PRESIDENT OF THE REPUBLIC OF INDONESIA,

Weighing: that in the course of implementation of the provisions regarding the neutrality as set in Act No. 21 of l992 on the Voyage, it is seen necessary to establish a Government Regulation on the Kenavigasian;

Remembering: 1. Section 5 of the paragraph (2) of the Basic Law of 1945;
2. Act Number 21 of 1992 on Voyages (Sheet State Of The Republic Of Indonesia In 1992 Number 98, Additional State Sheet Number 3493);

BAB I
UMUM PROVISIONS

Section 1
In this Government Regulation referred to by:
1. Kenavigasy is an activity that includes everything related to shipping navigation, shipping telecommunications, hydrography, grooves and crossings, sweeteners, shipbuilding handling, salvage, and underwater jobs, for Cruise safety interests.

15. Salvage is a job to provide aid to the ship and/or its cargo which is in a ship accident or in a state of danger in the waters including lifting a ship's skeleton or any underwater hurdle or other object that is not permanently and is not intended to be installed at the bottom of the sea.
16. underwater work is a job related to installation, construction or ship, which is performed under water or a work under a special water.
17. Building or installation is any construction either is above and/or below the surface of the waters.
18. Indonesian waters are the territorial sea of Indonesia and the waters of the archipelago and its deep waters.
19. The Indonesian legal body is a body of business owned by the state and/or private and/or cooperative.
20. The Minister is a responsible Minister in the field of aviaviality.

BAB II
CRUISE NAVIGATION AIDS AND
CRUISE TELECOM

The First Part
Common

Section 2
(1) For the sake of sailing safety, the Minister sets out:
a. The technical requirements of the shipping and telecommunications navigation;
B. the requirements of any building or installation to be built and/or set up around the installation of the cruise navigation and cruise telecommunications;

The Second Part
The staging of

Section 3
(1) The means of helping sail navigation and shipping telecommunications are carried out by the Government.
(2) The means of helping navigation and shipping navigation as referred to in verses (1) include activities:

(3) The provision, operation and maintenance of the means of navigating the navigation as referred to in paragraph (2) can be performed by a special port manager with the requirements specified.

Section 4
(1) To carry out the event referred to in Article 3 of the paragraph (1) undertaken by the Government, the Minister established a unit of service for the navigation of shipping and telecommunications.
(2) The service unit as referred to in paragraph (1) serves:
a. implement the operation, maintenance and supervision of the shipping navigation and cruise telecommunications;
B. Conducting surveillance of the means of aid of cruise navigation executed by the special port manager.
(3) The further provisions of the unit of service as referred to in paragraph (1) and paragraph (2) are governed by the Decree of the Minister.

Section 5
(1) The existence of, the operation and maintenance of the means of navigating the cruise control by the special port manager as referred to in Article 3 of the paragraph (3) must meet the requirements:
a. Hosted shipping must meet technical requirements;
B. the financing source of the special port manager is concerrvision as referred to in paragraph (1), paragraph (2), paragraph (3), and paragraph (4) are governed by the Decree of the Minister.

Section 21
(1) Any building or installation that no longer meets the provisions as referred to in Article 20 of the paragraph (1) and the verse (2) and that is not used again, must be dismantled so that it does not interfere or compromise the safety of the sail.
(2) The owner of the building or installation is responsible for the dismantling as it is referred to in paragraph (1).
(3) The demolition as referred to in paragraph (1) must be exercised in accordance with the provisions applicable and reported to the Minister to be announced.
(4) The further provisions of the dismantling and responsibility of the owner against the dismantling as referred to in paragraph (1), paragraph (2), and paragraph (3) are governed by the Decree of the Minister.

Section 22
(1) For the benefit of sailing safety, on any building or installation as referred to in Article 20 of the paragraph (1), must:
a. Installed the means to help navigate the cruise to the applicable provisions;
B. set a safety zone around it;
c. announced via the beach radio station;
D. announced via Indonesian sailor News.
(2) Installation of the cruise navigation means in paragraph (1) letter a, performed by the owner of the building or installation.
(3) The penetration of the safety zone and the announcement via the beach radio station as referred to in paragraph (1) the letter b and the letter c, performed by the Minister.
(4) Announcement through Indonesian Marine News as referred to in paragraph (1) letter d, carried out by the authorized instance.

