M E M U T U S K A N: setting: GOVERNMENT REGULATION of KENAVIGASIAN.
CHAPTER I GENERAL PROVISIONS article 1 In this Government Regulation is: 1. CHAPTER II the CRUISE NAVIGATION AIDS and TELECOMMUNICATIONS Public CRUISE the first part of article 2 (1) for the purposes of the safety of sailing, the Minister sets out: a. technical requirements of navigation AIDS and cruise shipping Telecom;

Article 4 (1) to carry out organizing as stipulated in article 3 paragraph (1) are carried out by the Government, the Minister established the unit of navigation aids servicing cruise and cruise's telecommunications. (3) the provisions on service unit referred to in subsection (1) and paragraph (2) subject to the decision of the Minister.
Article 5 (1) Procurement, operation and maintenance of navigation aids cruise by special ports Manager as mentioned in article 3 paragraph (3) must meet the requirements: a. the cruise navigation aids are held must meet technical requirements; b. sources of financing of the concerned special port manager;

Article 6 (1) the operation and maintenance of navigation AIDS and cruise shipping Telecom carried out by officers of the unit of navigation aids servicing cruise and shipping Telecom which meet the requirements of the health, education, and skills. (2) health requirements referred to in subsection (1) include the following: a. a healthier physical and spiritual, not color blind, is not hearing-impaired and no stuttering; b. free of narcotics and illicit drugs;

(3) education requirements referred to in subsection (1) at least suitably high school or equivalent, and include navigation AIDS education certificate and/or shipping Telecom cruise.
(4) the requirements of the skills referred to in subsection (1) includes the skills to operate, maintain and repair the equipment navigation AIDS and/or shipping Telecom cruise.
(5) further Provisions on the requirements of the health, education, and skills referred to in subsection (2), subsection (3) and subsection (4) is set by a decision of the Minister.
Article 7 (1) to ensure the security and safety of navigation AIDS and cruise shipping Telecom established zones of security and safety around the buildings and installations.

Article 8 (1) of the ship sailing in the waters of Indonesia cost the use of navigation aids voyage are calculated based on gross tonnage of the vessel.

d. hospital ships;

(3) further Provisions regarding broadcasting, broadcasting frequencies and coastal radio station announcer referred to in subsection (2) are governed further by a decision of the Minister.

Article 12 (1) the owner and/or operator of the vessel shall be obliged to repair and/or replace the cruise navigation AIDS, telecommunications facilities and cruise the Groove cruise on the rivers and lakes that suffered damage and/or obstacles caused by the operation of their ships.
(2) repair and replacement referred to in subsection (1) done in the time limit of sixty (60) calendar days, so the cruise navigation AIDS, telecommunications facilities and cruise the Groove cruise on the rivers and Lakes can serve as before.
(3) in the interest of safety of navigation aids owners sailing cruise, telecommunications facilities and cruise the Groove cruise on lakes and rivers can repair and/or replace damage and/or the obstacles referred to in subsection (1) without prejudice to the responsibility and liability of the ship owner and/or operator of the ship.
(4) if the time limit of sixty (60) calendar days referred to in subsection (2) and paragraph (3) does not do repair or replacement by the owner of the vessel, or the owner of the cruise navigation AIDS, telecommunications facilities and the Groove cruise, cruise on the rivers and lakes, the Minister performs the repair and replacement costs charged to the owner and/or operator of the ship referred to in subsection (1).
(5) every person or legal entity that Indonesia because its activities result in disorder and/or not functioning telecommunications cruise, obliged to fix and/or change the value of the damage and/or construction so that it can soon be functioning as before.
(6) the provisions on the obligation to repair and/or replacement of the cruise navigation AIDS, telecommunications facilities and cruise the Groove cruise on lakes and rivers, the time limit of repair/replacement, and the replacement of the magnitude of damage referred to in subsection (1), subsection (2), subsection (3), subsection (4) and paragraph (5) subject to the decision of the Minister.

Article 14 (1) of organizing the Groove cruise was carried out by the Government.

