Academic manuscripts as referred to in paragraph (2) the letter a contains:

a. the results of the test results, as referred to in Section 6 of the paragraph (2); b. an explanation of the suitability, excellence, and benefits that

consists of the technological, social aspects of the economy, and the prospective new fish-type environment to be cultivated; and

c. truth genealogy description and the method of domestication, Introduction, or glorification.

(4) Based on the request as referred to in paragraph (2), the Head of the Agency performs the assessment and in the most prolonged time 45 (forty-five) days of work since the request is received in complete conveyation:

A. recommendation to the Minister if based on the assessment results, a new fish type to be cultivated can be done by release; or

b. The rejection letter to the applicant, accompanied by an excuse based on the results of the assessment, a new type of fish to be cultivated could not be done by release.

(5) More terms on the form and layout of the drafting of the Academic Script are set up with the Chief Body Regulation.

Article 9 (1) Minister based on the recommendation as referred to in Section

8 verse (4) the letter a set the release of a new type of fish to be cultivated with the Decree of the Minister.

(2) The release of the new fish-type release which shall be cultivated as referred to paragraph (1) at least contains: a. name of the new fish type to be cultivated; b. description, consisting of:

1) taxonomy; 2) phenotypic and genotype superiority; 3) reproductive character; 4) fish health status; 5) tolerance to the environment; and 6) the parent supply.

c. photo of colored fish. (3) The expiration of a new fish-type release designation

is cultivated with the characteristic fish type.

Article 10 (1) Assessment as referred to in Article 8 of the paragraph (4) includes:

a. excellence; b. cedar; c. conformity of fish type; and d. benefit.

(2) The assessment of excellence as referred to paragraph (1) of the letter a: a. growth speed; b. power resistant to fish disease; c. durability against tolerance or environmental change

waters;

d. The speed of production; and the e. diverse size.

(3) The edar assessment as referred to in paragraph (1) of the letter b among others:

a. free from pests and certain fish diseases and/or pests and quarantine fish diseases;

b. does not damage the environment; c. does not harm the sustainability of the fish resources; and d. no harm to human health.

(4) The assessment of the suitability of the fish type as referred to in paragraph (1) of the letter c among others:

a. Genealogy truth; b. truth descriptions; and c. truths of domestication, introduction, or glorification.

(5) The assessment of the benefits as referred to the verse (1) of the d letters between others includes:

a. Technological aspects; b. economic aspects; c. social aspect; and d. environment aspect.

Article 11

Giving the name of a new type of fish to be cultivated should meet the provisions as follows:

a. reflect the identity of the type and/or variety in question; b. does not create characteristics, value or identity of an

type and/or variety;

c. does not use any existing type and/or variety names; d. does not use the name of the State symbol; e. can use the name of the area, the Hall, the Breeding Unit, the Company,

or the individual with an abbreviation;

f. no more than 30 (thirty) letters; g. is not a trademark; h. does not use foreign language; i. was not interpreted as enlarging the actual value of the

variety;

j. not using punctuation; and

k. not use the name type or species or the latin name for the use of a single word.

CHAPTER V MONITORING AND EVALUATION

Article 12

(1) The Director General conducts monitoring and evaluation of the newly cultivated species of fish who have obtained the release decision.

(2) Monitoring and evaluation as referred to in paragraph (1) includes: a. availability and distribution; b. consistency of description, including:

1) phenotypic and genotyping advantage; 2) reproductive character; 3) fish health status; and 4) tolerance for environment.

(3) Monitoring and evaluation as referred to in paragraph (1) are performed at least every 6 (six) months at once.

(4) In terms of monitoring and evaluation it is known that the new fish cultivated does not correspond to the description on the release decision, the Director General proposes a withdrawal new types of cultivated fish that have gotten the release decision to Minister.

(5) Further provisions on the manner of the monitoring and evaluation of new types of cultivated fish are governed with the Regulation of the Director General.

BAB VI

provisions CONCLUDING Article 13

At the time of the Ministerial Ordinance This is in effect, the Regulation of the Minister of Marine and Fisheries No. 24/MEN/2008 on the Types of New Fish that will be cultivated, revoked and declared do not apply.

Article 14 of the Minister ' s Regulation begins to take effect on the date of promulgations.