Section 23
(1) Any activity or thing in the waters that can harm the safety of the sailing must be set a safety zone and it is announced.
(2) The charge of the activities or the thing as referred to in verse (1) notifies the Minister.
(3) Based on the notice as referred to in paragraph (2) the Minister establishes the safety zone and announces.
(4) Further provisions of the manner of notification, the designation of the safety zone and the announcement as referred to in paragraph (2) and paragraph (3) are governed by the Decree of the Minister.

BAB IV
SWEETENER

The First Part
The Hosting Of The Control

Section 24
(1) For the benefit of safety, order and the agility of the ship ' s traffic on certain areas of water is designated as the mandatory waters of pandu and the extraordinary waters of pandu.
(2) On the waters that are designated as obligatory waters as referred to in verse (1) are mandatory guidance on ships of the gross tonnage sized GT 500 or more.
(3) On the waters that are designated as the outstanding pandu waters as referred to in verse (1) the service of the guidance is carried out at the request of the nakhoda.
(4) The hosting of the guidance as referred to in verse (1) is carried out by the Government and its implementation may be devolve to the port and/or port manager.
(5) The hosting of the board by the port organizer and/or port manager must be:
a. provide a meeting officer who meets the requirements;
B. provides a means of help and a guidance infrastructure that meets the requirements;
c. provide a reasonable and proper guidance service;
(6) Further provisions regarding the hosting of the guide are set up with the Minister ' s Decision.

Section 25
(1) Conscription of compulsory water and external pandu are based on the criteria/aspects that can affect the safety of the voyage.
(2) The further provisions of the designation of compulsory waters and the extraordinary waters of pandu as referred to in paragraph (1) are governed by the Decree of the Minister.

Section 26
The mandatory provision of the guide as referred to in Section 24 of the paragraph (2) does not apply to:
a. the battleship;
B. country ships used for governance duties;
c. vessel bertonnage less than the GT 500.

Section 27
(1) The charge of the sweeteners is imposed for the ships given the guidance service.
(2) The charge of the guidance is imposed on the basis of the structure and tariff group specified by the Minister.
(3) Besaran tariff on guidance for the guidance hosted by the Government, set with Government Regulation.
(4) The sponsorship of the Program, as specified in Section 5 (4), the rate set by the Port Authority or the Port Manager is based on the structure and/or the Port Authority ("Host"). The fare class is set by the Minister.

Section 28
The cost of the guidance as referred to in Article 27 is not imposed for:
a. country ship or private vessel used for governance duties;
B. the battleship;
c. hospital ship;
D. The ship that enters the harbor for the purpose of asking for help and rescue of the human soul;
e. The ship belongs to an international organization that is not used for the benefit of the business.

Section 29
(1) For the safety and order and the agility of the execution of the water area as referred to in Article 24 of the paragraph (1) the Managing Officer of the Safety Function or the Head of the Port acts as the supervising supervisor.
(2) The further provisions of the governance of the supervision of guidance as referred to in paragraph (1) are governed by the Decree of the Minister.

Section 30
(1) The Nakhoda of the ship that serves the mandatory waters of the pandu in a fixed and orderly way less than 24 (twenty-four) hours and has the ability and meets the requirements, may not use the officer of the pandu.
(2) Further provisions as referred to in paragraph (1) are governed by the Decree of the Minister.

The Second Part
The Requirements In The Guidance


Section 31
(1) The execution of a guide in the water area as referred to in Article 24 of the paragraph (1) must be performed by the panding officer.
(2) The officer of the pandu as referred to in paragraph (1) must meet the requirements:
a. berijdiplomexpert sailor nautika;
B. have a sailing experience;
c. pass the education and training of the pandu;
D. Master of the local requirement of the local pandu/extraordinary waters;
e. To be able to perform a guide in the waters of the mandated pandu/outer pandu is outstanding; and

The Second Part
Hosting Salvage and/or Underwater Works

Section 42
(1) Salvage Activities and/or underwater jobs may only be implemented by the salvage company and/or underwater work.
(2) The implementation of the salvage activities and/or underwater work must meet the technical requirements that include the working method, the completeness of the equipment and the workforce.
(3) The supervision of the salvage activities and/or the underwater work as referred to as verse (2) is exercised by the Minister.
(4) In certain circumstances the company ' s salvage and/or underwater work can conduct operations cooperation with other similar companies both national and foreign.
(5) Further provisions concerning technical requirements, supervision, operating cooperation as referred to in paragraph (2), paragraph (3) and paragraph (4) are governed by the Decree of the Minister.

