FOR THE ESTABLISHMENT OF THE COMPANY PERSEROAN (PERSERO)
IN THE FIELD OF CEMENT INDUSTRY
PRESIDENT OF THE REPUBLIC OF INDONESIA,
Weigh: a. That in order to support national development, especially in the field of industrial development, is necessary to increase cement production in order to meet the increasing needs of the industry.
B. that in the case of an upper-letter, a corporation in the form of the Company (PERSERO) is referred to in the Act No. 9 of 1969;
c. that the link of the PT. Cement Gresik has experience and expertise in the construction and management of the cement industry, hence it is considered necessary to include the company in the Persero referred to;
D. that in accordance with the provisions of
Article 2 paragraph (1) of the Government Regulation No. 12 of 1969, the inclusion of the capital of the Republic of Indonesia in the framework of a Perseroan Company (PERSERO) is established with the Regulation of the Republic of Indonesia. The government.
Remembering: 1. Section 5 of the paragraph (2) of the Basic Law of 1945;

DECIDED:
SET: GOVERNMENT REGULATION ON THE INCLUSION OF THE CAPITAL OF THE REPUBLIC OF INDONESIA FOR THE ESTABLISHMENT OF THE COMPANY PERSEROAN (PERSERO) IN THE FIELD OF CEMENT INDUSTRY.
BAB I
THE COUNTRY ' S CAPITAL INCLUSION
Section 1
(1) The State of the Republic of Indonesia conducts its inclusion in the stock capital of the Company Perseroan (PERSERO) in the area of the cement industry in Madura, subsequently in the Regulation of the Government of this is called PERSERO.
(2) The PERSERO in verse (1) was established jointly between the State of the Republic of Indonesia with PERSERO PT. Cement Gresik, with a comparison of its share capital would be further determined by the Minister of Finance.

INTENT AND PURPOSE
Section 2
The purpose and purpose of PERSERO as referred to in Article 1 is to undertake the activities of the cement industry, in the sense of its breadth-breadth.
BAB III
PERSERO CAPITAL
Section 3
(1) The basic Modal PERSERO is divided over the shares in accordance with the provisions of Article 1 of the Government Regulation No. 24 of 1972.
(2) The specified capital of PERSERO that is placed and which is appointed will be established by the Minister of Finance based on the calculations conducted by the Treasury Department together the Department of Industry.
(3) Other provisions of PERSERO ' s application including provisions concerning the base capital of PERSERO are further set forth in the PERSERO Basic Budget.
(4) The PERSERO Opening Neraca is set by the Minister of Finance.
BAB IV
THE IMPLEMENTATION OF THE PERSERO ESTABLISHMENT
Section 4
The implementation of the establishment of PERSERO as referred to in Article 1 is done according to the provisions of the Code of Trade Law (Staatsblad Year 1847 Number 23) as has been several times altered and plus, lastly with Law No. 4 of 1971 with regard to provisions meant in Government Regulation No. 12 of the year 1969 jo. Government Regulation No. 24 of 1972.
Section 5
(1) The completion of the PFRSERO is established to the Minister of Finance in accordance with the provisions of Article 3 of the Government Regulation No. 12 of 1969.
(2) The Finance Minister may hand over power as referred to in paragraph (1) with the accompanying substitution right to the Minister of Industry provided that the Basic leniency Plan of PERSERO should receive approval first from the Minister of Finance.

Section 6
Things that have not been set up in this Government Regulation will be set in its own.
Section 7
This Government Regulation shall come into effect on the date of the promulctest.