Article 16 (1) the work of dredging on the Groove cruise and/or port area must get permission from the Minister.
(2) further Provisions concerning the permission referred to in subsection (1) is governed by the decision of the Minister.
The second part of the system Routes Traffic Ordinance and article 17 (1) for the purposes of safety and smooth sailing on the waters of certain Ministers set a route system that includes: a. dividing traffic schemes at sea;

b. two-way routes;

c. the recommended detour line;

d. water route;

e. areas that should be avoided;

f. inland traffic areas;

b. consideration of traffic density;

c. State of the weather.
(3) the route of the System referred to in subsection (1) must be listed in the map of the sea and/or cruise Guide and should be announced by the relevant authorities.
Section 18 of the Ordinance-traffic in the waters is done based on the applicable legislation.

g. marine space;

h. recommendations of international organizations.
The third part of the building or installation of article 20 (1) for the purposes of the safety of sailing at any establishment and/or alteration of buildings or installations in the waters should be: a. eligible placements, pemendaman and labelling;

b. considering the development of the cruise;
c. do not cause damage to the building or any other installation.

(2) the establishment and/or alteration of the building or installation as a ubiquitous referred to in subsection (1) must first obtain approval from the Minister.

(5) further Provisions concerning the requirements and procedures for the granting of the approval and supervision referred to in subsection (1), subsection (2), subsection (3), and subsection (4) is set by a decision of the Minister.
Article 21 (1) every building or the installation no longer meets the conditions referred to in article 20 paragraph (1) and paragraph (2) and which are not used anymore, had to be demolished so as not to interfere with or endanger the safety of sailing.
(2) the owner of the building or installation responsible for dismantling as referred to in paragraph (1).
(3) Dismantling referred to in subsection (1) must be carried out in accordance with the provisions applicable and reported to the Minister to announced.
(4) further Provisions regarding the demolition and the responsibility of the owner against dismantling referred to in subsection (1), subsection (2), and subsection (3) is set by a decision of the Minister.
Section 22 (1) for the purposes of the safety of sailing, on each building or installation referred to in article 20 paragraph (1), shall be: a. the cruise navigation aids were installed in accordance with applicable;

b. set the safety zones around them;

c. announced through the radio station coast;

d. Seaman News announced through Indonesia.

Article 23 (1) any activity or thing in waters that could jeopardize the safety of sailing safety zone should be established and announced.

CHAPTER IV SCOUTING Scouting organization of the first part of article 24 (1) in the interest of safety, order and the smooth traffic of ships in certain waters of the areas designated as compulsory waters and the waters of pandu pandu is incredible.

Article 28 Scouting Costs as mentioned in article 27 are not subject to: a. the ship of State or private boat used for the task of governance;

b. ships;

c. hospital ships;
d. ships that entered the port for the purposes of requesting help and Ministry of the human soul;
e. Ship belonging to international organisations that are not used for the benefit of Commerce.

(5) further Provisions regarding the Scouting Service Ordinance referred to in subsection (1) is governed by the decision of the Minister.
Article 33 Against a ship that did not get a proper Scouting service, the ship's captain or a leader can be reported with oral and/or written to Scouting supervisor.

(6) further Provisions regarding the procedures for reporting, types of tagging, media announcements and mounting procedures, maintenance and implementation of the survey as well as the appointment of the cruise navigation aids referred to in subsection (1), subsection (2), subsection (3) and subsection (4) is set by a decision of the Minister.
Article 37 (1) the owner of a ship is responsible and must get rid of the skeleton ship and/or charge that interferes with the safety of sailing upon a determination as referred to in article 36 paragraph (2). (2) the removal referred to in subsection (1) must be made: a. within the time limit set by the Minister; and b. to the place designated by the Minister;
(3) the determination of the boundaries of time and place referred to in subsection (2) are assigned based on the operational interests of the cruise and maritime space.
(4) if within the time limit specified, as mentioned in paragraph (3), the owner of the ship has yet to carry out its responsibilities and its obligations, the Minister is authorized to appoint, remove or destroy all or part of the ship's frame and/or charge for the costs of ship owners.
(5) the authority of the Minister referred to in subsection (4) is carried out through the efforts of the giving of warnings ought to be and other administrative actions.
(6) further Provisions regarding the procedures for the imposition and the magnitude of the costs as well as the type of warning and administrative acts referred to in subsection (2), subsection (3), subsection (4) and paragraph (5) subject to the decision of the Minister.
Article 38 (1) to fulfill responsibilities as stipulated in article 37 paragraph (1), the owner of the vessel is obligated to insure its responsibility.
(2) the obligation of insuring the responsibility referred to in subsection (1) does not apply to: a. the ships of war;

b. the ship of State that are used to perform the tasks of Government;

c. sailing and motor yachts;

d. motor boat with gross tonnage (GT) of less than 35.
(3) the obligation of insuring and exclusions referred to in subsection (1) and subsection (2) does not eliminate the liability of ship owners to get rid of the skeleton crew and/or charge that interferes with the safety of sailing.
(4) the magnitude of the removal of the ship's framework insurance coverage based on the gross tonnage of the ship and/or national or international provisions.
(5) the provision of more about stages of enactment of the Ordinance, liability insurance pengasuransian insurance coverage and quantity, the procedures for supervision of the implementation of the obligations referred to in subsection (1), subsection (3) and subsection (4) is set by a decision of the Minister.
Article 39 ship owners who do not carry out obligations of the removal of the skeleton crew and/or charge referred to in Article 37 paragraph (1), having exceeded the time period referred to in Article 37 paragraph (2) of the accident resulting in the cruise, is obliged to pay compensation to parties who had an accident in accordance with the applicable.