Section 43
(1) In the activities of the salvage and/or underwater work as referred to in Article 42 of the dive is done.
(2) The dive activities as referred to in paragraph (1) are carried out by divers who meet the health requirements, skills and skills in accordance with applicable laws.
(3) The dive as referred to in paragraph (2) is required to be equipped with a lamic submarine operation and a dive operation manual.
(4) The skill and diving skills as referred to in verse (1) are obtained through education and training.
(5) Further provisions concerning the requirements of the diver, the requirements of the diving equipment, the manual operation of diving operations, education and diving training as referred to in verse (2), paragraph (3), and verse (4) are governed by the Decree of the Minister.

Section 44
(1) The salvage and/or underground work may only be carried out by the Indonesian legal entity in the form of a Limited Perseroan entity (PT), the State-owned Business Agency, the Regional Owned Entity, or the Koperative.
(2) To be able to undertake the activities of the salvage and/or underwater work as referred to in paragraph (1) is required to have a salvage and/or underwater work permit.
(3) The business permit as referred to in paragraph (2) is provided for the term as long as the company concerned is still running its business activities.

Section 45
(1) To obtain a salvage and/or under-water work permit as referred to in Article 44 of the paragraph (2) must be met with the requirements of at least as follows:
a. have or master the work equipment in the field of salvage or underwater work;
B. have an expert power consisting of experts who have the ability to plan and carry out a salvage operation or underwater job, and a dive team consisting of 4 (four) divers;
c. have the founding acte;
D. have the company ' s domicile certificate;
e. Has a required number of people who have access to the IBM Cloud Service.
(2) The further provisions of the requirements as referred to in paragraph (1) are governed by the Ministerial Decree.

Section 46
(1) The request of a salvage and/or underwater work permit as referred to in Article 44 of the paragraph (2), submitted to the Minister.
(2) The granting or rejection of a permit as referred to in paragraph (1) is granted within a period of 14 (fourteen) business days after the full request is received.
(3) The rejection of a salvage effort permit and/or underwater work as referred to in paragraph (2) is given in writing accompanied by reason of rejection.
(4) Further provisions of the manner of application, giving, and rejection of the business permit as referred to in paragraph (1), paragraph (2) and paragraph (3) are governed by the Decree of the Minister.

Section 47
(1) The salvage and/or underwater jobs that have obtained the business permit are required to:
a. Fulfill the obligations that are specified in the business permit in the event of a change in the form of a salvage and/or underwater job;
B. report the company or the company ' s domicile;
c. report on the activities of the business annually to the licensor.
(2) The further provisions of the manner of reporting the reporting activities as referred to paragraph (1) of the letter c, are governed by the Decree of the Minister.

Section 48
(1) If the company ' s salvage and/or underwater work violates the provisions as referred to in Article 47 of the paragraph (1), it is imposed administrative sanction.
(2) the administrative sanction as referred to in paragraph (1) is given through a written warning process of 3 (three) times-participating in the middle of each month.
(3) If the warning as referred to in paragraph (2) is not inhospitable, it is continued with a freeze of a salvage and/or underwater work permit for a term of 1 (one) month.
(4) If the term of the suspension of a salvage and/or underwater job as referred to in paragraph (3) has passed and there is no repair attempt, then a salvage and/or underwater work permit is revoked.

Section 49
A salvage and/or underwater job permit can be revoked without going through the alert and freezing clearance process in the case of the company concerned:
a. conduct activities that compromise the security of the country; or
B. obtaining a salvage and/or underwater work permit in an unauthorized manner.

BAB VI
THE TRANSITION PROVISION

Section 50
By force of this Government Regulation, all the lower laws of the Government Regulations governing the provisions of the service of the Avivus are declared to remain in effect, as long as it is not contradictory or not replaced with new ones based on this Government Regulation.

BAB VII
CLOSING PROVISIONS

Section 51
This Government Regulation shall come into effect on the date of the promulctest.

Section 40
