ABOUT THE CIVIL EMERGENCY
IN THE MALUKU PROVINCE AND THE NORTH MALUKU PROVINCE

PRESIDENT OF THE REPUBLIC OF INDONESIA,

Weigh: a. That the communal conflict in the Moluccas and the North Moluccas continued and caused disruption of the infrastructure of life, especially those shown with the decline of the quality of social relations and the slowing of the wheels of the government;
B. that it is thus the execution of a civil emergency that is intended to dampen and stop any form of violence that is due to conflict, for the Moluccan Propinsi and the North Maluku Propinsi have not fully been able to show the results of which adequate for a variety of things;
c. that the implementation of the Maluku Agreement or the Malino II Agreement is an important milestone for the government and all the components of the community in particular the Moluccan Propinsi community and the North Molucsi Propinsi also still face various constraints, especially associated with the conditions in the field;
D. that for that it needs to be measures to further optimize the implementation of civil emergencies in the Molucsi Province and North Maluku Province through a policy of restructuring in order to be expected to be more conducive and possible. The acceleration is the solution;
e. that in connection with this, it is considered necessary to fine-tune the Presidential Decree No. 88 of 2000 on the State of Civil Emergency in the Moluccan Propinsi and the North Maluku Province;

Remembering: 1. Section 4 of the paragraph (1), Article 10, and Article 12 of the Basic Law of 1945;
2. Law No. 23 Prp 1959 On the State of Danger (State Sheet 1959 Number 139 Additional Gazette State Number 1908) as amended twice last by Law Number 52 Prp of the Year 1960;
3. Presidential Decree Number 88 Year 2000 on the Redemption of the Civil Emergency Situations in the Moluccan Propinsi and North Maluku Propinsi;

DECIDED:

SET: THE PRESIDENT 'S DECISION ON THE CHANGE TO THE PRESIDENT' S 2000 PRESIDENTIAL DECISION ON THE STATE OF CIVIL EMERGENCY IN THE MALUKU PROVINCE AND NORTH MALUKU PROVINCE.

Section 1
1. Changing the provisions of Article 2 of Presidential Decree No. 88 of 2000 so the whole reads as follows:

" Section 2
(1) The highest extent of civil emergency for the Moluccan Propinsi region and the North Moluccan Propinsi is carried out by the President.
(2) Selaku the Central Civil Emergency Authority, the President in exercising his power assisted by the Daily Managing Board with the membership arrangement as follows:
Chief: Coordinating Minister of State for Political and Security Affairs.
Member:
1. Home Secretary;
2. Foreign Minister;
3. Defence Minister;
4. Minister of Justice and Human Rights;
5. Attorney General;
6. Commander of the Indonesian National Army;
7. Head of the State Police of the Republic of Indonesia;
8. Chief of Staff of the Indonesian Army National Army;
9. The Chief of Staff of the Indonesian National Armed Forces of the Navy;
10. Chief of Staff of the Indonesian National Army Air Force;
11. Head of the State Intelligence Agency.
Secretary: Secretary of State Minister for Coordinating Political and Security Affairs.
(3) The Daily Managing Board Membership as referred to in paragraph (2) may be plus as needed. "

2. Add to the provisions of Article 2A in Presidential Decree No. 88 of 2000 which reads as follows:

" Article 2A
The Daily Managing Board has a task:
a. coordinate government agencies related to the mastery of civil emergencies in order of drafting and preparation of policies and programs and its execution and control, with respect to the comprehensive resolution of communal conflict and integrated;
B. Coordinating and conducting the implementation of the instructions or order of the President as the Central Civil Emergency Authority to the Governor of Maluku and the Governor of the North Maluku as the Civil Emergency Authority of the Regions accompanied by the accountability of the Governor of Maluku and The Governor of the North Maluku as the Regional Civil Code of Emergency to the President as the Central Civil Emergency.
c. The delivery of policy proposals and necessary advice to the President as the Central Civil Emergency Master in order of decision and guidance required for the completion of the resolution of the communal conflict quickly, fluent and orderly;
D. implement measures that maintain preventive activities, denial and cessation of violence, whether armed violence, physical and psychic violence or other or in the form of polysional actions in accordance with the provisions of the laws applicable in the framework of law enforcement and justice;
e. Assistance for the assistance of the Governor of Maluku and the Governor of the North Maluku as the Regional Civil Emergency Master in performing his duties;
f. Consideration and advice to the President as the Central Civil Code of Emergency, which concerns the treatment of a civil emergency either the removal or revocation of all or part of a civil emergency, maintaining and establishing a civil emergency or upgrade it as a military emergency or war emergency;
G. control and supervision over the execution of all policies, programs and activities of all government agencies related in order to resolve the communal conflict in the Moluccan Propinsi and North Maluku Province;
h. the delivery of the report by the Daily Managing Editor both routinely and incidental to the President as the Central Civil Emergency Lord, accompanied by consideration and advice. "

3. Add to the provisions of Article 2B of Presidential Decree No. 88 of 2000 which reads as follows:

" Article 2B
In carrying out the duties as referred to in Section 2A, the Daily Managing Board organizes the function:
a. perumusan, drafting and preparation of policy concepts, programs and activities related to comprehensive and integrated efforts and measures in order to resolve the communal conflict in the Moluccan Propinsi and North Maluku Province;
B. the hosting of working relationships, coordination and cooperation with the relevant government agencies and all the ranks of government or non-government agencies and all of the community components;
(c) the IBM Cloud Service and the IBM International Security Service ("IBM") and the IBM International Conference on Cloud ("IBM"), and the IBM International Security Service ("IBM"), and the following terms: D. coordinate in order to conduct the policy, program and activities of the Daily Managing Board which concerns a problem to the relevant government agencies to seek a solution of the solution;
e. Regular meetings or dialogue with related officials, experts and public figures and religious figures with a persuasive approach in order to solve all problems in the Moluccan and Propinsi Processions. Northern Maluku;