(5) further Provisions regarding technical requirements, supervision, joint operations as mentioned in paragraph (2), subsection (3) and subsection (4) is set by a decision of the Minister.
Article 43 (1) in the activities of salvage and/or work under water as stipulated in article 42 conducted dives.
(2) the diving Activities referred to in subsection (1) done by divers who meet health requirements, skills and skill according to applicable legislation.
(3) a diver as mentioned in paragraph (2) obligatory equipped with scuba gear that be eligible operations and operating guide dives.
(4) the competence and skills of the divers as mentioned in subsection (1) is acquired through education and training.
(5) further Provisions concerning the requirements of divers, scuba gear requirements, operating guide dives, scuba diver education and training referred to in subsection (2), subsection (3), and subsection (4) is set by a decision of the Minister.
Article 44 (1) Attempt to salvage and/or underwater work can only be carried out by legal entities limited liability shaped Indonesia (PT), State-owned enterprises, Regional-owned enterprises, or cooperative.
(2) to perform business activities of salvage and/or underwater work as intended in paragraph (1) required to have a permit to salvage effort and/or work underwater.
(3) business license referred to in subsection (2) is given for a period as long as the company is concerned it is still running its business activities.
Article 45 (1) to obtain a business license to salvage and/or work under water as stipulated in article 44 paragraph (2) must be met for at least the following requirements: a. have or work in the fields of equipment master salvage or underwater employment;
b. have experts which consists of experts who have the ability to plan and execute the operation to salvage or work under water, and a team of divers that consists of 4 (four) divers; c. have a statute;

d. has a company domicile affidavits;

e. have the staple Taxpayer Number (NPWP).
(2) further Provisions concerning the requirements referred to in subsection (1) is governed by the decision of the Minister.
Article 46 (1) the application for business license salvage and/or work under water as stipulated in article 44 paragraph (2), submitted to the Minister.
(2) the grant or refusal of consent solicitation referred to in subsection (1) is granted for a period of fourteen (14) working days after the application is received in full.
(3) Refusal of application for business license salvage and/or underwater work referred to in subsection (2) is given in writing accompanied by the reason for rejection.
(4) further Provisions regarding the procedures of the petition, awarding, and the refusal of business license referred to in subsection (1), subsection (2) and paragraph (3) subject to the decision of the Minister.
Article 47 (1) the company's salvage and/or underwater work that has been getting a business license is required to: a. meet the obligations set out in the business license if there is a change in charge of the salvage and/or underwater employment; b. report of the company or company's domicile;

c. report its business activities every year to the giver of the consent.
(2) further Provisions regarding the procedures for reporting on business activities as intended paragraph (2) Letter c, subject to the decision of the Minister.
Article 48 (1) if the company is to salvage and/or underwater work violates the conditions as referred to in article 47 paragraph (1), subject to administrative sanctions.
(2) administrative Sanctions referred to in paragraph (1) was given-kan through the process of written warning as many as three (3) times consecutive air-join in with their respective grace period of 1 (one) month.
(3) when the warning referred to in subsection (2) is not above begging, followed by the freezing of business license and/or salvage work underwater for a period of 1 (one) month.
(4) if the period of the freeze to salvage a business license and/or underwater work referred to in subsection (3) has passed and no reparation, then the salvage business license and/or underwater work was revoked.
Article 49 business license salvage and/or employment under water can be revoked without going through the warning process and freeze the permit in case of the company in question: a. conduct activities endangering State security; or b. obtain permission to salvage effort and/or work underwater by way illegitimate.
CHAPTER VI TRANSITIONAL PROVISIONS article 50 with the introduction of government regulations, all regulations that were lower than government regulations governing the provisions on kenavigasian stated remains valid, as long as it does not conflict or has not been replaced with a new one based on government regulations.

CHAPTER VII PROVISIONS COVER Article 51 of this Regulation comes into force on the date of promulgation.
